RE: APPROVAL OF RECORDED EXEMPTION NO. 750 - FLOYD C. AND MILDRED
D. HALE
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners, pursuant to its
authority under Section 30-28-101 (10) (d) , CRS, as amended, did
determine at a public meeting held in the Chambers of the Board,
that a certain parcel of land, to be divided into two parcels, as
shown on the plat known as Recorded Exemption No. 750 , does not
come within the purview of the definition of the terms,
"subdivision" and "subdivided land" , and
WHEREAS, the request for Recorded Exemption No. 750 was
submitted by Floyd C. and Mildred D. Hale for property which is
located in the NE1, Section 6 , Township 4 North, Range 68 West of
the 6th P.M. , Weld County, Colorado, being more particularly
described in the plat which shall be provided by the applicant and
known as Exhibit "A" , said plat to be recorded, and
WHEREAS, this request is to divide the property into parcels
estimated to be approximately 5 acres and 75 acres.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the hereinabove
described parcel of land be, and hereby is, exempt from the
definition of the terms, "subdivision" and "subdivided land" .
BE IT FURTHER RESOLVED by the Board that this approval is
conditional upon the applicant submitting a Use by Special Review
application to the Department of Planning Services within thirty
days from the date of approval by the Board of County
Commissioners.

Dear Commissioners:
This request for a recorded exemption is submitted by Floyd C. & Mildred D.
Hale . The parcel of land on which this request is being made is described
as NE1 of Section 6, T4N, R68W of the 6th P.M. , Weld County, Colorado. The
property is located more than 6 miles west of Johnstown on Colorado Highway
60. The parcel of land under consideration is the total contiguous land
holdings of the applicant.
The request is to divide the property into parcels of 4.66 acres and 75.34
acres, more or less. Mr. & Mrs. Hale propose to sell the larger lot for
agricultural production. The smaller lot will be maintained in it present
use, as a pork production operation.
Based upon the submitted information and policies of the County, the
Department of Planning Services staff recommends the request be approved for
the following reasons:
1. The applicant has demonstrated in the submitted application
materials that the request complies the submission
requirements of Section 9-2 C. of the Weld County Subdivision
Regulations.
2. The applicant has demonstrated in the submitted application
materials that the standards and conditions of Section 9-2 E.
(1) (a) through (m) of the Weld County Subdivision
Regulations have been met.

explained that a Use by Special Review Permit for Lot A will be needed. The

THE FOLLOWING INFORMATION IS PRESENTED IN RESPONSE TO

( 4 ) THE PURPOSE FOR THIS LOT SPLIT IS TO PROVIDE FOR
TWO ( 2 ) SEPARATE PARCELS OF LAND, THE SMALLER PAR-

To whom it may concern:
Recently Mrs. Hale and I visited your office and Mr. Mayerl about
the possibility of the sale of our 80 acre farm in the West Half
of the Northeast Quarter of Section Six, Township 4 North, Range
Sixty-Eight West of the Sixth Principal Meridian.
We at that time indicated the possibility of selling the approx-
imately 4 acres on the north west corner of this property where
all the buildings are located to a party interested in continuing
the present use of that area as a pork producing unit. Mr. and Mrs.
Larry Zimmerman of Longmont would like to buy that portion of the
farm for the above stated purpose but cannot afford the whole farm.
Mr. Mayerl indicated that this should be no problem other than
going through the proper procedures.
We, Mrs. Hale and I, would therefore ask that the bearer of this
letter from the firm of Kruback Engineering Associates be allowed
to proceed with the steps necessary to accomplish this purpose.
