RE: ACTION OF THE BOARD REGARDING SUBSTANTIAL CHANGE IN THE
CHANGE OF ZONE APPLICATION OF CRS INVESTMENTS (BAY SHORES
P.U.D. )
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners held a public
hearing on the 6th day of May, 1987 , at the hour of 2 : 00 p.m. in
the Chambers of the Board for the purpose of considering whether
or not there has been substantial change in the facts and
circumstances regarding the application of CRS Investments (Bay
Shores P.U.D. ) , 1333 West 120th Avenue, Suite 308 , Denver ,
Colorado 80234 , or that there is newly discovered evidence for a
Change of Zone which was denied by the Board of County
Commissioners on February, 18 , 1987 , and
WHEREAS , said hearing concerned the application for a Change
of Zone on the following described real estate, to-wit:
Part of the N1 of Section 5 , Township 2 North,
Range 68 West of the 6th P.M. , Weld County,
Colorado
WHEREAS, said hearing was conducted according to the Board' s
policy concerning applications for land-use for property
previously denied , said policy having been adopted on May 2 , 198' ,
and
WHEREAS, the Board of County Commissioners heard all of the
testimony and statements of those present, has studied the request
of the applicant and the recommendation of the Weld County
Planning Commission and all of the exhibits and evidence presented
in the matter and, having been fully informed, finds that the
request for a rehearing concerning this matter shall be approved
for the following reasons:
1 . It is the opinion of the Board of County Commissioners
that the applicant , in his letter of May 5 , 1987 , has
demonstrated that a substantial change in facts and
circumstances has occurred.
a. The application for Bay Shores, Z-430 : 86: 5 , that
was denied by the Board of County Commissioners on
February 18 , 1987 , was reviewed under the old
Comprehensive Plan. The Board of County

Commissioners on January 13 , 1987 , approved a new
Comprehensive Plan. This is a substantial change
in the facts and was not available when the
original rezoning case was submitted. Any new
application that would be submitted will be
reviewed under the newly-approved Comprehensive
Plan.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that there has been
substantial change in the facts and circumstances regarding the
application of CRS Investments (Bay Shores P.U.D. ) for a Change of
Zone.
BE IT FURTHER RESOLVED by the Board that the request for a
rehearing regarding a Change of Zone on the above described parcel
of land be, and hereby is, granted.
The above and foregoing Resolution was, on motion duly made
and seconded , adopted by the following vote on the 6th day of May,
A.D. , 1987 .

A public hearing was conducted on May 6, 1987, at 2:00 P.M. , with the
following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated April 20, 1987, and
duly published April 23, 1987, in the Johnstown Breeze, a public
hearing was conducted to consider whether or not there has been
substantial change concerning the application of CRS Investments for a
Change of Zone for Bay Shores P.U.D. which was denied by the Board on
February 18, 1987. Bruce Barker, Assistant County Attorney, made this
matter of record and Keith Schuett, Planning Department representative,
read the favorable recommendation of the Planning Commission into the
record. Mr. Barker reviewed the Board's policy regarding substantial
change hearings and stated that the only matter being considered at
this hearing is whether or not the applicant will be allowed to
re-apply for a Change of Zone. Vern Nelson, of Nelson Engineers, came
forward to represent the applicant. He stated that a new Comprehensive
Plan has been adopted by Weld County, which constitutes a substantial
change in this request, and that a change has been made in the area
involved. No public testimony was offered concerning this matter.
Commissioner Kirby moved to find that a substantial change has occurred
and allow the applicant to re-apply for a Change of Zone, due to the
adoption of the new Weld County Comprehensive Plan. The motion was
seconded by Commissioner Brantner. After favorable comments by
Commissioner Johnson and Chairman Lacy, the motion carried unanimously.
This Certification was approved on the 11th day of May, 1987.

This will acknowledge receipt of your notice, dated April 20, 1987,
scheduling a public hearing at 2:00 P.M. , May 6, 11387.
The Great Western Railway offers a possible substantial change in
its position i.e. ,
1. In the interest of harmony with the Bayshores developers and
the community at large, GWRy will withdraw its objection,
providing. . .
2. The Board of County Commissioners will, prior to, or
concurrently with -possible -approval of the Bay Shores
proposal, direct the Weld County Roast and Bridge Department
to place and maintain speed bumps and -stop signs in advance
of both sides -at Great Western Railway crossings traversing
Weld County raods 3 1/2 -and 26, in addition to any other
prescribed devices.
The Groat Western Railway respe-ctfully suggests that in light of the
record in this docket, i.e. , extremely high potential liability to
both the railway, and the county; position two (2) above, constitute
our best collective protection against inevitable accident litigation.

was none.
The Chairman asked that reading the recommendations, conditions, and
development standards into the record be dispensed with and that they be
filed with the summary as a permanent record of these proceedings.
MOTION:
Lydia Dunbar moved Case Number USR-777:87: 1 for Jack Dinis for a Use by
Special Review Permit for a livestock confinement operation for a 1,200
animal unit dairy facility be forwarded to the Board of County Commissioners
with the Planning Commission's recommendation for approved based upon the
recommendations and conditions as outlined by the Department of Planning
Services staff, the development standards as outlined by the staff and
amended by the Planning Commission, and the testimony heard by the members
of the Planning Commission. Motion seconded by Louis Rademacher.

