RE: APPROVE CONTINUANCE OF SHOW CAUSE HEARING - MANUEL BALDERAS
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners held a public
hearing on the 21st day of November, 1988 , at the hour of 9 : 00
a.m. in the Chambers of the Board for the purpose of considering
the revocation of Use by Special Review Permit #713 which was
granted to Manuel Balderas for the following described parcel of
land:
Part of the SE} of Section 22 , Township 2
North, Range 64 West of the 6th P.M. , Weld
County, Colorado
WHEREAS, the Board deemed it advisable to continue said
hearing to March 1 , 1989 , so that Mr. Balderas can submit an
application for an Amended Use by Special Review, said application
to be reviewed by the Planning Commission and the Board.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the hearing to Show
Cause concerning Use by Special Review Permit #713 , issued to
Manuel Balderas , be, and hereby is , continued to March 1 , 1989 , at
or about 9 : 00 a.m.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 21st day of
November, A.D. , 1988 .

RE: HEARING TO SHOW CAUSE FOR -REVOCATION OF USE BY SPECIAL REVIEW #713
- MANUEL BALDERAS
A public hearing was conducted on November 21, 1988, at 9:00 A.M. , with
the following present:
Commissioner Gene Brantner, Chairman
Commissioner C.W. Kirby, Pro-Tem
Commissioner Jacqueline Johnson
Commissioner Gordon E. Lacy
Commissioner Frank Yamaguchi
Also present:
Acting Clerk to the Board, Tommie Antuna
Assistant County Attorney, Bruce T. Barker
Planning Department representative, Brian Bingle
The following business Baas transacted:
I hereby certify that pursuant to a notice dated October 19, 1988, and
duly published November 2, 1988, -in the Platteville Herald, a public
hearing was conducted to consider the revocation of Use by Special
Review #713, issued to Manuel Balderas. Bruce Barker, Assistant County
Attorney, -made this matter of record. Brian Bingle, representing the
Department of Planning Services, said this hearing -had been continued
from November 14, to allow Mr. Balderas to meet with the Keenesburg
Town Council concerning the construction of a six—foot privacy fence.
Mr. Single said the Town of Keenesburg did submit a letter on November
15, stating that the Council voted to rescind the requirement for the
privacy fence. Mr. -Bangle said the Planning staff feels Mr. Balderas
is still not in compliance with -Development Standard #2, and it
recommends the following options: 1) that the applicant construct the
six—foot high privacy fence on the east and south property lines, with
the plan for the fence to be reviewed and approved by the Engineering
Department; 2) that the applicant submit an application for an Amended
Use by Special Review; or 3) that the Board revoke Special Review
Permit #713. Manuel Balderas, the applicant, and his wife, came
for-ward to make comments to the Board. Mr. Balderas said he will
submit an application for an Amended Use by Special Review.
Commissioner Johnson moved to continue this matter to March 1, 1989, at
-9:00 A.M. , to allow the applicant time for the submitted application to
be heard by both the Planning Commission and the Board. Seconded by
Commissioner Kirby, the motion carried unanimously.
This Certification was approved on the 23rd day of November, 1988.
