RESOLUTION RE: APPROVAL OF REPLAT OF ARROWHEAD SUBDIVISION - STEVE LUNDVALL WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on the 11th day of December, 1985 , in a public meeting, the Board considered the request of Steve Lundvall for the resubdivision of Lots 1 and 2 , Arrowhead Subdivison, Fourth Filing, and WHEREAS, the Board reviewed the submitted evidence and heard the testimony of those present, and WHEREAS, the Board, having considered the recommendation of the Weld County Planning Commission, finds that the resubdivision request concerning Lots 1 and 2 , Arrowhead Subdivision, Fourth Filing, shall be approved for the following reasons: 1 . The resubdivision conforms with the application requirements of Section 6-4 D. of the Weld County Subdivision Regulations. 2 . The resubdivision conforms with the application requirements of Section 6-4 E. of the Weld County Subdivision Regulations. 3 . The following referral entities have reviewed this request and set forth no objections: a. The Weld County Utilities Coordinating Advisory Committee b. The Greeley Planning Commission c. The Evans Planning Commission d. The Weld County Engineering Department, subject to conditions as listed below. e. The Weld County Health Department f. NOTE: No building permits shall be issued for the subject lots until Kiowa Drive meets completion standards, as set forth in the Subdivision Improvements Agreement, dated November 26 , 1985 , and approved by the Board of County Commissioners. Mr. Lundvall appeared at the meeting to explain the request and answer questions from the Commission Members. Following review of the information and discussion with Mr. Lundvall , the Planning Commission passed a motion to recommend to Weld County approval of the variance requested by Mr. Steve Lundvall for the following reasons : 1 . The Arrowhead Subdivision is located in the planned growth area of the City of Evans and the proposed use of the subject property is compatible with our Preliminary Comprehensive Plan. 2. The proposed use is also compatiable with the existing land uses in the area . The Planning Commission is concerned about direct access from the proposed lots onto County Road 45 (37th Street) and therefore further recommends that such access be prohibited and so indicated on the recorded plat. COLO. 80632 REGISTERED LAND SURVEYOR PHONE: 352-0100 August 30, 1985 Weld County Planning Department Centennial Complex 925 Tenth Street Greeley, CO 80631 Subject: Request for Replatting Lot 1, Block 10, Arrowhead Fourth Filing Ladies and Gentlemen: The following information and statements are presented in support of the request for replatting: Arrowhead Fourth Filing was filed in August 1971 with lot sizes that varied from .92 acres to 1.77 ac. with two (2) exceptions: Lot 1, Block 10 contain- ing 6.09 acres and Tract "A" containing 10.68 acres. The purpose of this request is to replat Lot 1, Block 10 (5.70 ac) into four (4) lots. A small portion (.39 ac.) has been sold off to Western Slope Gas Company. Lot 1, Block 10, as currently platted, is not consistent with the remainder of the subdivision and is and has been an unsaleable and unusable lot. Replatting would allow usage consistent with the surrounding lots in Arrowhead Fourth Filing. On August 8, 1985, the Weld County Board of Adjustment, by a 6 to 1 vote, granted a lot size variance for Lot 1, Block 10, Arrowhead Fourth Filing enabling the applicant to proceed with replatting. In the time since Arrowhead Fourth Filing was platted many changes have taken place. Economic conditions have changed and Weld County and the State of Colorado have passed numerous changes in Land Use Regulations and applications that have changed the manner in which land may be used and developed. This statement is certainly true for Lot 1, Block 10. The appli- cants have not been responsible for any of the changes noted above and now find themselves with a parcel of ground that is economically undevelopable as currently platted. Weld County Planning Department August 30, 1985 Page 2 If the replat is granted, the applicants will have reasonable use of the parcel. The parcel will be divided into four (4) smaller parcels varying in size from 1.13 acres to 1.73 acres. The new parcels will be fully consistent with other parcels within the subdivision. The request for four (4) lots is the minimum practical variance. A three (3) lot variance would make lots larger than surrounding lots and a five (5) lot variance would begin to make lots smaller than surrounding lots. Lot 10, Block 1 can be served with the domestic water system that currently serves the Arrowhead Subdivision. It is proposed to provide the sanitary sewer requirements by use of individual septic systems similar to those in use throughout the existing subdivisions. I discussed the use of individual septic systems with Mr. Wes Potter of the Weld County Health Department on July 5, 1985 and he felt he could support the use of individual septic systems in this area providing they meet county standards. Dear Mike : An issue has arisen that is of considerable concern to the developer of Lake Arrowhead and it centers around the maintenance, repair and replacement of the irrigation system, including the pump. The developer has been obliged to concentrate on this problem in view of the recent letter from the Board of County Commissioners concerning escaping water from a leaking irrigation line damaging a road which the county is obliged to maintain. In the past the developer has replaced an irrigation pump for which no compensation has ever been received from the various users of irrigation water. Additionally, some minor repairs have been made from time to time by the developer without any reimbursement from irrigation water users. Unfortunately, the state of the art in irrigation pipe at the time it was originally installed by Arrowhead was not as advanced as it presently is and it is becoming apparent that sooner or later re- placement will be necessary. To the best of my knowledge with the possible exception of the most recent difficulty, water users had not been obliged to pay for any repairs or replacement, nor have they been charged anything by the developer either for the water, or the maintenance of the lines. It appears to the developer that the situation calls for a change in procedures and it is suggested that your group appoint a committee to meet with the developer for the purpose of working out a program that will resolve the current and potential future difficulties . I should indicate that what the developer has in mind is that each irrigation user be obliged either to pay an annual maintenance fee or a fee for the use of the water in order that a fund can be devel- oped 'hich can be utilized from time to time to accommodate necessary re! s. 2/7 � - -- Michael A. Vara] June 10, 1985 Page Two There are owners in Arrowhead who have lived there from the very beginning of the development and others who have lived there for a substantial period of time, who have utilized irrigation water and the only expense they have incurred has been electricity and some minor maintenance. The developer is pleased that irrigation water has been provided up to this time with a minimum of expense and inconvenience to the users, but we have now reached a point where this can no longer continue. I don' t perceive that contemplated maintenance or water use cost will be prohibitive or excessive, but some charges are going to have to be imposed . I would suggest that your group indicate at its earliest opportunity the membership of your committee and when you would like to meet. I think this should be done promptly in order to avoid further diffi- culties. I am informed that the present problem has been temporarily resolved except for the cost of repairing the road and in order that the Weld County Commissioners be advised that we are taking some action in response to their letter of demand of June 3 , 1985 , I am sending a copy of this letter to their attention.