Commission. Discussion followed.
The Chairman asked the secretary to poll the members of the Planning
Commission for their decision. Louis -Rademacher - yes; Ivan Gosnell - yes;

LOCATION: Approximately 3 miles east of Longmont; north of State _Highway 119
and south of Weld County Road 26
APPEARANCE:
LaVerne Nelson, 3.E. , Nelson Engineers, represented the applicants. He
reviewed a letter from Harvey Curtis, Attorney, asking for permission to
r-eapply for this request. This request was denied by the _Board of County
Commissioners on February 17, 1987, but it was submitted under the old
Comprehensive Plan. They -now wish to resubmit the application under the
Comprehensive Plan adopted on January 13, 1987. This plan incorporated -a
mixed use development area. At the time this request was 3ienied, the Board
of County Commissioners were not sure about the planned roads. CRS
contracted a traffic -planner and this study is now complete. The
Engineering Department and the Planning Services' staff now have copies of

this plan. They have not reached a specific agreement with Union Reservoir
at this time. They do have an agreement with the Oligarchy Ditch Company.
Since this request was denied there has been a actual change of ownership to
CRS Investments. They will be on the St. Vrain Sanitation District. New
information is not to be reviewed at this time. New information need to be
submitted, but it will be presented with a new application.
Keith Schuett stated the 1973 Comprehensive Plan did not have a mixed use
development and activity center, urban growth plan goals and policies, nor
did it have the public service goals and policies. Therefore, the staff is
of the opinion that conditions have changed since the first application was
heard.
Lee Morrison explained that without getting into the merits of the case,
unless there has been a substantial change, an applicant cannot refile a
request for -five years. He read the Substantial Change Hearing requirements
into -the record. Whether or Tot you will change your mind regarding this
request is not the issue. This request has to be reviewed. The Planning
staff is entitled to an opinion based on the facts from a planning point of
view. Theirs is not an opinion of the law.

determine substantial change because she believes the provisions we are
looking at are not substantially different even if the plan does have
changes in it. Ann Garrison - yes; Jack Holman - No, he agrees with
Paulette. There is not that much of a substantial change even though we are

his business even though the business -has been here for years. A small
office addition will be added to the existing building.
The Chairman tailed for discussion _from the members of the audience. There
was none.
The Chairman asked the applicant if they had reviewed the -recommendations,
conditions, and development standards as set Lorth by the Department of
Planning Services staff. He stated they have and have no objections to
them.

APPLICATIONS FOR LAND-USE FOR PROPERTY PREVIOUSLY DENIED
1. Neither an applicant nor his successors in interest in property for
which a land-use application was denied within the preceding five (5)
years may submit a land-use application or request a rehearing on a
previously submitted application for any portion of the property
contained in the original application unless the Board of County
Commissioners has determined that, based upon a showing by the
applicant, there has been a substantial change in the facts and
circumstances regarding the application or that there is newly
discovered evidence that the applicant could not have discovered with
diligent effort at the time of the original application.
2. "Substantial change in facts and circumstances" shall mean a
substantial change in the land-use application, in the surrounding
land-uses or in applicable provisions of the law.
3. A petition requesting rehearing on an application or permission to file
another application for property previously Aenied a land-use permit
shall be submitted to the Department of Planning Services for
processing. The Department shall schedule a substantial change hearing
before the Planning Commission or the Board of County Commissioners.
Land-use applications originally heard by only the Board of County
Commissioners shall be scheduled before the Board only. The Planning
Commission shall consider the rehearing petition only if it considered
the original land-use application. It shall review the petition and
any supporting information. The Planning Commission shall consider
whether the applicant has demonstrated that a substantial change in the
facts or circumstances have occurred subsequent to the Board's decision
or that there was newly discovered evidence that the applicant could
not have discovered with diligent effort at the time of the original
application. The Planning Commission shall make a written
recommendation of its findings to the Board of County Commissioners.
4. Legal notice of a substantial change hearing shall be published once in
the newspaper designated by the Board of County Commissioners for
publication of notices. The date of publication shall be at least ten
(10) days prior to the Planning Commission hearing.
5. Notice of the substantial change hearing and the public hearing date
shall be provided to owners of property located within five hundred
(500) feet of the parcel under consideration and owners and lessees of
the mineral estate on or under the parcel under consideration. The
notification shall be mailed, first class, not less than ten (10) days
before the scheduled public hearing. Similar notice shall also be
provided any agency, body, or group who received a referral request
from the Department of Planning services on the original application.
6. The Board of County Commissioners shall hold a substantial change
hearing after the legal notice and notices to property owner, mineral
owners and lessees, and referral agencies identified in 4 and 5 have
been completed. The legal notice and notification shall be done at
least ten (10) days prior to the Board's hearing.

