RE: GRANT CERTIFICATE OF DESIGNATION FOR A SOLID WASTE DISPOSAL
SITE FOR TIRES AND SCRAP TIRE RECYCLING FACILITY - TIRE
MOUNTAIN, INCORPORATED
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, a public hearing was held on the 25th day of
January, 1989 , at 10 :00 a.m. for the purpose of hearing the
application of Tire Mountain, Incorporated, for a Certificate of
Designation to operate a solid waste disposal site for tires and
scrap tire recycling facility on the following described real
estate, to-wit:
Part of the SE} of Section 32 , Township 3
North, Range 65 West of the 6th P.M. , Weld
County, Colorado
WHEREAS, said applicant was represented by Kenneth F. Lind,
Attorney, and
WHEREAS, Section 32-20-101 , C.R.S . , and regulations issued
pursuant thereto at 6 C.C.R. 1007-2 provide standards for review
of such application, and
WHEREAS, the Board of County Commissioners heard all the
testimony and statements of those present, has studied the request
of the applicant and the recommendations of the State and Weld
County Health Departments and the Weld County Planning Commission,
and having been fully informed, finds that this request shall be
approved for the following reasons:
1 . The Conditions for approval and stated Standards will
minimize the impacts on the surrounding property and the
area to the greatest extent possible. The Conditions
for approval and stated Standards will also provide
adequate protection of the health, safety, and welfare
of the inhabitants of the area and the County.
2 . The location of the proposed solid waste disposal site
will be convenient and accessible to the potential
users.
3 . The applicant has demonstrated in the application
materials that there is a need for the proposed solid
waste disposal site for tires.

4 . The applicant has demonstrated through the application
materials that he has the ability to comply with the
health standards and operating procedures of the Solid
Waste Disposal Site and Facilities Act, Title 30-20,
Part 1 , CRS.
5 . The Colorado Department of Health and the Weld County
Health Department have reviewed this request and find,
subject to conditions, that the proposal will comply
with the Standards of the Solid Waste Disposal Sites and
Facilities Act, Title 30-20-101 et seq. , CRS.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the application of
Tire Mountain, Incorporated, for a Certificate of Designation on
the above referenced parcel of land be, and hereby is, granted
subject to the following condition:
1 . The property shall be maintained in compliance with the
submitted application materials on file with the
Department of Planning Services, approved Special Review
Permit #842 , and all requirements of the Weld County
Health Department and the Colorado Department of Health.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 25th day of
January, A.D. , 1989 .

Site Information
Located in part of the Southeast Quarter (SE1/4 ) of Section
32, Township 3 North, Range 65 West of the Sixth Principal Meri-
dian, Weld County, Colorado.

The proposed use for the site, pursuant to Section 9, addend
to regulation 6CCR1007-2 and known as the "Solid Wastes Disposal
Sites and Facilities Regulations" , is to receive, store, dispose
and recycle used and discarded tires. The facility presently holds
more than 5, 000,000 scrap tires in inventory. The scrap tires
need to be stored separately and accessible to the surface; yet
contained within earth cells and covered with a 6 mil plastic
sheeting. The plastic sheeting will be weighted and held in
place by tires.
Tire Mountain, Inc. , has operated its surface storage and
tire disposal business at the current site since August 18, 1976,
under Weld County Zoning I-3, and a Special Use Permit. Tires
are stored on the ground surface. Scrap tire regulations have
recently been changed and updated, and have been added to the
existing "Solid Wastes Disposal Sites and Facilities Regulations" .
The operator intends to comply with the stated minimum stan-
dards of the Colorado Health Department in the development of the
Scrap Tire Disposal and Recycling Facility.
Site Standards
The site, see "Permit Plan Map" , is to be constructed with
cells located in a north-south configuration to take advantage of
the existing topography. Cells will only be opened as needed.
Each cell will contain about 500,000 tires. The remaining areas
will be maintained with their present vegetative cover. Wind
erosion will be minimized by seeding exposed berms with dryland
grass mixtures.
There are no surface water facilities such as streams, lakes,
irrigation ditches adjacent to or on the site. The facility is
not located in a flood plain nor is it a major contributary to a
flood plain.

Aquifer recharge areas are not a major concern as the tires
will be disposed of and stored in a dry condition, which is not
anticipated to adversely impact existing aquifers. Surface drain-
age will be directed off of and away from the disposal areas.
An existing well is present on site at a depth of 410 feet.
As previously stated, tires stored in a dry condition should not
adversely effect subsurface water.
Tire Mountain, Inc. , has located their facility in a remote
agricultural setting. It is located 8-1/2 miles north of Hudson,
which is the nearest town. Geologic conditions are favorable with
the one exception of sloughing soil on steep cut slopes. This ex-
• ception will be alleviated by using shallower slopes. See accom-
panying Geotechnical Report prepared by Empire Laboratories, Inc.
The Geotechnical Report recommends the bottom of the storage
cells be maintained at least two feet above the highest anticipated
ground water level. Tire Mountain, Inc. , plans to comply.
Engineering Design Standards
Such items as discussed under Article 4.2 of the "Regulations
Pertaining to Solid Waste Disposal Sites and Facilities" are not
applicable to tire storage. The items are requested to be waived
by the Owner pursuant to Article 1.3.8 of the previously identified
regulation.

