RE: APPROVE CONTINUANCE OF HEARING TO CONSIDER REQUEST OF LARRY
SMITH FOR SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW
PERMIT
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners held a public
hearing on the 4th day of October, 1989 , at the hour of 10 : 00 a.m.
in the Chambers of the Board for the purpose of considering the
request of Larry Smith for a Site Specific Development Plan and
Special Review Permit for an accessory building with gross floor
area larger than 1 , 500 square feet in an approved and recorded
subdivision, and
WHEREAS, R. Russell Anson, Attorney representing the
applicant, requested continuance of this hearing so that
additional work can be done on the application, and
WHEREAS, after study and review, the Board deemed it
advisable to continue said hearing to a non-specified date,
requiring that the continued hearing shall be advertised and
surrounding property owners shall be notified of said hearing by
mail.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the hearing to
consider the request of Larry Smith for a Site Specific
Development Plan and Special Review Permit be, and hereby is,
continued to a non-specified date .
BE IT FURTHER RESOLVED by the Board that the continued
hearing shall be advertised and the surrounding property owners
shall be notified of said hearing by mail.

A public hearing was conducted on October 4, 1989, at 10:00 A.M. , with
the following present:

Commissioner Constance L. Harbert
Commissioner George Kennedy
Commissioner Gordon E. Lacy
Also present:

The following business was transacted:
I hereby certify that pursuant to a notice dated September 18, 1989,
and duly published September 21, 1989, in The New News, a public
hearing was conducted to consider the application of Larry W. Smith for
a Site Specific Development Plan and Special Review Permit for an
accessory building with gross floor area larger than 1,500 square feet
in an approved and recorded subdivision. Lee Morrison, Assistant
County Attorney, made this matter of record. Lanell Curry, Planning
Department representative, said a letter was received from Russ Anson,
attorney for the applicant, requesting a continuance. Mr. Anson
explained that this continuance was requested to allow the applicant
additional time to make his application more agreeable to his
neighbors. Fred Otis, attorney representing some of the area
homeowners, asked that this hearing be conducted today and reviewed the
history of this case. Neighbors Robert Lozinski and John McCamey
objected to continuing this hearing to a later date. Mr. Anson stated
that the applicant has no objection to taking testimony today from
those who do not wish, or will be unable, to return to a later hearing.
Commissioner Kennedy moved to start the hearing today, without
discussing the possibility of future changes. The motion died for lack
of a second. Commissioner Lacy moved to continue this hearing to a
non-specified date, noting that continuation to a non-specified date
requires publication and notification of surrounding property owners.
The motion was seconded by Commissioner Brantner. On a roll-call vote,
the motion carried with Commissioner Kennedy voting nay.
This Certification was approved on the 9th day of October, 1989.

NOTICE
Pursuant to the zoning laws of the State of Colorado and the Weld County
Zoning Ordinance, a public hearing will be held in the Chambers of the Board
of County Commissioners of Weld County, Colorado, Weld County Centennial
_Center, 915 10th Street, First Floor, Greeley, Colorado, at the time
pecified. All persons in any manner interested in the Site Specific
Development Plan and Special Review Permit are requested to attend and may
-be heard.
Bhould the applicant or any interested party desire the presence o₹ a court
reporter to make a record of the proceedings, in addition to the taped
-record which will be kept during the hearing, the Clerk to the Board's
Office shall be advised in writing of such action at least five days prior
to the hearing. The cost of engaging a court reporter shall be borne by the
requesting party.
BE IT ALSO KNOWN that the text and maps so certified by the Weld County
Planning Commission may be examined in the office of the Clerk to the Board
of County Commissioners, located in the Weld County Centennial Center, 915

Re: Case No. USR-887 - Larry W. Smith
Dear Commissioners :
The undersigned represents Larry Smith in his application for a
Use By Special Review, accessory building exceeding 1 , 500 square
feet. Since the Planning Commission hearing, my client, Mr.
Smith, has spent a considerable amount of time addressing some of
the concerns of the neighbors who had objections to his proposal .
As a result of these discussions with his neighbors and with the
Planning and Zoning Department we believe that we can come up
with a proposal that is satisfactory to everyone or nearly
everyone concerned. In order to work these matters out with the
neighboring property owners we need some additional time,
therefore, we are requesting that our hearing scheduled for 10 : 00
a.m. on Wednesday, October 4 , 1989 be continued so that we can
accomplish the details of a proposal that we feel will be
satisfactory to Mr. Smith' s neighbors .
