HomeMy WebLinkAbout871343.tiff RESOLUTION RE: ACTION OF BOARD CONCERNING APPEAL OF HEALTH BOARD DECISION - RONALD AND MARY ANN SCHMUNK WHEREAS , the Board of County Commissioners of Weld County, Colorado , pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado , and WHEREAS, on September 22 , 1987 , the Board of Health considered a request from Ronald and Mary Ann Schmunk concerning a variance request to connect a second mobile home to an existing septic system currently servicing a mobile home looted at 38418 Weld County Road 33 , Eaton, and WHEREAS, on said date the Board of Health granted said variance subject to the following conditions: 1) The septic tank size be determined to be 1 , 500 gallons . 2) The absorption field be increased an additional 702 square feet. 3) The repairs to the system be completed within 30 days . WHEREAS , Mr. and Mrs . Schmunk filed an appeal concerning said conditions to the Board of County Commissioners , with the appeal being heard on October 26 , 1987 , and WHEREAS, after consideration, the Board deemed it appropriate to deny said appeal as to Conditions No. 1 and 2 ; and grant the appeal as to Condition No. 3 , allowing the Schmunks until May 20 , 1988 , to accomplish the repairs to the, existing system. Board of Health members present included: Dale Peters, Chairman; Mary Henneck; Jean Maxey; Dr. William Cutts ; Vicki Edmiston; and Diana Score. Others: Patrick Shepherd, Environmental Health Specialist; Allen Palmquist, Environmental Health Supervisor; Don Orleans; Dr. Joe Ferguson; Ronald Schmunk, Mary Schmunk, and others. Mr. & Mrs. Schmunk are requesting a variance to connect another mobile home to an existing septic system currently servicing a mobile home located at 38418 Weld County Road 33, Eaton. They are seeking a variance to the following sections of I.S.D.S. Regulations: Section 3. 1 — Relating to whether or not the system is adequate. Section 3. 17E — Relating to more than one dwelling being connected to the same system. Section 5.4 — Relating to the size of the absorption field. Mr. and Mrs. Schmunk stated they live in one mobile home and their son will live in the other. They do not wish to go to the expense of installing another septic system or enlarging the current system because they do not plan on more than the three of them living in these homes. The Schmunks stated they would be willing to enlarge the system if more people would :live in the homes while they own them. The Schmunks also offered to take out a wall between two bedrooms in each of the mobile homes so that each home would have two bedrooms instead of three. Mr. and Mrs. Schmunk stated they have a receipt showing they paid for a 1,250 gallon septic tank. Their installer told them he did not have a 1,250 gallon in stock at the time of installation, and he installed a 1,500 gallon tank instead. Health Protection staff feels that the current system originally designed for one three—bedroom mobile home is not sufficient size to handle two three— bedroom mobile homes. The original permit issued in May, 1987, was for one dwelling with four bedrooms. They are now proposing to have two dwellings with a total of six bedrooms connected to the system. A 1,750 gallon septic tank is required for six bedrooms. Patrick Shepherd, Environmental Health Specialist with Weld County Health Department, stated the percolation rate at the site is 12 minutes per inch. This requires an absorption field of 1,422 square feet. The system now has 720 square feet of absorption field. Health Protection staff recommended denial of this variance request. 871a 3 Schmunk Variance Request September 22, 1987 Page 2 Diana Score moved the Board of Health approve this variance request with the following conditions: 1.
