RE: APPROVE SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW
PERMIT FOR SUBSTITUTION OF A NONCONFORMING USE (DECORATIVE
ROCK FABRICATION, PROCESSING, AND FINISHING) - JACK AND
LaVONNE ECKSTINE
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners held a public
hearing on the 20th day of December, 1989 , at the hour of 10 : 00
a.m. in the Chambers of the Board for the purpose of hearing the
application of Jack and LaVonne Eckstine, 8585 Weld County Road
22 , Fort Lupton, Colorado 80621 , for a Site Specific Development
Plan and Special Review Permit for substitution of a nonconforming
use (decorative rock fabrication, processing, and finishing) on
the following described real estate , to-wit:
Part of the SE* , Section 9 , Township 2 North,
Range 67 West of the 6th P.M. , Weld County,
Colorado
WHEREAS, said applicants were represented by Charles Dickson,
Attorney, and
WHEREAS, Section 24 .4 . 2 of the Weld County Zoning Ordinance
provides standards for review of said Special Review Permit, and
WHEREAS, the Board of County Commissioners heard all of the
testimony and statements of those present, has studied the request
of the applicants and the recommendations of the Weld County
Planning Commission and all of the exhibits and evidence presented
in this matter and, having been fully informed, finds that this
request shall be approved for the following reasons:
1 . The submitted materials are in compliance with the
application requirements of Section 24 . 7 of the Weld
County Zoning Ordinance.
2 . It is the opinion of the Board of County Commissioners
that the applicants have shown compliance with Section
24 . 4 . 2 of the Weld County Zoning Ordinance as follows:
a. This proposal is located within the Urban Growth
Boundary Area of the Town of Firestone and is
consistent with the Weld County Comprehensive
�/ Plan' s Urban Growth Boundary Area Goals and

Policies. The Tri-Area Planning Commission
reviewed the proposal and indicated in a referral
response dated November 9 , 1989 , they find no
conflict with their interests;
b. The proposal is consistent with the intent of the A
(Agricultural) Zone District in which the use is
located. The proposed use is a substitution of a
nonconforming oil and gas support and service
facility and is provided for as a Use by Special
Review in the A (Agricultural) Zone District;
c. The uses permitted will be compatible with the
existing surrounding land uses and with the future
development of the surrounding area as permitted by
the Weld County Comprehensive Plan. The uses on
surrounding properties include agricultural
production, pasture , and a turkey farm.
d. No overlay districts affect the site; and
e. Special Review Development Standards will provide
adequate protection of the health, safety and
welfare of the neighborhood and County.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the application for a
Site Specific Development Plan and Special Review Permit for
substitution of a nonconforming use (decorative rock fabrication,
processing, and finishing) on the hereinabove described parcel of
land be, and hereby is , granted subject to the following
conditions:
1 . The attached Development Standards for the Special
Review Permit shall be adopted and placed on the Special
Review plat prior to recording the plat. The plat shall
be delivered to the Department of Planning Services and
be ready for recording in the office of the Weld County
Clerk and Recorder within 15 days of approval by the
Board of County Commissioners.
2 . No additional building or electrical permits shall be
issued on the property until the Special Review plat is
ready to be recorded in the office of the Weld County
Clerk and Recorder.
3 . Prior to recording the Special Review plat, the method
for disposal of cutting fluids associated with the
operation and the system design shall be reviewed by a

Colorado Registered Professional Engineer. A copy of
the report completed by the professional engineer shall
be submitted to the Weld County Health Department for
review and approval. A copy of the approved method and
system design shall be submitted to the Department of
Planning Services.
4 . Within 30 days of approval by the Board of County
Commissioners , evidence shall be submitted to the
Department of Planning Services that the approved system
design for cutting fluid disposal has been installed and
is operating in compliance with the Weld County Health
Department' s regulations.
5 . Prior to recording, the Special Review plat shall he
amended to show a 20 ' x 70 ' expansion of the existing
building to provide inside storage.
The above and foregoing Resolution was , on motion duly made
and seconded, adopted by the following vote on the 20th day of
December, A.D., 1989 .

