RE: APPROVE REPLAT OF LOT 6 , BLOCK 2, SEEMORE HEIGHTS SUBDIVISION
- DAVID PIETRANGELO
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, on the 27th day of April, 1988, a public hearing was
held before the Board of County Commissioners of Weld County,
Colorado, to consider the application of David Pietrangelo for the
replat of Lot 6 , Block 2, Seemore Heights Subdivision, Weld
County, Colorado, and
WHEREAS, said Lot is located on the following real estate,
to-wit:
Part of the NW} of Section 30, Township 3
North, Range 68 West of the 6th P.M. , Weld
County, Colorado
WHEREAS, the Board heard the testimony and statements of
those present, studied the recommendation of the Weld County
Planning Commission and, being fully informed, is satisfied that
the proposed replat conforms in all respects to the requirements
of the Weld County Zoning Ordinance.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the replat of Lot 6,
Block 2 , Seemore Heights Subdivision, requested by David
Pietrangelo, be, and hereby is, approved subject to the following
condition:
1 . No building or electrical permits shall be issued on the
property until the resubdivision plat has been delivered
to the Department of Planning Services Office and the
plat is ready to be recorded in the office of the Weld
County Clerk and Recorder.

RESOLUTION OF RECOMMENDATION TO THE BOARD OF COUNTY COMMISSIONERS
Moved by Louis Rademacher that the following resolution be introduced for
passage by the Weld County Planning Commission. Be it Resolved by the Weld
County Planning Commission that the application for:

LOCATION: Approximately 2.5 miles southwest of the Town of Mead; south of
State Highway 66 and east of Weld County Road 1 .
be recommended favorably to the board of County Commissioners for the
following reasons:
1 . The submitted materials are in compliance with the application
requirements of Section 6-4 B. of the Weld County Subdivision
Regulations.
2. It is the opinion of the Weld County Planning Commission that the
applicant has shown compliance with Section 6-4 E. of the Weld
County Subdivision Regulations as follows:
- No lots are being created that are less than the minimum
requirements for area and dimensions as established by
the Weld County Subdivision Regulations or other
applicable ordinances.
- Drainage easements or rights-of-way reserved for
drainage will not be changed.
- The proposed resubdivision plat will not be altered in
any way which will adversely affect the character of the
plat filed.
3. The following referral entities have reviewed this request and set
forth no objections:
- The Weld County Engineering Department;
- The City of Longmont;
- The Longmont Fire Protection District;
- The Longmont Soil Conservation Service; and
- The Town of Mead
4. The Weld County Utilities Coordinating Committee recommended
approval of this request at its meeting on March 24, 1988.

5. The Department of Planning Services has not received any
objections from surrounding property owners.
6. On April 14, 1988, the Board of Adjustment approved an offset
variance of 11 inches from the northern property line of this lot.
This recommendation is based, in part, upon a review of the application
submitted by the applicant, other relevant information regarding the request
and the responses of the referral entities which have reviewed this request.
The Planning Commission's recommendation for approval is conditional upon
the following:
1. No building or electrical permits shall be issued on the property
until the resubdivision plat has been delivered to the Department
of Planning Service's Office, and the plat is ready to be recorded
in the office of the Weld County Clerk and Recorder.

APPEARANCE:
David Pietrangelo, property owner and applicant, this request for a Special
Review permit is for a building in excess of 1,500 square feet in a platted
subdivision. It is a well constructed building, put up by a reputable
dealer, and the color contrasts well with other building in the subdivision
and on the property.
The Chairman called for discussion from the members of the audience. There
was none.
The Chairman asked Yr. Pietrangelo if he had any problems with the
recommendation, conditions, and Development Standards as presented by the
staff": Fe stated he has no problems with these.

The square mile in which Applicants ' property, known by
mailing address as 13801 Elmore Road, Longmont, CO 80501, in Weld
County, Colorado, is situated is zoned rural residential. The
surrounding area is zoned agricultural. Across State Highway 66,
for example, North of the Applicants' property is situated
Longmont Dairy Farm. Within the square mile rural residential
area, the residents carry on agriculturally-related pursuits such
as keeping horses and poultry. Applicants ' operate a hay
business where they grow, swath and bale hay for sale on nearby
leased properties in Weld and Boulder Counties and do some
custom swathing and baling.
In Applicants ' subdivision, many residents have a multitude
of sheds and outbuildings used for equipment and machine storage,
as well as for keeping animals and poultry. Applicants, in
connection with haying activities, have 2 field tractors together
with implements necessary for swathing and baling and including
tractor accessories of general use such as buckets and blades.
Applicants' agricultural equipment is large and the accessories
for the tractors are numerous. During much of the year, the
equipment is not needed for field work.
Applicants wished to obtain a large outbuilding in which to store
their field tractors and implements in the idle winter months,
and which would provide space for casual hay storage and
consolidation of existing sheds and outbuildings. Accordingly,
they contacted John Stark of Morton Buildings, known to be a
reputable and capable installer of packaged buildings and dealer
believed to be active in Weld County and knowledgeable about
county building requirements. It was at Applicants' express
insistence that John Stark went to the county building department
office to ensure compliance with permit requirements. John Stark
reported he had been advised no permit for the building was
required. Applicants subsequently paid $15, 000. 00 for the
packaged pole-building shed which was sited in reliance upon John
Stark's expertise and knowledge of county requirements for set-
backs. John Stark advised that the county side-line set-back
requirement was 5 feet, so the building was sited 6 feet off the
North lot side-line. It developed the set-back for side-lines is
7 feet.
Subsequently, a few months after the building was erected and the
purchase price paid, it was red-tagged by the county. At the
hearing as to a violation of permit requirements, the building
inspection division admitted it had been contacted by John Stark,
who'd appeared there in person, and that it was probable he had
been misinformed as to permit requirements.
Applicants, who had paid a lot of money and had dealt with a firm
they believed to be reputable and knowledgeable, then learned
very little was in conformance with county regulations. The
building was sited one foot too close to the North lot side-line.
It had too much square footage. It stood in the back line
utility easement prescribed for platted lots. It is not disputed

that Applicants acted prudently, reasonably, and in good faith
and are blameless in all of this.
As to the side-line set-back, the building presents a closed wall
to the North, no smells or lights emanate to the North, and the
neighbors haven't objected or complained to the Applicants. It
is estimated it would cost $4000. 00-5000. 00 to move the building
one foot South to conform to the set-back requirements.
As for square footage, Applicants just wanted a building to store
their equipment, just as their neighbors have outbuildings, to
store theirs. Applicants ' field tractors and implements are
larger than the equipment of their neighbors and therefore
Applicants need a larger storage building to enjoy the same
benefit. The building was sited to one side of the lot
specifically so as not to interfere with the view to the West of
residents immediately to the East. Residents to the East of the
Applicants ' property are at a higher elevation, the building is
offset so as not to affect those residents' view to the West,
and Applicants are aware of no complaints or objections of
residents to the East of them.
As for the matter of the back-line lot easement for utilities,
utilities for residents on Elmore Road are in the road (water,
gas) or overhead along the road frontage (electricity) , and a
number of outbuildings on lots encroach on the back-line lot
easement. This matter is a subject of a separate request to
replat Applicants ' lot to include land to the West which they own
adjacent to the platted lot.
