HomeMy WebLinkAbout870035.tiff RESOLUTION RE: APPROVE USE BY SPECIAL REVIEW FOR A CHANGE IN NON-CONFORMING USE, CULTURED MARBLE FABRICATION BUSINESS - ROBERT SEE WHEREAS , the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 14th day of January, 1987, at the hour of 2: 00 p.m. in the Chambers of the Board for the purpose of hearing the application of Robert See, 3405 16th Street, Greeley, Colorado 80631 , for a Use by Special Review for a change in non-conforming use, cultured marble fabrication business, on the following described real estate, to-wit: Part of the Wh of Lot 2 , SW; SEa of Section 9 , Township 5 North , Range 65 West of the 6th P.M. , Weld County, Colorado WHEREAS , said applicant was represented by Fred Otis, Attorney, and WHEREAS, Section 24 . 4. 2 of the Weld County Zoning Ordinance provides standards for review of said Use by Special Review, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1 . The submitted materials are in compliance with the application requirements of Section 24. 7 of the Weld County Zoning Ordinance. 2 . It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24. 4 . 2 of the Weld County Zoning Ordinance as follows : a. The proposal is consistent with the intent of the R-1 (Low Density Residential) Zone and is provided for as a Use by Special Review. b. The proposed use is consistent with the Comprehensive Plan and will be compatible with future development of the surrounding area. The City of Greeley Planning Commission recommended no objections to the Use by Special Review with some concerns. These concerns have been addressed in the conditions for approval and in the Development Standards. d. The property is located in the A-P (Airport) Overlay District. Structures would not be allowed over 162 feet in height at this location. The structure included with the proposal does not exceed that height limit. e. Use by Special Review Development Standards will provide adequate protection of the health, safety and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application for a Use by Special Review for a change in non-conforming use, cultured marble fabrication business , on the hereinabove described parcel of land be , and hereby is , granted subject to the following conditions: 1 . The Use by Special Review activity shall not occur nor shall any building or electrical permits be issued on the property until the Use by Special Review plat has been delivered to the Department of Planning Services Office and the plat is ready to be recorded in the office of the Weld County Clerk and Recorder. 2. Prior to recording the Use by Special Review plat: a. The attached Development Standards for the Use by Special Review permit shall be placed on the Use by Special Review plat. b. The plat shall be amended to show a fifty-foot road right-of-way reservation from the center line of Balsam Avenue. c. The applicant shall file for a new well permit or late registration (depending on the situation) for the proposed drinking and sanitary uses as identified in the Division of Water Resources letter, dated December 17, 1986 , and signed by Hal D. The Use by Special Review permit is for a change in a non-conforming use, cultured marble fabrication , as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated herein. 2 . No outside storage shall be allowed except one trash dumpster. 3. The hours of operation shall be between the hours of 7 : 30 a.m. and 5 : 30 p.m. 4 . The amount of traffic created by this proposal shall not exceed 35 vehicle trips per day. 5. The appearance of the facility shall be maintained in a neat and orderly condition through periodic painting, maintenance and landscaping. The maintenance of the property shall not allow the growth of weeds. 6. Building and grounds shall be kept clean, in good repair, and free of trash. All wastes shall be removed on a weekly basis and disposed of in an approved land fill. 7. All areas which are not covered with vegetation shall be hard surfaced or graveled. 8. All construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 9 . The property owner or operator shall be responsible for complying with the Design Standards of Section 24. 5 of the Weld County Zoning Ordinance. 10 . The property owner or operator shall be responsible for complying with the Operation Standards of Section 24. 6 of the Weld County Zoning Ordinance. 11 . Personnel from the Weld County Health Department and Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to insure the activities carried out on the property comply with the Development Standards stated herein and all applicable Weld County Regulations. 870035 Page 2 DEVELOPMENT STANDARDS - ROBERT SEE 12 . The Use by Special Review area shall be limited to the plans shown herein and governed by the foregoing Standards and all applicable Weld County Regulations . Any material deviations from the plans or Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans or Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services . 13. The property owner or operator shall be responsible for complying with all of the foregoing Standards . Paulette Weaver asked that the minutes reflect that she was present. After reviewing the minutes they reflect that she zras absent at roll -call, but on Page 2, third paragraph from the bottom of the page, there 3s the following item: "NOTICE: 1:45 -p.m. Paulette Weaver is now present." The Minutes of the Comprehensive Plan Meeting held on November -25, 1986, were approved as distributed. Summary of the Weld County Planning Commission Meeting January 6, 1987 Page 2 APPEARANCE: _ Fred Otis, Attorney, representing the Robert Hinman Estate stated they have a contract with Robert See to purchase the property. Pete Murphy, Tiffany Marble Company, is leasing the property from Mr. See. Mr. See has spoken to the neighbors to see how they feel about this business going into this location. Pete Murphy, lessee, reported the only solid wastes they have are pieces of the marble product they manufacture, and they just put these in the trash dumpster to be picked up once a week. The barrels the resin come in are picked up by a company from Denver. They will hang approximately six employees. There will be about two trucks a week coming onto the property with deliveries and about two trucks a week taking out the finished product. The building is noisy inside, but there is no noise outside. Inside the building there is a fiberglass with a resin odor that does not smell outside the building. Robert See, applicant, stated the lot is gravel and is kept very neat, clean, and free of weeds. There is a small lawn and they plan to place picnic tables, etc. , on this. The Chairman asked if they had reviewed the recommendations, conditions, and development standards as outlined by the Department of Planning Services staff. Mr. Otis stated they have no problems with any of the recommendations, conditions, or standards. The Chairman called for discussion from the members of the audience. Walter Schenkman, surrounding property owner, reported they have no objections to this request as long as there are no odors or adverse affects to the neighborhood, and as long as the facility could not be enlarged or changed without going through procedures such as this. Karen Richardson, adjacent property owner, inquired about the hours and days of operation and whether one or more businesses could take place on the property without the neighbors being notified. They build an approved spray booth constructed as specified in the Fire Code. _This would be for the purpose of spraying the hazardous chemicals used in the operation. 