RE: APPROVAL OF RECORDED EXEMPTION NO. 1223 - JOSEPH L. BOSWORTH
AND GLENN K. BAILEY
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners, pursuant to its
authority under Section 30-28-101 (10) (d) , CRS, as amended , did
determine at a public meeting held in the Chambers of the Board,
that a certain parcel of land, to be divided into two parcels, as
shown on the plat known as Recorded Exemption No. 1223 does not
come within the purview of the definition of the terms,
"subdivision" and "subdivided land" , and
WHEREAS, the request for Recorded Exemption No. 1223 was
submitted by Joseph L. Bosworth and Glenn K. Bailey for property
which is located in the SEi , Section 31 , Township 7 North, Range
66 West of the 6th P.M. , Weld County, Colorado, being more
particularly described in the plat which shall be provided by the
applicant and known as Exhibit "A" , said plat to be recorded, and
WHEREAS , this request is to divide the property into parcels
estimated to be approximately 155 acres and 5 acres.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the hereinabove
described parcel of land be, and hereby is , exempt from the
definition of the terms, "subdivision" and "subdivided land" .
BE IT FURTHER RESOLVED by the Board that this approval is
subject to the following conditions:
1 . The applicant shall submit a mylar plat to the
Department of Planning Services to be recorded in the
office of the Weld County Clerk and Recorder. The plat
shall be drawn in accordance with the requirements of
Section 9-2C. (4 ) of the Weld County Subdivision
Regulations. The plat shall be submitted within sixty
days from the date of approval by the Board of County
Commissioners.
2 . A Weld County septic permit is required for the proposed
home and its septic system shall be installed according
to the Weld County Individuals Sewage Disposal System
(ISDS) regulations.

3. An ISDS evaluation on all existing septic systems will
be necessary prior to issuing the required septic
permits on the existing systems.
4 . The Recorded Exemption mylar plat shall show the Eaton
McClelland Ditch right-of-way excluded from this parcel.
5 . The Recorded Exemption plat shall show a fifty foot
right-of-way reservation from the centerline of Weld
County Road 74 .
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 6th day of

Dear Commissioners:
This request for a recorded exemption is submitted by Joseph L. Bosworth and
Glenn K. Bailey. The parcel of land is described as the southeast 1/4 of
Section 31, T7N, R66W of the 6th P.M. , Weld County, Colorado. The property
is located north of Weld County Road 74 and west of Weld County Read 27.
This request is to divide a 160 acre parcel, which is the total contiguous
land holdings of the applicants, into two lots of 155 acres and 5 acres,
more or less. The proposed larger lot contains two dwellings.
The applicants propose using North Weld County Water District as the water
source for both lots. Septic systems will provide sewage disposal.
The staff has concerns that the proposed division will be inconsistent with
efficient and orderly development. This quarter section was conveyed by
Guttersen and Company during 1989 about the same time the 7 parcels were
created by Cuttersen and Company in the section southeast of this section.
The level of development in this area and the potential for continued
divisions to occur warrants concern. Residential development in rural areas
necessitates an increased demand for road maintenance, police and fire
protection, school busing, snow removal, utilities, and other urban
services. As density increases, so do service demands.
The staff requests that the Board of County Commissioners consider the
application and determine if the standards of Section 9-2 E. (1) (a) through
(m) of the Weld County Subdivision Regulations have been met.

The applicant shall submit a mylar plat to the Department of Planning
Services to be recorded in the office of the Weld County Clerk and Recorder.
The plat shall be prepared in accordance with the requirements of Section
9-2 C. (4) of the Weld County Subdivision Regulations. The plat shall be
submitted within 60 days from the date of approval by the Board of County
Commissioners. The applicant shall be responsible for paying the recording
fees.
A Weld County septic permit is required for the proposed home and its septic

#4 PURPOSE AND REASON FOR DIVIDING LOT INTO TWO SEPARATE LOTS
The purpose of dividing the lot is to be able to convey to Gary and Karen Buxton, five acres on the southwest
corner of the above described property. The Buxtons plan to build a home on said property. The Buxton will
eventually have an interest in the entire property though they are not currently fee owners.
#5 PROPOSAL IN RELATION TO WELD CO. COMPREHENSIVE PLAN
Though this area is currently zoned agricultural,the intent is to remove five acres which have never been irrigated
and apparently have never been utilized for any agricultural purpose. The property is currently considered pasture
by the county assessors office. At one point it appears that there was a small home or dwelling of some sort on this
portion of the property which had been assigned an address by the county.
#6 PROPOSAL IN RELATION TO THE ZONE DISTRICT
The purpose is to remove non-productive farm land from the existing property which is compatible with the zone
district and will not interfere with farming operations.
#7 PERMITTED USES AND COMPATIBILITY WITH EXISTING SURROUNDING LAND
USES
One home site on five acres will not interfere with orderly development and will not create an impact which is
inefficient or unorderly. The surrounding property is primarily agricultural and would not be affected by improve-
ments on this five acre lot. The property sits on the corner of the quarter section with access directly to the county
road. A driveway to the proposed home would be the only access from the north side of the highway in the quarter
section.Access to the tillable portion of this quarter section has historically been from other locations.
#8 COMPATIBILITY WITH FUTURE DEVELOPMENT OF THE SURROUNDING AREA
The area is intended to remain agricultural in the future and is compatible with other large lot development
occurring around Woods Lake and on other properties in the surrounding area.
#9 CONSISTENCY WITH EFFICIENT AND ORDERLY DEVELOPMENT
This five acre parcel is not in the pathway of any urban development. The property is rural in nature and is five
miles from Eaton and two miles from Severance.
#10 EXISTING OR PROPOSED WATER AND SEWAGE DISPOSAL METHODS
The property is on the north side of Highway 74 which is the same side as a water line belonging to North Weld
County Water District. The District has assured us that a tap would be allowed.
It is understood that a septic system would be required for sewage disposal.
#11 PROPERTY IN RELATION TO A FLOOD PLAIN,GEOGRAPHIC HAZARD OR WELD
COUNTY AIRPORT OVERLAY DISTRICT
The property is not located in a flood plain or a geographic hazard and is not in the Weld County Airport Overlay
District. The application complies with Section 50, Overlay District Regulations, as outlined in the Weld County
Zoning Ordinance.