Acreage
The site area is a total of 80 acres broken into two
parcels of 40 acres each. A 40 acre parcel, owned by a
different party, divides the two parcels. See accompany-
ing "Permit Plan Map" .

Facility Services
As previously discussed, the site is to be used exclusively
for the disposal and storage of scrap tires. The tires are to be
placed in trenches or cells, 15 feet total depth, 75 feet wide,
and 550 feet in length. The trenches will be excavated and
filled with tires as they are needed. No trench will remain open
for any long period of time without receiving tires. As previous-
ly discussed, one trench can hold about 500,000 tires. Two
trenches will handle the yearly production of Denver and surround-
ing cities. The entire State of Colorado produces approximately
2 million scrap tires per year. As each new lift of disposed
tires is completed to planned surface grade, the tires will be
covered with a 6 mil plastic, which is weighted down with tires.
The intent of the plastic is to protect the tires from
• contamination of dirt and debris which would make them less
acceptible for recycling.
The service area of Tire Mountain includes Denver and north-
eastern Colorado. Ninety percent of the traffic generated to this
site originates in Denver. Traffic from Denver can travel either
Interstate 76 to Hudson, then across State Highway 52 to Weld
County Road 41, then north on Weld County Road 41 to the site; or
U.S. Highway 85 north to Fort Lupton, then east on State Highway
52 to Weld County Road 41, then north to the site.
Soils Characteristics and Geologic Data
See attached report from Empire Laboratories, Inc. , discuss-
ing subsurface soils at the site.
Hydrological Data
There are no lakes, rivers, streams, ditches, springs, or
bogs on site, or within a two mile radius, except a small irriga-
tion pond one mile east on Weld County Road 43, and the Beebe
Seep Canal located one and one half miles east of the site.
Depth of the uppermost stratigraphic unit is 0 to 125 feet,
and is classified as the Valley-fill deposits, which is part of
the Recent and Pleistocene series of the Quaternary system. Its
characteristics are interbedded clay, silt, sand and gravel
containing some cobbles, boulders, and some volcanic ash. They
underlie the flood plains and terraces on the South Platte River
Valley, and are included in some slope wash along the edges of
Beebe Draw and Box Elder Valley. There are occasional water
bearing aquifers within this strata that are used for irrigation
and not for domestic purposes.
The next important strata is the Laramie-Fox Hills Forma-
tion. Wells of lesser yield in the vicinity of the study site
have their origin in this formation. The depth to this strata is
approximately 180 feet. The thickness of the Laramie-Fox Hills
Formation is approximately 300 feet.

Qvf = Valley-fill deposits
The hydrologic properties of the Laramie-Fox Hills Formation
will be discussed as most of the domestic wells located within one
mile of the subject site are drilled to the Laramie-Fox Hills
Formation and sealed above to prevent pumping or appropriation of
tributary waters. The direction of flow is northeasterly to out-
crop areas and the South Platte River. Flow rates, porosity, co-
efficient of storage, and permeability are not available through
the Colorado Division of Water Resources. The potentiometric sur-
face is 4700.
Flood Insurance Rate Map (FIRM) rates this area a minimal
flooding area. The nearest flooding is located along Box Elder
Creek, which is a north-south flood plain basin four (4 ) miles
east of the site under study.
Tire disposal and storage should not have any impact to
surface water and groundwater quality from the proposed facility.
Except for isolated cases, groundwater is located well below the
depth of penetration of the proposed cells. Surface water from
rain will drain from the plastic covering over the tires and
runoff is to be collected by stormwater trenches that connect
with each cell and flow to a central detention pond. Discharge
from the detention pond will not exceed the rate of the historic
runoff. Further, even if infiltration occurs, there is no evidence
to substantiate that water quality will be impacted by its passing
through or being entrapped by tires. Tires have been used to
promote coral growth along the Florida Keys with no adverse
effect to fish habitat.
The quality of groundwater in the uppermost stratographic
unit beneath the site under study is poor in quality and pro-
hibitive for domestic use. Shallow wells in the area that are
drilled in the Valley-Fill Deposits (Qvf ) are high producers for
cropland irrigation. The water has a high mineral content
partially attributable to leaching minerals from the surface.
Water for domestic use is drawn from the deeper Laramie-Fox Hills

