RE: APPROVAL OF AMENDMENT OF USE BY SPECIAL REVIEW FOR A BIRD
HUNTING OPERATION TO INCLUDE AN OIL AND GAS SUPPORT OPERATION
- DEARAL W. AND MARY LOU BEDDO
WHEREAS , the Board of County Commissioners of Weld County,
Colorado , pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
-affairs of Weld County, Colorado , and
WHEREAS , the Board of County Commissioners held a public
hearing on the 19th day of February , 1986 , at the hour of 2 : 00
p.m. in the Chambers of the Board for the purpose of hearing the
application of Dearal W. and Mary Lou Beddo , 11154 State Highway
66 , Platteville, Colorado 80651 , to amend a Use by Special Review
permit for a bird hunting operation to include an oil and gas
support operation on the following described real estate , to-wit :
Part of the Sk , Section 24 , and part of the
NZ, Section 25 , Township 3 North, Range 67
West of the 6th P.M. , Weld County , Colorado
WHEREAS , Section 24 .4 .2 of the Weld County Zoning Ordinance
provides standards for review of said Use by Special Review, and
WHEREAS , the Board of County Commissioners heard all of the
testimony and statements of those present , has studied the request
of the applicant and the recommendations of the Weld County
Planning Commission and all of the exhibits and evidence presented
in this matter and, having been fully informed, -finds that this
request shall be approved for the following reasons :
1 . The submitted materials are in compliance with the
application requirements of Section 24 . 7 of the Weld
County Zoning Ordinance.
2 . It is the opinion of the Board of County Commissioners
that the applicant has shown compliance with Section
24 .4 . 2 of the Weld County Zoning Ordinance as follows :
a. The proposal is consistent with the Comprehensive
Plan policies in that the use does not infringe on
continued agricultural use in the vicinity or
County. The proposal does not appear to have any
adverse impacts on the agricultural interests .
b . The proposal is consistent with the intent of the
Agricultural Zone District and is provided for as a
Use by Special Review.

c . The subject property does not lie within the
Geologic Hazard Overlay District or A=P (Airport)
Overlay District.
d. Use by Special Review Development Standards -will
provide adequate protection of the health, safety
and welfare of the neighborhood and County.
NOW, THEREFORE , BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado , that the application to
amend a Use by Special Review for a bird hunting operation to
include an nil and gas support operation on the hereinabove
described parcel of land be , and hereby is , granted subject to the
following conditions :
1 . The attached Development Standards for the Use by
Special Review permit be adopted and placed on the Use
by Special Review plat prior to recording the plat.
2 . The Use by Special Review activity shall not occur nor
shall any additional building or electrical permits be
issued on the property until the Use by Special =Review
plat has been delivered to the Department o₹ Planning
Services Office and the plat is ready to be recorded in
the office of the Weld County Clerk and Recorder.

Amended USR-626 :85 : 63
1 . The Amended Use by Special Review permit is far a bird
hunting operation and parking of custom -harvesting equipment
and oil and gas equipment consisting of three recording
trucks and eleven vibrator trucks as submitted in the
application materials on file in the Department of Planning
Services and subject to the Development Standards stated
hereon.
2 . The bird hunting operation shall be operated in accordance
with the Colorado Fish and Game Department regulations . The
applicant shall obtain a -valid Colorado Commercial Hunting
Park License prior to starting the bird hunting operation.
3 . All construction none on the property shall be in accordance
with the requirements of the Weld County Building Code
Ordinance.
4 . The property owner or operator shall be responsible for
complying with the Design Standards of Section 24 .5 of the
Weld County Zoning Ordinance.
5 . The property owner or operator shall be responsible for
complying with the Operation Standards of Section 2-4 . 6 of the
Weld County Zoning Ordinance.
6 . Personnel from the Weld County Health Department and Weld
County Department of Planning Services shall be granted
access onto the property at any reasonable time in order to
insure the activities carried out on the property comply with
the Development Standards stated herein and all applicable
Weld County Regulations .
7 . The Use by Special Review area shall be limited to the plans
shown herein and governed by the foregoing Standards and all
applicable Weld County -Regulations . Any material deviations
from the plans or Standards as shown or stated shall require
the approval of an amendment of the Permit by the Weld County
Planning Commission and the Board of County Commissioners
before such changes from the plans or Standards are
permitted. Any other changes shall be filed in the office of
the Department of Planning Services .

8 . The property owner or operator shall be responsible for
complying with all of the foregoing Standards . Noncompliance
with any of the foregoing Standards may be reason for
revocation of the Permit by the Board of County
Commissioners .

A public hearing was conducted on February 19, 1986, at 2:00 P.M. , with
the following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated January 29, 1986, and
duly published February 6, 1986, in the Johnstown Breeze, a public
hearing was conducted to consider an amendment, to include an oil and
gas support operation, to Use by Special Review #626, which was for a
bird hunting operation, and was issued to Dearal W. and Mary Lou Beddo.
Lee Morrison, Assistant County Attorney, made this matter of record.
Debbie de Besche, representing the Planning Department, read the
favorable recommendation of the Planning Commission into the record.
She said there are two Conditions and eight Development Standards
associated with this request. Ms. de Besche said the Platte Valley
Soil Conservation District submitted a letter opposing this request.
Dearal Beddo, one of the applicants, came forward to answer questions
of the Board. Clyde Abbett, representing the Platte Valley Soil
Conservation District, came forward to explain why the District is
opposed. Mr. Beddo made his closing remarks and answered further
questions of the Board. Commissioner Lacy moved to approve the Amended
Use by Special Review for Dearal and Mary Lou Beddo, subject to the
recommended Conditions and Development Standards. Commissioner
Brantner seconded the motion which carried unanimously.
This Certification was approved on the 24th day of February, 1986.

