RE: AUTHORIZE COUNTY ATTORNEY TO PROCEED WITH LEGAL ACTION TO
RECOVER COST OF DEMOLITION WORK - OTABIO ESPINOZA
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, pursuant to action of the Board, Western
Construction, Inc. , performed demolition work on Lot 51 , Espanola
Subdivision, Weld County, Colorado, and
WHEREAS, said demolition work was done to abate dangerous
conditions on the hereinabove described property which the
Assessor' s records show as being owned by Otabio Espinoza, and
WHEREAS, said property was duly posted and a notice was duly
published in the County legal newspaper, ten days prior to the
meeting, with a certified letter being sent to Otabio Espinoza and
accepted by Edna Aragon, that the Board was to consider the matter
of recovering the cost of the demolition work at its regular Board
meeting of September 28 , 1988 , and
WHEREAS, Edna Aragon, 2557 Stout Street, Denver, Colorado,
daughter of Otabio Espinoza, submitted a letter informing the
Board that Otabio Espinoza is deceased, and
WHEREAS, neither Ms. Aragon nor any other representative of
Otabio Espinoza was present at the Board meeting of September 28 ,
1988 , and
WHEREAS, the Board, at said meeting, determined that this
matter be referred to the County Attorney to proceed with
appropriate legal action to recover the cost of the demolition on
the hereinabove described property in the amount of $2 , 000 . 00 .
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the Weld County
Attorney' s Office be, and hereby is, authorized to seek judgment
to recover the cost of the above mentioned demolition work on Lot
51 , Espanola Subdivision, Weld County, Colorado, in the amount of
$2 ,000 . 00 .

Dear Ms. Feuerstein:
I have received your notice regarding the meeting concerning the demolition
of the property of Otabio Espinoza described as Lot 51, Espanola Subdivision
located at 1411 N. 25th Ave. , Weld County, CO.
My father, Otabio Espinoza is deceased and the property has remained in his
name as far as I know, since he did not leave a will.
I have no interest in this property at this time and do not intend to pay
for the expense of demolition.

NOTICE IS HEREBY GIVEN that, pursuant to a Resolution dated July 27, 1988,
the Board of County Commissioners of Weld County, Colorado, during its
regular Board meeting at 9:00 A.M. on Wednesday, September 28, 1988, will
consider recovering the cost of certain demolition work done to abate
dangerous conditions, pursuant to the Weld County Building Code and Uniform
Code for the Abatement of Dangerous Buildings. Said meeting will be
conducted in the Chambers of the Board, Weld County Centennial Center, 915
10th Street, First Floor, Greeley, Colorado. The demolition work will be
done by Western Construction, Inc. , of Evans, Colorado, at the direction of
the Board. The property involved is owned by Otabio Espinoza and is
described as Lot 51, Espanola Subdivision, located at 1411 N. 25th Avenue,
Weld County; Colorado. The Board will hear any protests and consider
whether or not the cost should be assessed personally against the owner or
by special assessment and lien against the property.
All persons in any manner interested are requested to attend the meeting and
may be heard.
It has been determined that the total cost of said demolition work is
$2,000.00, with a copy of the summary of the cost being available in the
office of the Clerk to the Board, Third Floor, Centennial Center, 915 10th
Street, Greeley, Colorado, between the hours of 8:00 A.M. and 5:00 P.M. ,
Monday through Friday.

It was the decision of the Weld County Board of County Commissioners to accept
the low bid for Demolition and Removal of Structure , Lot 51 , Espanola Subdivi-
sion located at 1411 North 25th Avenue from Western Construction , Inc. in the
amount of $2,000.00, as this price included the haul in of clean material .
