RE: ACTION OF BOARD CONCERNING PETITION FOR LOCAL IMPROVEMENT
DISTRICT - 71ST AVENUE
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, a Petition for a Local Improvement District was
submitted to the Board by owners of property which is more
particularly described in said petition, and
WHEREAS , after review, the Board deems it advisable to refer
said petition to the Weld County Engineering Department for its
recommendation, a copy of said petition being attached hereto and
incorporated herein by reference, and
WHEREAS , the Board further deems it advisable to schedule the
Preliminary Hearing concerning this matter for March 1 , 1989 , at
9 : 00 a.m.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the aforementioned
Petition for a Local Improvement District be, and hereby is ,
referred to the Weld County Engineering Department for
recommendation.
BE IT FURTHER RESOLVED by the Board that the date for the
Preliminary Hearing concerning this matter be, and hereby is,
scheduled for March 1 , 1989 , at 9 : 00 a.m.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 1st day of
February, A.D. , 1989.

of record of real property proposed to be assessed more than
one-half of the costs assessed for the project and which property
will benefit from improvements in the area of (describe general
area to be improved) :
71st Avenue between U.S. 34 Business Route (also known
as West 10th Street) and U.S . 34 Bypass; and 77th Avenue
between U.S. 34 Business Route and 12th Street; and 76th
Avenue between 11th Street and 12th Street; and 11th
Street between 77th Avenue and 76th Avenue; and 12th
Street between 77th Avenue; and 12th Street between 77th
Avenue and 76th Avenue in an area generally west of the
developed portion of the City of Greeley.
situated in Weld County, Colorado, do hereby petition the
Honorable Board of County Commissioners of the County of Weld,
State of Colorado, for the formation of a local improvement
district pursuant to C.R.S . , §30-20-601 , et seq. Such improvement
district is for the purpose of (may include road improvements,
street lighting, or drainage) :
Road improvements and drainage incident to road
improvements .
The specific improvements we wish to have constructed are as
follows (designation of specifics , optional) :
Shape , grade , drain, and pave the above-described roads.
We request that the following materials be used:
Six inches of aggregate basecourse and three inches of
asphalt pavement on 71st Avenue; and two inches of
aggregate basecourse and two inches of asphalt pavement
on 77th Avenue, 76th Avenue, 11th Street, and 12th
Street; and culverts necessary to accomplish drainage.
We request that the cost of the improvements not exceed $950 . 00
per individual subdivision lot or separate parcel of land.

- The specific time and manner_ of assessments we recommend is as
follows: - : -
The property _ owners be assessed equally on a per lot
basis for all lots within Knaus Subdivision 1st, 2nd,
and 3rd Filings; Bird Subdivision; and Peterson-
Alexander Subdivision , excepting Lot 5 , Block 1 ; and for
each individual parcel of land adjoining 71st Avenue
between U.S . 34 Business Route and U.S . 34 Bypass for
the cost of materials and labor for the installation of
asphalt.
The assessment shall be payable either in full, without
interest, or over a ten-year period at the rate of ten
percent (10%) simple interest per annum.
We further understand and acknowledge that we are to be
responsible individually for any grading or other adjustments to
our driveways and culverts necessitated by such project.
Do not sign this petition unless you are an "owner" of real
property benefitting from the project and requesting to be
assessed costs of the improvements . An owner is a person holding
fee title to real property. You are an "owner" if you hold a
contract to purchase real property which obligates you to pay
general taxes on that property. In that instance , the seller may

We , the undersigned , citizens of Weld County who are owners
of record of real property proposed to be assessed more than
one-half of the costs assessed for the project and which property
will benefit from improvements in the area of (describe general

