HomeMy WebLinkAbout861015.tiff RESOLUTION RE: APPROVE REQUEST TO CHANGE, ALTER OR MODIFY PREMISES FROM THE EATON COUNTRY CLUB - CLUB LICENSE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS , on the 13th day of October, 1986 , the Eaton County Club submitted a request to change, alter or modify its premises by the addition of 1 , 872 square feet , said request being attached hereto and incorporated by reference, and WHEREAS , on the 29th day of October, 1986 , the local licensing authority, the Weld County Board of County Commissioners approved same and said documents were submitted to the Colorado Department of Revenue, Liquor Enforcement Division, for consideration , and WHEREAS, the Colorado Department of Revenue, Liquor Enforcement Division , has approved said request. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the request of the Eaton County Club to change, alter or modify its premises be, and hereby is, approved. Barker, Assistant County Attorney Subject: Procedure Involved in the Changing, Altering, or Modifying Liquor Licensed Premises --- The changing, altering, or modifying of liquor licensed premises is governed by Regulation 47-106. 2 , C.C.R. The general rule is the following: A. "After issuance of a license, the licensee shall make no physical change, alteration, or modification of the licensed premises which materially or substantially alters the licensed premises or the usage of the licensed premises from the plans and specifications submitted at the time of obtaining the original license without the prior written consent of the local and state licensing authorities. " Physical changes , alterations, or modifications of the licensed premises, or changes in the usage of the premises , which require prior written consent, include, but are not limited to, the following: (1) Any increase or decrease in the total size or capacity of the licensed premises. (2) The sealing off, creation of, or relocation of a common entryway, doorway, passage or other such means of public ingress and/or egress, when such common entry way, doorway, or passage permits access to the licensed premises from or between public streets or thoroughfares , adjacent or abutting buildings, rooms , or premises. (3) Any substantial and material enlargement of a bar, or relocation of a bar, or addition of a separate bar. (4) Any material change in the interior of the premises that would affect the basic character of the premises or the physical structure that existed in the plan on file with the latest prior application. This does not include painting and redecorating of premises; the installation or replacement of electric fixtures or equipment, plumbing, refrigeration, air conditioning or heating fixtures and equipment; the lowering of ceilings; the installation and replacement of floor covering; the replacement of furniture and equipment; and other similar changes. The Board of County Commissioners must decide whether the premises , as changed, altered, or modified , will meet all the "pertinent" requirements of the Colorado Liquor Code and its Regulations. Regulation 47-106. 2 lists certain examples which the Board should consider. Those examples are included in the hearing sheet which is attached to this memo. If the Board denies the licensee the permission to change, alter, or modify the licensed premises , the Board must give notice in writing to the licensee and must state all grounds upon which the application was denied. The licensee is then entitled to a hearing on the denial, if he or she requests the hearing in writing within fifteen (15) days after receiving the notice of denial. Thus, much like a renewal application , the application for change, alteration, or modification of licensed premises first comes before the Board of County Commissioners at its regular meeting, but if the application is denied by the Board , the licensee has the option of asking for a full-blown hearing set at a later date. Barker Assistant County Attorney BTB: rm CHANGING, ALTERING, OR MODIFYING LICENSED PREMISES In making a decision with respect to any proposed changes, alterations, or modifications in the licensed premises, the Board of County Commissioners must consider whether the premises, as changed, altered, or modified, will meet all to the pertinent requirements of the Colorado Liquor Code and the regulations promulgated thereunder. Factors to the taken into account by the Board, include, by way of illustration, but not of limitation, the following: 1. The reasonable requirements of the neighborhood and the desires of the inhabitants. 2. The possession, by the licensee, of the changed premises, by ownership, lease, rental, or other arrangement. 3. Compliance with the applicable Zoning laws as stated in the Weld County Zoning Ordinance. 4. Compliance with the distance prohibition in regard to any public or parochial school or the principle campus of any college, university, or seminary. 5. The legislative declaration that the Colorado Liquor Code is an exercise of the police powers of the State for the protection of the economic and social welfare and health, peace, and morals of the people of the State of Colorado. . •: - Hello
