RE: APPROVAL OF RECORDED EXEMPTION NO. 755 - CHARLES T. COLLOPY,
TRUSTEE, ET AL.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners, pursuant to its
authority under Section 30-28-101 (10) (d) , CRS , as amended, did
determine at a public meeting held in the Chambers of the Board,
that a certain parcel of land, to be divided into two parcels , as
shown on the plat known as Recorded Exemption No. 755 , does not
come within the purview of the definition of the terms ,
"subdivision" and "subdivided land" , and
WHEREAS, the request for Recorded Exemption No. 755 was
submitted by Charles T. Collopy, Trustee, et al. for property
which is located in part of the SE3 , Section 9 , Township 6 North,
Range 67 West of the 6th P.M. , Weld County, Colorado, being more
particularly described in the plat which shall be provided by the
applicant and known as Exhibit "A" , said plat to be recorded, and
WHEREAS , this request is to divide the property into parce) r;
estimated to be approximately 21 acres and 100 acres.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the hereinabove
described parcel of land be, and hereby is, exempt from the
definition of the terms , "subdivision" and "subdivided land" .
BE IT FURTHER RESOLVED by the Board that this approval is
conditional upon the applicant submitting a mylar plat to the
Department of Planning Services to be recorded in the office of
the Weld County Clerk and Recorder. The plat shall be drawn in
accordance with the requirements of Section 9-2C. (4) of the Weld
County Subdivision Regulations . The plat shall be submitted
within sixty days from the date of approval by the Board of County
Commissioners.

Dear Commissioners:
This request for a recorded exemption is submitted by Charles T. Ccllopy,
Trustee, et al. The parcel of land on which this request is being made is
described as Part of the SEA, Section 9, T6N, R67W of the 6th P.M. , Weld
County, Colorado. The property is located approximately one mile north of
Windsor on Weld County Road 19. The parcel of land under consideratior is
the total contiguous land holdings of the applicant.
The request is to divide the property into parcels of 20.797 acres and 100.2
acres, more or less. The applicant wishes to split the 121 acre parcel
along a boundary partially created by an existing irrigation ditch. The
smaller proposed Lot A is presently an agricultural residence with pasture
area. The applicant wishes to sell this site. The larger parcel would
continue to be leased and farmed by a tenant.
Based upon the submitted information and policies of the County, the
Department of Planning Services staff recommends the request be approved for
the following reasons:
1 . The applicant has demonstrated in the submitted application
materials that the request complies the submission
requirements of Section 9-2 C. of the Weld County Subdivision
Regulations.
2. The applicant has demonstrated in the submitted application
materials that the standards and conditions of Section 9-2 F.
(1) (a) through (a) of the Weld County Subdivision
Regulations have been met.

The Department of Planning Services staff recommendation for approval is
conditional upon the following:
1 . The applicant shall submit a mylar plat to the Department of Planning
Services to be recorded in the office of the Weld County Clerk rand
Recorder. The plat shall be drawn in accordance with the requirements
of Section 9-2 C. (4) of the Weld County Subdivision Regulations. ^.be
plat shall be submitted within sixty (60) days from the date cf
approval by the Board of County Commissioners.

Re: Application for Recorded Exemption
Gentlemen:
Attached to this letter are the following: $100.00 application fee;
completed and signed Application; completed Certificate of Conveyances; copy
of Deed showing existing owners and legal description; draft plat as prepared
by McRae and Short, Inc. ; and the following letter explaining the request.
The purpose of this request is to divide an existing acreage into two
parcels. The reason for this request is that the existing owners of the
property do not live on the farm and are not in need of having a farmer or
tenant live upon the property as the same is leased to a neighbor. The shape
of the smaller parcel (Lot A) is created based upon an existing irrigation
ditch and marginal pasture land. The remaining acreage of the property (Lot
B) is adequate agricultural land whereas Lot A is not considered fine
agricultural property.
This request is consistent with the policies of the Weld County
Comprehensive Plan and the intent of the agricultural district as all
surrounding uses are agricultural as well as agricultural and residential due
to the nearness of the location to the Town of Windsor. This request is
further compatible with proposed future development as the Town of Windsor has
proposed to annex land immediately South of these parcels and develop the same
for residential and estate lots. Due to the annexation by the Town of Windsor
this proposal is consistent with efficient and orderly development.
To the best of our knowledge this property is not located within a flood
plain, geologic hazard area or any overlay district and sewage disposal shall
be on-site septic tank and leach lines. Water is presently provided and can
be provided to the property in the future by the North Weld County' Water
District.
