RE: APPROVE STATEMENT OF AGREEMENT AND AUTHORIZE CHAIRMAN TO SIGN
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with a Statement of
Agreement concerning Operational and Emergency Notifications for
the Fort St. Vrain Nuclear Generating Station, and
WHEREAS , after review, the Board deems it advisable to
approve said Statement, a copy of which is attached hereto and
incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the Statement of
Agreement concerning Operational and Emergency Notifications for
the Fort St. Vrain Nuclear Generating Station be, and hereby is,
approved.
BE IT FURTHER RESOLVED by the Board that the Chairman be, and
hereby is, authorized to sign said Statement of Agreement.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 14th day of
August, A.D. , 1989.

STATEMENT OF AGREEMENT
OPERATIONAL AND EMERGENCY NOTIFICATIONS
FORT ST. VRAIN NUCLEAR GENERATING STATION
The State of Colorado (State), Weld County (Local ) and Public
Service Company of Colorado (PSC) recognize the need to establish and
maintain effective communications concerning the operation of, and
emergency response to, the Fort St. Vrain Nuclear Generating Station
(FSV). Responsibilities and pre-planned response actions have been
established in various forms, including the Colorado Radiological
Emergency Response Plan (RERP) for FSV (Annex 24 to the State
Emergency Operations Plan) , Weld County Contingency Plan for the FSV
RERP and the station' s RERP-PLANT (collectively referred herein as
"plans"). This agreement acknowledges our responsibilities to
communicate between FSV, State and Local governments.
Public Service Company of Colorado agrees to the responsibility
of notifying State and Local authorities of any abnormal situations
which could lead to public concern or could degrade the health and
safety of the public and/or environment. These potential situations
have been recognized in the station's Emergency Action Levels (EAL's)
contained within the emergency classification procedure(s). PSC
agrees to notify the designated State and Local agencies in
accordance with the Code of Federal Regulations, Part 50; NUREG-0654,
FEMA-REP-1, Rev. 1; and established, approved station procedures.
These notifications will include, as a minimum, the following
emergency classifications; "Notification of Unusual Event" , "Alert",
"Site Area Emergency" and "General Emergency" as defined in the
plans. These emergency classifications will be determined in
accordance with established procedures. FSV agrees to distribute the
station' s classification procedure(s), including the approved EAL' s
to the Colorado Division of Disaster Emergency Services and the
Colorado Department of Health.
Public Service Company of Colorado further agrees to a request
by the State of Colorado for the establishment of another
notification process entitled "State Advisory" for any unplanned
radiological release up to the limits identified in the FSV Technical
Specifications, or any planned release which exceeds two times the
maximum permissible concentration (MPC), but is under the Technical
Specification limit. This State Advisory will notify the Colorado
Department of Health and allow them the opportunity to monitor
environmental impacts from the station. The establishment of the
State Advisory notification process resulted from a meeting held
April 22, 1988, between members of the Colorado Department of Health,
Colorado Division of Disaster Emergency Services and PSC.

The State and Local notification contacts identified in the
plans further agree to verify all emergency notifications, not made
via a dedicated link, by calling the Fort St. Vrain Shift Supervisor,
a PSC management representative, or a PSC emergency director to
validate the notification. The State and PSC also agree that it will
be the responsibility of the State, via the Colorado Department of
Health, to establish and operate a public inquiry center. PSC agrees
to supplement this center with its customer service department, as
needed.
We, the undersigned, hereby concur to the responsibilities
identified within this notification agreement, and will perform, or
cause to be performed, the responsibilities set forth in this
agreement to the best of our ability.
This agreement supercedes all previous notification agreements
and will remain in place until revised, replaced or deleted by mutual
consent.