7. The Board of County Commissioners may grant such a petition when it
determines that the applicant has demonstrated that a substantial
change in the facts or circumstances have occurred subsequent to the
Board's decision or that there was newly discovered evidence not
available to the applicant at the time the Board considered the
application. The Board may deny the petition solely upon the contents
of the petition or when deemed advisable by the Board that the
applicant has failed to demonstrate that a substantial change in the
facts or circumstances have occurred subsequent to the Board's decision
or that there was newly discovered evidence that the applicant could
not have discovered with diligent effort at the time of the original
application. The Board shall consider the applicant's rehearing
petition, the Planning Commission's recommendation, oral testimony at
the public hearings, written related information, and any other
relevant material in making its decision.
8. When the Board of County Commissioners grants a rehearing petition, the
applicant may file a new application with the Department of Planning
Services. The application shall be processed in accordance with the
requirements of the Weld County Zoning Ordinance or Weld County
Subdivision Regulations.
9. No petition for rehearing may be granted where the decision of the
Board of County Commissioners on a land-use application has been
appealed or contested in any court of law, during the pendency of the
court action.

Dear Commissioners :
This letter is written on behalf of CRS Investments , Inc. ,
requesting that it be permitted to submit a re-application for
the rezoning of the Bay Shores Planned Unit Development pursuant
to the policy of this Board adopted on October 22, 1986 , entitled
"Applications for Land-Use for Property Previously Denied. "
Pursuant to said resolution of policy, CRS Investments , Inc.
would state as grounds for the re-application the following:
1. One of the reasons of the Board of County
Commissioners ' denying the rezoning of the Bay Shores Subdivision
P.U.D. on February 18 , 1987, was that the proposed rezoning was
not in compliance with the Weld County Comprehensive Plan adopted
in 1973 , under which the rezoning request was submitted.
2. While this rezoning application was pending, on
January 7 , 1987, this Board adopted a new Weld County
Comprehensive Plan. This plan denotes uses for the Bay Shores
property as low density residential and medium density
residential . The prior 1973 plan denoted uses as agricultural.
3 . The adoption of the 1986 Master Plan represents a
change of facts and circumstances under the October 22, 1986
policy and CRS Investments , Inc. respectfully submits that
re-application for the rezoning of the Bay Shores Subdivision
P.U.D. should be permitted by this Board.
4. As further grounds , the Commissioners at the hearing on
February 18, 1987 , stated in discussion upon the motion for
denial , that planned road improvements to County Roads Nos . 3-1/2
and 26 needed to be adequate for handling the Subdivision traffic
in Phases I and II and that further study in this area was
indicated. Accordingly, CRS Investments , Inc. has committed to

doing a traffic study. If this petition is granted, this traffic
study for the rezoning request will be completed prior to the
resubmittal of the rezoning request to the County.
5 . Since the original 1986 rezoning application was filed,
Great Western Railway Company deeded to Susan Ringsby Pietrzak
certain lands which are to be conveyed by Mrs . Pietrzak to CRS
Investments , Inc. The re-application will include these
additional lands . These lands are described in the enclosed
bargain and sale deed.
Because of each of the foregoing reasons , CRS Investments , Inc. ,
respectfully requests that this Board determine that a
substantial change of facts and circumstances has occurred and
that this Board allow CRS Investments , Inc. to resubmit its
rezoning application for its property located on the north half
of section 5 , T. 5 N. , R. 68 W. of the 6th P.M.
To facilitate the time required for the resubmittal, C.R.S . will

Dear Mr. Schuett:
We have expressed several concerns about this project in letters dated
June 19, 1986, October 13, 1986, and November 3, 1986 (attached). Although a
plan has been adopted for this area, many of our concerns remain unresolved.
1. A high density, urban development at this location will be detri-
mental to the development concentrated around the SH119 interchange, as well
as the City of Longmont, as it will lead to the extremely inefficient pro-
vision of services to the future residents of the area. It will also have
detrimental effects on surrounding agricultural uses.
2. The City of Longmont recently acquired a majority interest in the
Union Reservoir. Much of this proposed project is below the dam. Development
for high density residential purposes would change the rating of the dam to
high hazard status, which would greatly increase the standards of maintenance.
It could also increase liability to the owners of the dam, the developers of
the proposed Bay Shores PUD, and the County. Most importantly, however, is
that residential development as envisioned would put many lives at risk.
3. Drainage and runoff from the subdivision is a concern, not only in
terms of restricting the amount to historical levels, but also with regard to
the water quality. Adjacent development would negatively affect water quality.
4. The enlargement potential of the Union Reservoir could be negated
or at least be more difficult to achieve with the development of the proposed
subdivision. There is limited existing potential for water storage in the
St. Vrain Basin, and the Union Reservoir is one of the viable sites. The City
of Longmont needs additional storage capacity and opposes any development which
would preclude potential water storage.