2. Also, they would have to keep the amount of hazardous liquids kept in the building below the quantities specified in Table 9-A of the 1985 Uniform Building Code. 3. The north wall of the building may be closer than 20 feet to the property line, if so, the code requires a one (1) hour fire wall, but due to the fact that this occupancy group would be less restrictive than the previous occupancy, I would not consider this as having to be done. 4. They would have to meet all other requirements of the code for this type of occupancy. If they did not meet the above requirements, the occupancy would be classified as an H-2 and would have to be located a minimum of 30 feet from the property line. Explain the access route(s) to be utilized for the proposed use: There is an existing access from Balsam Avenue. 9. Explain the type, size, weight and frequency of vehicular traffic associated with the proposed use: Applicant estimates that there will be a one-ton delivery truck coming and going per day plus an estimated one or more customers per day and employee parking. 10. The type of sewage facilities for the proposed use: Existing septic system. 11. Description of the pissed fire protection measures associated with the proposed use: Western Hills Fire PiuLection District - Station approximately six blocks away from piuperty located at 1804 Cherry Avenue, Greeley, Colorado. 12. Waste, stockpile and storage areas associated with proposed use: There will be no outdoor waste, stockpile or storage areas with the exception of a small dumpster which will be emptied weekly. Weeds will be controlled and the existing landscaping will receive care to the extent necessary to put it back in order. 17. Reclamation procedures to be employed upon cessation of the Use by Special Review activity shall be: Not applicable. 18. Timetable for construction and start-up of the proposed use: The Applicant estimates it will take 30 days after approval by the Weld County Commissioners to complete its purchase from the Estate of Robert Hinman and to have Tiffany Marble Products operational on the site. 19. A statement explaining how the proposal is consistent with the Weld Cnnnty Comprehensive Plan: The building on the cauperty was constructed prior to the Weld County Comprehensive Plan and used as a truck terminal and office space between 1963 and 1979. After 1979, it was used by an irrigation systems supplier. The use suggested by the Applicant, although it is not consistent with the zone district, will be compatible in that there will be no off-site noise generated from the property, no hazardous waste generated and only a small amount of traffic. In the context of the area in which the property is situated, the use suggested by -Applicant is very compatible. 20. A statement explaining how the proposal is consistent with the intent of the district in which the use is located: The property is zoned R-1, but there is a mixture of uses in the immediate vicinity. The use suggested by Applicant will be extremely low profile. 21. If applicable, a statement explaining what efforts have been made, in the location decision for the pissed use, to conserve productive -agricultural ground in the agricultural zone district: Not applicable. 22. A statement explaining there is adequate provision for the protection of the health, safety and welfare of the inhabitants of the neighborlwl and the county: Me use suggested by applicant: i.e., for use as a site for manu- facturing cultured marble products provides adequate protection for the health, safety and welfare of the inhabitants of the neighborhood and the county. There will be no off-site noise that would be generated from the property, no health or safety risks and very little traffic to and fran the site. Page 4 23. A statement explaining the uses permitted will be cmpatible with the existing surrounding land uses: As explained above, the use suggested by Applicant is extremely cmapatible with the surrounding landowners in that the uses suggested by Applicant will have no impact on the surrounding landowners in terms of noise, pollution and traffic. 24. A statement explaining the proposed use will be compatible with the future development of the surrounding area as permitted by the existing zone and with future development as projected by the Comprehensive Plan of the county or adopted master plans of affected municipalities: The use suggested by Applicant is compatible with future development of the surrounding area as permitted by the existing zone and is compatible with future development as projected by the Canprehensive Plan of the county and the affected municipalities. The use suggested by Applicant will have little or no impact on surrounding landowners. There are other more intense uses than suggested by Applicant in the surrounding area. 25. A statement explaining the Use by pedal Review is not located in a flood plain, geologic hazard and Weld County Airport overlay district area; or that the application complies with Section 50 of Overlay District Regulations as outlined in the Weld County Zoning Ordinance. The property on which a change in nonconforming use is requested is not located in a flood plain, geologic hazard or Weld County Airport overlay district. 26. Proof that a water supply will be available which is adequate in terms of quality, quantity and dependability. The water supply is available and is adequate in terms of quantity, quality and dependability in that there is a well 81 feet deep drilled in 1962 producing 24 gallons per minute and registered as No. 012716. No water is necessary in the marble fabricating business. 27. A copy of the Deed or legal instrument identifying the Applicant's interest in the ptuperty under consideration.
