HomeMy WebLinkAbout880434.tiff RESOLUTION RE: APPROVE RECOMMENDATION TO COLORADO DEPARTMENT OF HIGHWAYS CONCERNING HAZARDOUS MATERIALS ROUTING AND AUTHORIZE CHAIRMAN TO SIGN WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with a petition to be presented to the Colorado Department of Highways concerning the routing of hazardous materials within Weld County, and WHEREAS , after review, the Board deems it advisable to recommend approval of said petition, a copy of which is attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Board submit a favorable recommendation to the Colorado Department of Highways concerning the routing of hazardous materials within Weld County. BE IT FURTHER RESOLVED by the Board that the Chairman be, and hereby is, authorized to sign said recommendation. Dangerous intersection where Hwy 257 crosses both Hwy 34 and Hwy 34 bypass . Railroad crossing in downtown Johnstown and downtown Milliken. - On seperate paper list any additional consideration which would be significant in route determination. A critical part of SB 156 was the designation of routes . SB 156 gave the Colorado State Patrol , after consultation with local governmental authorities , the sole authority to designate which public roads shall be used and which shall not be used by motor vehicles transporting hazardous materials . However , SB 156 also allowed that on or before July 1, 1988 , a petition for route designation may be submitted to the patrol . This petition could be submitted by any one of the following: a . By a county, with respect to any public road maintained by the county, upon approval of the petition by the board of county commissioners of such county; b. By a town, city, or city and county, with respect to any public road located within such town, city, or city and county, upon approval of the petition by the governing body of such town, city, or city and county; c . By the state department of highways , with respect to any public road maintained by the state, except for any public road located within a town, city, or city and county, upon approval of the petition by the state highway commission. Section 43-6-302 (9 ) CRS also states that "Any town, city, city and county, or county may request the state department of highways to submit a petition to the patrol for a route designation on any highway maintained by the state within the jurisdiction of the said local entity. " The rules and regulations concerning hazardous materials route designation were adopted by the State Patrol on February 3 , 1988 of which a copy is attached for your information. 880434 `J % '7 All Municipalities and Counties SB 156 Route Designation March 24 , 1988 Page 2 - If any municipality or county is interested in the Colorado Department of Highways petitioning the State Patrol on their behalf they simply must only complete the enclosed packet entitled "Request to the Department of Highways to Petition on the Behalf of a Municipality or County, " March 24 , 1988 . This will relieve the municipality or county of any additional requirements as outlined in the Colorado State Patrol ' s "Hazardous Material Route Designation--Petitioning Packet" dated January 7 , 1988 . All other requirements including the data collection, data analysis , alternative analysis and map preparation will be completed by the Department of Highways. It is important to stress three critical issues at this time. 1. THIS REQUEST IS ONLY VALID FOR STATE HIGHWAYS WITHIN THE REQUESTING MUNICIPALITY. IF LOCAL ROADWAYS ARE TO BE CONSIDERED FOR ROUTED DESIGNATION, THE JANUARY 7, 1988 PETITIONING PACKET MUST BE COMPLETED BY THE MUNICIPALITY OR COUNTY AND SUBMITTED DIRECTLY TO THE COLORADO STATE PATROL. 2 .