DEVELOPMENT STANDARDS

1 . The Site Specific Development Plan and Special Review Permit
is for substitution of a nonconforming use (decorative rock
fabrication, processing, and finishing) as submitted in the
application materials on file in the Department of Planning
Services and subject to the Development Standards stated
herein.
2 . Approval of this plan may create a vested property right
pursuant to Article 68 of Title 24 , C.R.S. , as amended.
3 . Structures or septic systems shall not be located within
Colorado Interstate Gas Company' s right-of-way.
4 . Waste oil, waste paints, stains, treatments, anti-freeze, and
other associated liquid and solid wastes shall be stored and
removed for final disposal in a manner that protects against
surface and groundwater contamination.
5 . Any required Emissions Permit shall be obtained from the Air
Pollution Control Division, Colorado Department of Health,
for fugitive dust or other emissions.
6 . No permanent disposal of wastes shall be permitted at this
site.
7 . Fugitive dust shall be confined on this site.
8 . The maximum permissible noise level shall not exceed the
industrial limit of 80 dB (A) , as measured according to
25-12-102 , Colorado Revised Statutes.
9 . All individual sewage disposal systems for the facility shall
be installed and maintained according to the Weld County
Individual Sewage Disposal Regulations.
10 . All construction on the property shall be in accordance with
the requirements of the Weld County Building Code Ordinance.
11 . The property owner or operator shall be responsible for
complying with the Design Standards of Section 24 . 5 of the
Weld County Zoning Ordinance.

12. The property owner or operator shall be responsible for
complying with the Operation Standards of Section 24 .6 of the
Weld County Zoning Ordinance.
13 . Personnel from the Weld County Health Department and Weld
County Department of Planning Services shall be granted
access onto the property at any reasonable time in order to
ensure the activities carried out on the property comply with
the Development Standards stated herein and all applicable
Weld County Regulations .
14 . The Special Review area shall be limited to the plans shown
herein and governed by the foregoing Standards and all
applicable Weld County Regulations. Major changes from the
plans or Development Standards as shown or stated shall
require the approval of an amendment of the Permit by the
Weld County Planning Commission and the Board of County
Commissioners before such changes from the plans or
Development Standards are permitted. Any other changes shall
be filed in the office of the Department of Planning
Services.
15 . The property owner or operator shall be responsible for
complying with all of the foregoing Development Standards.
Noncompliance with any of the foregoing Development Standards
may be reason for revocation of the Permit by the Board of
County Commissioners.

A public hearing was conducted on December 20, 1989, at 10:00 A.M. ,
with the following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated November 29, 1989, and
duly published December 7, 1989, in The New News, a public hearing was
conducted to consider the application of Jack and LaVonne Eckstine for
a Site Specific Development Plan and Special Review Permit for the
substitution of a nonconforming use (decorative rock fabrication,
processing, and finishing) . Bruce Barker, Assistant County Attorney,
made this matter of record. Keith Schuett, Planning Department
-representative, entered the favorable recommendation of the Planning
Commission into the record. Charles Dickson, Attorney, came forward to
represent the applicants. He answered questions concerning the ditch
lateral which runs through the property, but not through the Special
Review Permit area. Mr. Dickson asked for the right to add a 20 x 70'
addition to the existing building, and said a mylar will be submitted
showing such. No public comment was offered concerning this request.
Commissioner Lacy moved to approve the request of Jack and LaVonne
Eckstine for a Site Specific Development Plan and Special Review
Permit, subject to the Conditions and Development Standards recommended
by the Planning Commission, with an extra Condition allowing the
proposed 20 x 70' addition to the existing building. The motion was
seconded by Commissioner Harbert, and it carried unanimously.
This Certification was approved on the 27th day of December, 1989.

