RE: APPROVE GRANTING EXTENSION OF TIME TO COMPLY WITH USE BY
SPECIAL REVIEW CONDITIONS - VESSELS OIL AND GAS COMPANY
WHEREAS , the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS , the Board did, by Resolution dated March 19 , 1986 ,
approve the request of Vessels Oil and Gas Company, for the
amendment of a Use by Special Review, and
WHEREAS, the Board has received a letter of request from
Vessels Oil and Gas Company asking for a 60-day extension of time
in which to comply with Condition #3 , a copy of said letter being
attached hereto and incorporated herein by reference, and
WHEREAS , said Condition #3 concerns evidence of approval of
the water source used in the expanded operation by the Division of
Water Resources, and
WHEREAS, after review, the Board deems it advisable to
approve said request for a 60-day extension of time.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the request of
Vessels Oil and Gas Company for an extension of time in which to
comply with Condition #3 of said Amended Use by Special Review be,
and hereby is , approved.
BE IT FURTHER RESOLVED by the Board that Vessels Oil and Gas
Company be , and hereby is, allowed 60 days , until September 1 ,
1986 , to comply with said Condition #3.

Permit Conditions #3
Request for Deadline Extension
Dear Ms . Dunn :
In accordance with our telephone conversation on Monday, June 30 ,
this letter is written as a formal request for an extension of the
deadlines imposed under Condition #3 of the subject Use by Special
Review permit .
Condition #3
Permit Condition #3 states :
"Within sixty days from the date of approval by the Board of
County Commissioners , evidence of approval by the Division of
Water Resources of the water source used in the expanded operation
shall be provided to the Department of Planning Services . "
The deadline for completion was previously extended by the Board
of County Commissioners by 60 days until July 2 , 1986 .
Vessels Oil & Gas has been working with the Division of Water
Resources to obtain a reinstatement of the existing water well
permit since early February, 1986 . At this time all documents and
fees required have been submitted to the State , and a site
inspection completed by the Division of Water Resources personnel .
Attached is a copy of the most recent correspondence and order of
the state engineer regarding the well permit . My efforts to
contact the Division of Water Resources have been unsuccessful ,
and their representatives have failed to return any telephone
calls . Therefore , the current status of this process if unknown .

We hereby request a 60-day extension to the deadline of Condition
#3 in order for this permit reinstatement process to be completed .
The new deadline for compliance would be established as September
1 , 1986.

-ZONING VIOLATION - DEUBACH (CONT. FROM 2/26/86) : Ms. de Besche
withdrew this item from the agenda, saying that this parcel has
been annexed into Garden City.
ZONING VIOLATION - MORRIS (CONT. FROM 3/5/86) : Ms. de Besche
said Charles Morris is in violation of Section 31.2 of the
Zoning Ordinance, dog kennel operation without the proper
permits. She said before Mr. Morris can obtain the proper
permits the well permit must be reclassified for commercial use
for the dog kennel, but the State Water Resources Division has
not yet approved the well, and does not expect to do so until
June or July. Commissioner Brantner moved to continue this
matter for 90 days. The motion, seconded by Commissioner Kirby,
arried unanimously.
REQUEST FOR EXTENSION OF TIME TO COMPLY WITH USR CONDITIONS -
VESSELS OIL & GAS: Ms. de Besche said Vessels Oil and Gas
Company is requesting a 45-day extension in order to come into
compliance with Conditions 3 and 4 of their Amended Use by
Special Review. Mike Boland, representing Vessels Oil & Gas
Company, came forward to explain the request to the Board.
Commissioner Lacy moved to grant a continuance to July 2.
Commissioner Brantner seconded the motion and it carried
unanimously.
RESOLUTIONS AND ORDINANCES: The Resolutions were presented and signed as listed
on the consent agenda. There were no Ordinances.
Let the minutes reflect that the above and foregoing actions
were attested to and respectfully submitted by the Acting Clerk
to the Board.
There being no further business, this meeting was adjourned at
11 :20 A.M.

-Ile above-referenced Use by Special Review permit was approved by the Board
of County Commissioners on March 19, 1986 . Mike Boland of Vessels Oil and
Gas Company is requesting the following:
1) A forty day extension beyond the May 18, 1986, deadline for
approval of the well permit by the Division of Water
Resources.
2) A forty-five day extension beyond the May 3, 1986, deadline
for submittal of a noise report which demonstrates Vessels'
compliance with Development Standard #6.
Attached is Vessels' written request, submitted to the Department of
Planning Services on April 23, 1986.

By law, a 30-day public comment period must now be initiated ,
after which Vessels ' permit is expected to be reinstated . It is
anticipated however that a final resolution by the Division will

We hereby request a 40-day extension to the deadline of Condition
#3 in order for this process to be completed . The new deadline
for compliance would be established as June 26 , 1986 .
Condition #4
Permit Condition #4 states :
"Within forty five days from the date of approval by the Board of
County Commissioners , a noise report prepared by a qualified
engineer shall be submitted to the Department of Planning Services
giving evidence of Vessels ' compliance with noise standards as set
forth in CRS 25- 12- 103 et seq . and stated in Development Standard
#6 . "
The deadline for submitting this report is May 3 , 1986 .
As Vessels ' personnel testified at the Weld County Commission
hearing of February 26 , 1986 , the noise report cannot be properly
prepared until the erection of the two new gas compressor
buildings is completed . Building construction is currently
underway, however , recent setbacks in the construction process
will not allow for completion of the noise survey by the date
required . Vessels ' delays are due primarily to material delivery
schedules and the recent major snowstorm and winds we have
experienced which restrict metal building erection .
We hereby request a 45-day extension of the deadline for Condition
#4 to allow this work to be completed and an accurate noise study
performed . The new deadline for compliance would be established
as June 17 , 1986 .
Vessels Oil & Gas Company is committed to conducting its business
operations in full compliance with all Federal , State and Local
laws , rules and regulations , and is working diligently to meet the
conditions and standards of the Use by Special Review permit in
Weld County . Your consideration of these deadline extension
requests to allow us to properly comply with the permit
requirements will be greatly appreciated .
