RE: APPROVE AGREEMENT FOR PAVING A PORTION OF WELD COUNTY ROAD 76
AND AUTHORIZE CHAIRMAN TO SIGN
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with an Agreement
between Weld County and Hank Stark, Gary Billings, Joel Burkes,
Oscar Thompson, Doug Morrow, Romero Ramirez , and Richard Bourasa
for paving a portion of Weld County Road 76 , and
WHEREAS , said property owners desire to obtain services from
Weld County for the paving of Weld County Road 76 at its
intersection with Weld County Road 39 east for 500 feet to the
common driveway of the property owners, and
WHEREAS , Weld County agrees to provide the paving services
with the terms and conditions being as stated in the Agreement, a
copy of which is attached hereto and incorporated herein by
reference, and
WHEREAS, the Board desires to approve the Agreement for
paving a portion of Weld County Road 76 .
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the Agreement between
Weld County and Hank Stark, Gary Billings , Joel Burkes , Oscar
Thompson, Doug Morrow, Romero Ramirez , and Richard Bourasa for
paving a portion of Weld County Road 76 be, and hereby is,
approved.
BE IT FURTHER RESOLVED by the Board that the Chairman be, and
hereby is, authorized to sign said Agreement.

AGREEMENT FOR PAVING A PORTION OF WELD COUNTY ROAD 76
RdTHIS GENENT, made and entered into this 6,3

Q , 1987 , by and between WELD COUNTY, COLORADO,
BY AI THROUGH THE BOARD OF COUNTY COMMISSIONERS OF WELD COUNTY,
COLORADO, hereinafter referred to as "Weld County, " and the
following parties : HANK STARK, GARY BILLINGS, JOEL BURKES, OSCAR
THOMPSON, DOUG MORROW, ROMERO RAMIREZ, and RICHARD BOURASA,
hereinafter individually referred to by their last names and
collectively as "Property Owners. "
WITNESSETH:
WHEREAS, Property Owners are the owners of certain properties
located to the south of Weld County Road 76 and to the east of
Weld County Road 39 , which border a common driveway which
intersects with WCR 76 approximately 500 feet east of the
intersection of WCR 76 and WCR 39 , and
WHEREAS , said Property Owners desire to obtain the paving of
WCR 76 at its intersection with WCR 39 east for 500 feet to said
private driveway, and
WHEREAS , Weld County desires to provide said paving in
accordance with the following terms and conditions.
NOW, THEREFORE, in consideration of the mutual promises and
covenants contained herein, the parties hereto agree as follows !
1 . That Weld County will pave Weld County Road 76 east from
its intersection with Weld County Road 39 approximately 500 feet
to the intersection of the above-stated private driveway and WCR
76 .
2 . That the cost of said paving shall be approximately
$4 , 002 .00 .
3 . That said cost will be paid as follows :
a. Stark, Billings , Burkes, Thompson, Morrow, and
Ramirez shall each pay $617 . 00 .
b. Bourasa shall pay $300 . 00 .
c. Any amount over $4 , 002 .00 shall be paid by Weld
County.
d. If the total cost of said paving is less than
$4 , 002 . 00 , then Weld County shall prorate back the
remainder ($4 , 002 .00 minus the actual cost of

paving) to Property Owners in accordance with the
percentages of $4, 002 . 00 as stated in paragraphs a
and b above.
4 . The Property Owners shall pay the sums as stated in the
above paragraph prior to the date when Weld County begins said
paving work.