APPEARANCE:
Russ Anson, Attorney at Law, represented the applicant. He stated the sign
posting requirements had not been met by the applicant. Therefore, they had
no objection to this request being continued to the regular meeting of the
Planning Commission scheduled for December 5, 1989.
MOTION:
LeAnn Reid moved Case Number Z-451 for Robert E. and Lenora Comer (Plastic
Art Products) be continued to the next regularly scheduled meeting of the
Planning Commission on December 5, 1989, at 1:30 p.m. , to allow the
Applicant sufficient time to meet the sign posting requirements. Motion
seconded by Judy Yamaguchi.
The Chairman called for discussion from the members of the Planning
Commission. Discussion followed.
The Chairman asked the secretary to poll the members of the Planning
Commission for their decision. Bud Clemons - yes; Rick Iverson - yes; LeAnn

APPEARANCE:
Jack Eckstine, applicant, stated this property has had a commercial
operation on it for about twenty years. The property looks much nicer now
with this operation on it than it did before. There will be some outside
storage of piled materials. Supplies will consist of only one to two
semi-loads a month.

-Representatives of the Bull Canal shall be provided access to the
Bull Canal and no structures or uses shall encroach on its
sight-of-way. And that all ensuing standards be renumbered
consecutively.
Charles Dixon, Attorney for the applicant, felt the staff is trying to
_create a contract right on the existing rights of the Bull Canal. The Canal
has a thirty foot right-cf-way from the centerline of the ditch in both
directions. Other than objecting to the recommendation for a new
Development Standard 10, they have no problems with the staff's
recommendation.

This recommendation is based, in part, upon a review of the application
submitted by the applicant, other relevant information regarding the

The Planning Commission's recommendation for approval is conditional upon
the following:
1 . The attached Development Standards for the Special Review permit
shall be adopted and placed on the Special Review plat prior to
recording the plat. The plat shall be delivered to the Department
o₹ Planning Services and be ready for recording in the Weld County
Clerk and Recorder's office within 15 days of approval by the
Board of County Commissioners.
2. No additional building or electrical permits shall be issued on

for approval, subject to the following conditions:
1. Waste oil, waste paints, stains, treatments, anti-freeze, and
other associated liquid and solid wastes , shall be stored and
removed for final disposal in a manner that protects against
surface and groundwater contamination.
2 . Any -Required Emissions Permit is obtained from the Air _Pollution
Control Division, Colorado Department of Health for fugitive dust
or other Emissions . .
3. No permanent disposal of wastes shall be permitted at this site.
4. Fugitive dust must be confined on this site.
5. Maximum permissible noise level -shall not exceed the industrial
limit of 80db(A) , as measured according to 25-12-102 , Colorado
Revised Statues.
6 . An individual sewage disposal system, is required for the
employees of the proposed facility and shall be installed
according to the Weld County Individual Sewage Disposal
Regulations .
7. The septic system is required to be designed by a Colorado
-Registered Professional Engineer according to the Weld County
Individual Sewage Disposal Regulations .
8 . The waste stream from the rock shall be evaluated by a Registered
Professional Engineer to certify the handling and disposal
including the land application of the liquid ,caste component.