71st Avenue between U.S . 34 Business Route (also known
as West 10th Street) and U.S . 34 Bypass ; and 77th Avenue
between U.S . 34 Business Route and 12th Street; and 76th
Avenue between 11th Street and 12th Street; and 11th
Street between 77th Avenue and 76th Avenue ; and 12th
Street between 77th Avenue; and 12th Street between 77th
Avenue and 76th Avenue in an area generally west of the
developed portion of the City of Greeley.
situated in Weld County, Colorado, do hereby petition the
Honorable Board of County Commissioners of the County of Weld ,
State of Colorado , for the formation of a local improvement
district pursuant to C. R.S . , §30-20-601 , et seq. Such improvement
district is for the purpose of (may include road improvements ,
street lighting, or drainage) :
Road improvements and drainage incident to road
improvements .
The specific improvements we wish to have constructed are as
follows (designation of specifics , optional) :
Shape , grade , drain, and pave the above-described roads .
We recuest that the following materials be used:
Six inches of aggregate basecourse and three inches of
asphalt pavement on 71st Avenue ; and two inches of
aggregate basecourse and two inches of asphalt pavement
on 77th Avenue , 76th Avenue , 11th Street , and 12th
Street; and culverts necessary to accomplish drainage.
We request that the cost of the improvements not exceed $950 . 00
per individual subdivision lot or separate parcel of land .

The .specific time and manner of assessments we recommend is as

The property owners be assessed equally on a per lot
basis for all lots within Knaus Subdivision 1st, .2nd ,
and 3rd Filings ; Bird Subdivision; and Peterson-
Alexander Subdivision , excepting Lot 5 , Block 1 ; and for
each individual parcel of land adjoining 71st Avenue
between U.S . 34 Business Route and U.S . 34 Bypass for
the cost of materials and labor for the installation of
asphalt.
The assessment shall be payable either in full, without
interest , or over a ten-year period at the rate of ten
percent (10% ) simple interest per annum.
We further understand and acknowledge that we are to be
respcnsible individually for any grading or other adjustments to
cur driveways and culverts necessitated by such project.
Do not sign this petition unless you are an "owner" of real
property benefitting from the project and requesting to be
assessed costs of the improvements . An owner is a person holding
tee title to real property . You are an "owner" if you hold a
contract to purchase real property which obligates you to pay

Dear Sir,
I am writing you in regard to the maintenance ( or lack of maintenance) of
71st Ave between HWY 34 business and HWY 34 bypass. I live in the Knaus
Subdivision directly West of this road. Everyone that 1 talk to complains
about this road. It is one of the worse roads that I have seen or in this
case FELT in this area. This road is heavily traveled by residents of this
area, farmers, oil and gas vehicles and employees of HP and associated
manufacturing facilities.
The road is a washboard. The road is graded about once every 1 or 2
weeks, but I think the County is wasting their money on equipment and
labor, The road is just as bad the day after the road is graded as it was
before. This makes it appear as though the grader is just filling in the
ruts with loose gravel. I know that the grader operator wants to save the
blade surfaces but this appears to be somewhat rediculous. One pass by
the grader up and down the road does not appear to be cutting it (so to
speak). Also, there are times that ridges are left on the side of the road
so if 1t rains, the water runs down the road rather that in the ditch. This
makes the road condition even worse.
Besides being a real pain in the neck, the road is hard on all vehicles and
is a safety concern. I have seen people that have not driven on the road
before hit the ruts and slide sideways on the road. People drive in the
opposite lane searching for a smooth section in which to drive. People
also drive in the ditch because It happens to be the smoothest
part of the road.
I have been patient for the 4 years that I have lived in this area, thinking
that the situation would get better. However, the situation has not
improved. It has gotten worse. Last year, I thought that the County was
getting serious about doing something since they applied some type of �,,�,-t�
liquid to tJe road. This may have helped for about 2 weeks but then the 7,_-7

road was back to the normal condition which is bad!
The County should consider either paving all or part of 71st Ave or
providing better maintenance to improve this road condition. If it is
decided that nothing will be done, you might want to put up a sign that
indicates that there is DANGER DUE TO ROUGH ROAD, This would at
least let people know what the conditions are and would also send a
message to the people of Greeley and Weld County indicating that the
county recognizes the concern in this area but cannot or will not do
anything about it.
Residents of this subdivision have started utilizing the west
exit/entrance to the subdivision due to the rediculous condition of 71st
Ave. The additional traffic to this area has caused the road conditions in
this area to also become worse. I am concerned about the traffic entering
the subdivision at this entrance. There is no turn lane to exit HWY 34 at
this point. Some one 1s going to be hurt at this entrance and it may be
related to the condition of 71st Ave.