The chairman asked the secretary to poll the members of the Planning
Commission for their decision. Lynn Brown - Yes. She is extremely
sympathetic with the neighbors concerns, but she feels the Use by Special
Review permit will give us greater control and will give the Planning staff
and the health department the means (in the future) to go and look at the
operation since standards have now been defined that must be abided by.
Doug Graff - Yes. Obviously there is a lot of emotion from a number of the
residents who reside in this area, and he sees a number of residents who
would probably like to see the whole development changed to some type of
residential development while, in fact, the subdivision is agriculturally
zoned. Hopefully, they will be able to get together and some how monitor
their own area. He would also make a recommendation to the Planning staff
and the Planning Commission that sometime the Planning Commission, as a
body, tour the area. He would like to become more familiar with it and see
for himself what is going on out there. Don Johnson - Abstain, because he
missed about fifty percent of the testimony. Ann Garrison - yes, and she
does realize the potential losses of the residents to property, etc. , but
the County cannot change what is going on there. Also, she like Lynn Brown,
-l) feels this at least gives us a start in controlling future problems. She
also hopes the residents will get together and through cooperation come up
with a plan to help themselves. Preventing future problems is more effective
than correcting problems after they are already in existence. Paulette
Weaver - While she thinks what Mr. Curtis is proposing is an improvement in
the area, she is voting no. She does not like the kinds of outbursts from
the people of the area, but she is voting no because the addition of the
feed mill and the manure storage will be a benefit to the area, but at this
point the addition of six thousand pullets is not in the best interests of
the neighborhood. Jack Holman - Yes, and without repeating everything that
has been said, he agrees with what has already been said by those who voted
for approval. Motion carried with four voting for the motion; one voting
against the motion, and one abstaining.

APPEARANCE:
Tearal Beddo, property owner And Applicant, reported he lives -on the
property on which they are applying for a Use by Special Review. -He has a
permit to plant birds on the property and hunt them. A zoning inspector
looked at his property to see if he was in compliance with the bird hunting
permit and told him he needed to amend his Use by Special -Review permit to
park his geophysical equipment on the property. He is a partner in G.P.S
Corporation -and has been trying to sell some of the equipment for over a
year. He intends to park the trucks only in the area -designated on the plat
for this purpose. If the geophysical equipment cannot be sold he may
convert some of it to farm machinery.
Gloria Dunn stated Mr. Beddo's storage of farm machinery is not a violation.

request is for one well with one storage tank. Their safety record in Weld
County has been good, but there can be problems with inexperienced personnel
working at the tank battery sites. He attended the City of Evans and the
City of Greeley Planning Commission meetings. The Evans Planning Commission
voted in favor of this request unanimously. The City of Greeley Planning
Commission vote was five in favor of the request and two against the
request.

Elk Exploration has obtained -most of Universal Gas -and Oil's mineral leases
and they will comply with the City of Greeley's recommendations. The
compressor station, etc. , will he in the same general area as the tank

COMMENTS:
Access is from a private access road to State Highway 66. The immediate

trucks and other miscellaneous equipment. The other parking area was not
viewed, due to snow and barking dogs.
There are 3 residence within 1/4 mile of the subject site.

The purpose of this proposal is to obtain approval by special -
use permit to park (1) equipment related to farming and custom
harvesting of farm produce, (2) equipment related to oil and gas
exploration and production.
(1) This farm equipment has been parked on the Beddo Farm
for the past eight years without complaint from adjacent land-
owners. This equipment is used on this farm as well as used for
custom work on other farms. This equipment consists of haying
equipment and trucks for farm harvests. All of this equipment is
owned by Dearal W. Beddo and is felt to be necessary to keep this
equipment on this place since it is used on this place.
Most farmers in this area have equipment which is used
on their farm as well as doing custom work for other farmers.
(2) The oil exploration equipment which is owned by G.P.S.
Corp. , a Colorado corporation owned by Dearal and Mary Lou Beddo,
has been parked on this farm for the past eight years with no
complaints from adjacent landowners. When this equipment is not
in use it has been parked on this farm. Following is a list and
description of the equipment.
(a) Three recording trucks used to record geophysical
data onto magnetic tapes. These trucks are Ford
F600 4X4 .
(b) Eleven vibrator trucks used as a source of energy
for geophysical operation. These trucks are Ford 8000
or International 5050 which are 48000 lbs . GVW.
All of this equipment is currently for sale. The trucks
that are not sold will be remounted for farm trucks to be used
in custom farm work or leased for farm use.
At the present there is oil related equipment parked
in all directions from Platteville.
There are no permanent employees related to this equipment.
The only maintenance done on this equipment consists of
lubricating the equipment.
This special use permit will in no way effect the Agriculture
productivity of this farm. There is no land being removed from
Agriculture for the parking area. The parking area consists of
3" to 4" of sand and gravel , 2 1/2 ' black clay, 50 ' sand and
gravel, before going into black shale.
The Beddo Farm is located in the 100 year flood plane but
since the permit consistsof no new buildings it is not pertinent to
this permit.
The adjacent land to the Beddo Farm consists of cattle raising,
parking of custom harvest equipment, boarding of horses , and farming.
The water and sewage need is not related to this permit since
there are no employees .
The fire protection is provided by Platteville Fire Protection
District.
There are no stock piles of waste related to this equipment.