The Union Reservoir Company has reviewed the petition of CRS
Investments for a Substantial Change Hearing.
If the application of CRS Investments is allowed to be re-
submitted, the Union Reservoir Company will still have many concerns
regarding the project , as previously set out in correspondence in
Case Number Z-430 : 86 : 5 . - These concerns are summarized as follows :
1 . The Company can still not obtain any liability insurance . The
development of the area and the road location must be designed in
order to reduce and discourage any public access onto the lake . If
houses are proposed to be built adjacent to the reservoir, claims may
be made by the lot owners against the Company for seep , erosion and
dust blowing from exposed shorelines . The lot owners next to the
lake should be required to execute or have in their deeds some form
of waiver, disclaimer or release directed to the reservoir company
not only for seep and erosion problems , but also for accidents from
drowning and any storage of gas and oil which might pollute the reser-
voir. With a school in the neighborhood, there will be additional
problems of the reservoir being an "attractive nuisance" .
2 . Detention ponds and other methods should be developed in
order to keep silt and storm run-off getting into the lake above
historic rates and amounts .
3 . The City of Longmont has purchased , or has under option to
purchase , the majority of the shares of Union Reservoir Company. The
City of Longmont has filed pleadings with the Water Court to enlarge
the decree for filling the reservoir and at some point is anticipating
the enlargement of the reservoir. If houses are built adjacent to the
reservoir, these houses will eventually have to be moved out either
voluntarily or through eminent domain proceedings . The water level
might be raised about 15 feet. If the road is relocated, it may also
have to be moved again.
4 . Lot owners next to the reservoir would not be allowed onto the

reservoir unless they were members of whatever recreational organi-
zation that was leasing the reservoir. An alternative might require
that a fence be constructed between the houses and the reservoir.
If any sip-rap was to be used, appropriate aesthetic principles must
be addressed , and the Company must be assurred of proper placement
and maintenance of the rip-rap.
I-t is hoped that these comments will assist the Planning Depart-
ment in its consideration of the petition. Union Reservoir Company
would request that the petition be denied unless these concerns are
dealt with and resolved.

We have reviewed the re-application request for Bay Shores PUD, and we have
no objections to this request. However, we would like to reemphasize our
previous concern about the traffic impact of this development on the State
Highway 119/County Road 31/2 intersection.
-As indicated in the re-application request, a traffic impact study will be
provided by the developer. This study must address the need for turn lanes
at the SH 119/Co. Rd. 3' intersection, according to the State Highway Access
Code. Depending on the size of the development, the potential for a traffic
signal may also need to be analyzed.
The appropriate intersection improvements should be provided by the developer
iof Bay Shores PUD. An Access Permit from this office will be required to
-document these improvements.

Due to changing circumstances and conditions, the Bay Shores
Y.U.D . rezoning case has been continued to November 4, 1986. You
will receive a copy of a revised submittal package from Weld
County late next week. We request that you disregard the Previous
submittal packages since they no longer reflect the intentions of
the applicant.
The most significant change is that we are requesting land use
designations which fix maximum densities. Whether or not the
maximum density will ever be obtained, the maximum number
controls. From our land use chart, you will notice that the
maximum allowable density is 1 ,007 units. We know that this
request differs substantially from the previous reviews and ask
that you contact our office if there are any significant changes
which will be made to your response to the county. Additionally,
we request that you provide a copy of the response which you mail
to the county to this office.

Estimated service population at buildout has been derived _from the 1980
census mean household figure of 2.78 persons for a total of 1,179 persons.
Costs to supply service for this population is derived from analysis of our
current costs to obtain a lower lint of $39 ,330 annually to an upper limit
of $94,638 annually.
This development is • located remote to central Weld County near a large
population concentration it Boulder _County . Historically, this is a very
active area for service tiemand: --These -factors tend to move the anticipated
costs toward the upper limits of the ranee. The POD concept tends to move
the costs into the mid-range. Crsr best estimate is 560,000 to 565,000
annually or about 5141 to 5153 per unit.
Conventional- sill levy property tames do mot appear sufficient to adecuately
-cover -the costs of this proj ect. While we are not opposed to the proi act,
some -;alternative funding to - cover the costs of our services will be
necessary for our concurrence.