Formation. These wells are sealed off from any upper formation.
The Laramie-Fox Hills Formation water is marginal for domestic
use due mainly to the dissolved iron concentration, its hardness,
and other undesirable characteristics.
The type and quality of material that will be required for
use as daily cover or intermediate cover over the life of the
facility will be 6 mil black plastic weighted down with tires.
No liner material will be used, as there is no known con-
tamination from tires to groundwater and with the cells being
covered and sloped to drain to the detention ponds, a minimum
amount of infiltration from surface runoff is expected.
' Operational Data
Owner and General Manager: Jerrald A. Jamison, President,
is the owner of Tire Mountain located at 12311 Weld County Road
41, Hudson, Colorado 80642. Mr. Jamison has 7 years of experience
in handling scrap tire disposal, storage, and recycling facilities.
Mr. Jamison and his site manager have authority to take corrective
action in the event of noncompliance.
Operation Hours: The operating time is 8 hours per day and
5 days per week. A working telephone is maintained at the facility.
Telephone: 573-5744 .
Daily Volume: The volume of tires on a daily basis is approx-
imately 2, 000 tires or 40, 000 pounds. Based on an operation for
52 weeks per year, and 5 days per week, 500, 000 tires per year
are estimated to collected at the site. It will take approximately
fifteen years to complete the landfill at a rate of 500,000 tires
per year, but may vary due to change in the economics and demand.
Personnel: Presently two full time employees work at the
facility. Additional employees will be hired as needed as the
scrap tire volume grows and when the recycling of tires starts.
Their classification and job descriptions are as follows:
1 - Owner and General Manager: general operations of business,
operates heavy equipment.
1 - Site Manager: heavy equipment operator, in charge of
placement of tires and construction of the cells.
1 - Truck Driver: responsible for handling tires from pick-
up point to storage facility.
2 - Tire Unloaders: responsible for unloading tires from
trucks.
The equipment to be used on the site is as follows:
1 - 8 yard Terex loader
1 - 3 yard Fiat Allis loader
1 - 1-1/2 yard Drop 50 backhoe
1 - 11 yard John Deere elevating scraper

Fire protection is provided, as shown on the plan sheet, by
50 foot wide berm between each cell in addition to all weather
fire lanes along the perimeter. Fire protection equipment will
consist of a crawler type hydraulic backhoe with a dirt and tire
bucket. This equipment will be stored adjacent to the tire
storage cells. Tire fires are generally extinguished with dirt.
There is ample dirt on site for such purpose. A 2, 200 gallon
water tank is stored on site for fire protection. Open burning
at a tire disposal and storage facility is not necessary nor
allowed.
Wind blown wastes do not become a problem at a tire dis-
posal and storage site. No retrieval plan is required.

No conceptual plans need to be implemented for surface or
groundwater contamination.
Tire Mountain has a domestic well with a capacity of 15
gallons per minute to be used for control of dust and personnel
use. Fire fighting and construction water will be trucked in
from Hudson or other bulk water sources.
Prominent signs are in place at the present entrance listing:
hours of operation, wastes accepted and 24 hour emergency telephone
number.
The Weld County Health Department and the Colorado Department
of Health will be notified in the event of a fire or other
emergency. The Owner plans to comply with follow up reporting of
the event.
Closure Data
The tire landfill and storage trenches will be in completed
phase as the trenches are filled, covered, and drainage systems
are put in place. No further closure procedures are anticipated
or warranted given existing technology. Reclamation of the en-
tire site upon completion and final closure thereof will be
accomplished in accordance with standard practices and the re-
quirements of the Colorado Department of Health for tire land-
fills in effect at the time of closure.

The system of records for incoming tires is by number of tires
delivered to the disposal site. Upon recycling activity, the
number of tires so recycled will be deducted from the cumulative
total delivered to the site.
Water quality monitoring will not be performed as no contami-
nation of groundwater is anticipated. Explosive gases are of no
concern as the ingredients for gases are not freely available, and
there are no organic wastes decaying in a high humidity environment.
As shown on the plans the cells are 550 feet long, 75 feet
wide at the natural ground line, and 15 feet deep. Eight of the
15 feet is in natural ground. The top 7 feet is to be constructed
embankment from the excavation of the cells .
The cells for disposing and storing of tires will be con-
tructed on an as needed basis. The tires in the cells will be
covered with 6 mil plastic. No dirt will be mixed with tires,
nor will they be covered with dirt. The intent is to leave them
dirt free as much as possible to have them ready to be recycled
when the equipment and feasible processes becomes available. The
plastic will be weighted down by tires.
Protective fencing is not going to be used along the perimeter
of the 40 acre tracts. The storing facility and filling operations
have been determined to be no more hazardous than the adjacent
farmland operations, thereby precluding a need for protective
fencing. Such fencing would be expensive to install and main-
tain, and it was determined that during fire fighting operations
a fence is a hinderance to turning equipment. There are natural
barriers around the site consisting primarily of blow sand that
would not allow movement of standard drive vehicles. Wherever
protection from entry is required, such as along the County Road,
tire barriers of large sized scrap tires will be placed in a uni-
form pattern. A locked entrance gate will be provided.
The provision for nuisance conditions are as follows:
1. Wind erosion - plant dryland grass seed to minimize
blowing soil.
2. Storm water runoff - detained in pond located at the
lowest point on the site.
3. Rodents and birds - there are no facilities to handle
waste substances that can be considered food to animal
or fowl.