PROPOSED OPERATION AND USE

1 . Proposed Use: Fabrication and finishing of marble and granite used for
building facing, interior vertical f-acing, and flooring.
2. Need for Use: The area has been used for oil field support and ser-
vices since 1969. The building was -built in 197_6. The building is the
right size and location with all utilities avail-able in place.
3. Ixisting Uses tf Surrounding -Areas: The property to the east is used
for commercial turkey production; the property to the south is -owned by the
Greeley National Bank and is undeveloped; the property to the west and
north is used as dryland pasture for cattle.
4. Residential Structures: North 1/2 mile — owned by my son; East 1/5
mile - owned by Gordon Turkey farm; west 3/10 mile - owned by me. Thera is
a mobile home located on the property which has been used by company
personnel to control and protect the operation and will remain as such.
5. Number tf Users, Patrons, Members, and -Buyers: There will be one user
of the building. There will to no patrons, members or buyers.
6. Number tf Employees, Shifts and Hours: There will be approximately six
employees, with one day-time shift and normal day-time hours. The employer
is seeking to hire local personnel which will help the local economy.
7. Water Source: Water is now supplied by Central Meld Water District.
There will to no increase in the demand for water.
8. Vehicular Traffic: Employees will use normal auto/truck vahicl-es on a
daily basis. Deliveries will occur two to three times a week and will be
delivered by standard delivery trucks up to tractor/trailers.
9. Sewage Facilities: There is an existing septic system and holding
tank, which is -adequate. We will need one additional holding -tank for
floor drain water to collect the grit in a settling tank. The excess water
will to used to irrigate the -adjoining pasture.
10. Proposed Fire Protection: The area is within the Platteville Fire
Protection District. The material to be handled is natural stone. Hand-
held -fire extinguishers will be placed at _each end of the building.
11. Types and Maximum Number of Animals: None.
12. Type and -Size of Waste, Stockpile or Storage Areas: Stockpiling -of
material will occur within the building. There will be no other waste. No
junk will tie allowed to stockpile on the property. The waste stone or
granite will be placed in dumpsters which will be picked up on a weekly
or bi-weekly basis.

13. Type of Storm Water Retention Facilities: The building is existing
and no additional impact is -anticipated.
14. Time Schedule for Removal and Disposal of Debris, _Junk and Waste:
Dumpsters will be picked up either weekly or bi-weekly as need dictates.
No other junk or waste will be allowed to accumulate en the property or
within the building.
15. Proposed Landscaping and Erosion Control. The building is existing
with the open areas Covered with gravel or roadbase to control erosion of
soil.
1b. Reclamation Procedure: There will be no reclamation needed.
17. Time Table: None because -building is existing and no additions are
required.
18. Weld _County Comprehensive Plan: The location is within urban growth
boundary. It appears consistent with the Town of Firestone. The business
is located in an area that is non-prime agricultural land. Therefore no
land will be -taken off production.
19. Intent of District: The area is located in the agricultural district.
Replacing of non-conforming uses are allowed by special revision.
20. Efforts to Conserve Agricultural Land: This property is already in a
deli-gnat-ed use -as a shop building and there will the no additional land
acquired or needed for-this use.
21 . Protection of Health, Safety and Welfare -of Neighborhood: The type of
work to be performed does not involve the storage of hazardous chemicals
and any debris will be n-atural rock or stone.
22. Use Permitted: The fabrication -and finishing of the decorative -stone
will be in the building. Therefore it will have minimal impact on the
surrounding area. The adjacent land to the east is owned by Gordon Turkey
Farm and used for commercial turkey production. The land to the north and
west is used for dryland -pasture and the property to the south is owned by
Greeley National Bank and is undevel-oped.
23. Development of Surrounding Areas: This building and site are existing
and -have not had nor will it have an impact on the development of the
surrounding areas. Future -development can -occur as permitted by the
existing zone as projected by the comprehensive plan of the county or the
adopted master Mans of affected -municipalities. The property is serviced
by Weld County Roads 22 (unpaved) and 19 (paved). The Continued use will
not affect highway travel more than past use by this property.
24. Flood -Plain. The existing site is not located within a flood plain,
geological hazard or Weld County Airport -overlay district area.

25. Water Supply: The present water suppli-ed -by Central Weld Water
District will continue to serve the needs of the proposed use. -A copy of

I have applied for a special use permit for the above property. I
request -that the County issue a building permit for -electric-al upgrade and
holding tank prior to the County Commissioners' final approval.
The permits' delay will have a severe economic impact on this t enant
as they have a large investment in this equipment. Also, any -delay will
have an adverse affect in the local personnel whom this -tenant is seeking
to hire. In addition, any delay will have an economic impact on me.
