WHEREAS , the Board of County Commissioners of Weld Count'
Colorado, pursuant to Colorado statute and the Weld County ion('
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners, pursuant to
authority under Section 30-28-101 (10) (d) , CRS , as amended, die
determine at a public meeting held in the Chambers of the Board .
that a certain parcel of land, to be divided into two parcels , ris
shown on the plat known as Recorded Exemption No. 752 , does nct
come within the purview of the definition of the terms ,
"subdivision" and "subdivided land" , and
WHEREAS, the request for Recorded Exemption No. 752 way:.
submitted by H. Kent Everett for property which is located in Part
of the NW4, Section 32 , Township 7 North, Range 65 West of the 6th
P.M. , Weld County, Colorado, being more particularly described _ir
the plat which shall be provided by the applicant and known as,
Exhibit "A" , said plat to be recorded , and
WHEREAS, this request is to divide the property into parse :.

NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the hereinabo,,e

BE IT FURTHER RESOLVED by the Board that this approva _

Pear Commissioners:
This request for a recorded exemption is submitted by H. Kent Everett . ^.he
parcel of land on which this request is being made is described as Pt . DW,
of Section 32, T7N, R65W of the 6th P.M. , Weld County, Colorado. The
property is located 1-1/2 miles east of Eaton on a private road with access
to Weld County Road 76. The parcel of land under consideration is the ' . ial
contiguous land holdings of the applicant.
The request is to divide the property into parcels of 1 .2 acres and ' . 1
acres, more or less. Mr. & Mrs Everett wish to retain Lot A as tlA it
personal residence and sell. Lot B as an agricultural homesite. "'his
property was previously divided prior to the approval of I.bd'vi ,:or
Exemption 4(. (recorded December 21 , 1977) , which joined the 2.3 acres Ito
One legal lot. The applicants have altered the proposed lot line end : re
applying foi a recorded exemption in order to create a building site for lot
B.
Based upon the submitted information and policies o:. the Count -, the
Department cf Planning Services staff recommends the request be appr:re; • c,r
the following reasons:
1. The applicant has demonstrated in the submitted application
materials that the request complies the submission
requirements of Section 9-2 C. of the Weld County Subdivision
Regulations.
2. The applicant has demonstrated in the submitted application
materials that the standards and conditions cf Section 9-2 F.

We are requesting a recorded exemption to divide one lot into two lots .
When I originally bought my house it was my understanding that two separa' I
lots already existed; there was a one acre parcel where the house sits ant
another 1.3 acre parcel added to it. We have always received two separat •
tax notices therefore I assumed two separate lots existed. Upon doing som
research, I found that the 1.3 acre parcel was added to the original one ire
and is not recorded separately.
Since a recorded exemption is required to do this, I would like to change , he
boundary so that both lots would have a more practical size and shape. I nouLd
intend to sell Parcel B for an approximate 1.2 acre home site. Parcel B would
be consistent with the Weld County Comprehensive Plan in that there are ecstin .,
previously approved residential lots adjacent presently,.
I will not be taking any agricultural land out of production but turning
dormant land that is presently planted in grass (and weed) and better ntil ; zing
it as a home site. This will be consistent with the existing nature of tcc•
single family residential estate area, although the general area is zoned "ag".
The uses will be residential on the approximately 1.2 acres of ground ik..r a] 1
the other houses in the neighborhood. This will he one of the last lots railallc
in this area and, there fore, I do not anticipate further expansion of resii' ntia
development. This is compatible with existing zoning and with future devlopme, t
as projected by the Comprehensive Plan of the County.
Domestic water service will come from North Weld Water Company who have a water
line beside Road 76 which runs directly in front of the proposed lot. Al : houses
in the area have septic tanks with a leeching field.
This land is on a bill and therefore is not located on a flood plane, geoL,gic
hazard, and/or Weld County Airport overlay district.
The property would have direct access off Road 76 and need no clearance or
right-of-way through other property.
