RESOLUTION
RE APPROVE USE BY SPECIAL REVIEW FOR AN AGRI-BUSINESS, WOOD
MULCH OPERATION - GARY SANDSTEAD
WHEREAS , the Board of County Commissioners of Weld _County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS , the Board of County Commissioners held a public
hearing on the 19th day of August, 1987 , at the hour of 2 : 00 p.-m.
in the Chambers of the Board for the purpose of hearing the
application of Gary Sandstead, 7615 West Ontario, Littleton,
Colorado 80123 , for a Use by Special Review for an a-gri-business,
wood mulch operation, on the following described real estate,
to-wit:
Part of the W} SWI , Section 6 , Township 3
North, Range 66 West of the 6th P.M. , Weld
County, Colorado
WHEREAS, said applicant was present, and
WHEREAS, Section 24 . 4 . 2 of the Weld County Zoning Ordinance
provides standards for review of said Use by Special Review, and
WHEREAS, the Board of County Commissioners heard all of the
testimony and statements of those present, has studied the request
of the applicant and the recommendations of the Weld County
Planning Commission and all of the exhibits and evidence presented
in this matter and, having been fully informed, finds that this
request shall he approved for the following reasons:
1 . The submitted materials are in compliance with the
application requirements of Section 24 . 7 of the Weld
County Zoning Ordinance.
2 . It is the opinion of the Board of County Commissioners
that the applicant has shown compliance with Section
24 . 4 . 2 of the Weld County Zoning Ordinance as follows :
a. The proposed Use by Special. Review is within the
Town of Platteville ' s Urban Growth Boundary Area
and is consistent with the Weld County
Comprehensive Plan as outlined in the Urban Growth
Boundaries Goal and Policies Section. The Urban
Growth Boundary Goals Section directs the
concentration of urban development in or adjacent
to an existing municipality, as well as to maintain

those areas so that an official definition between
future urban and agricultural land uses can be
perceived.
b. Because of the location of the Use by Special
Review being approximately one mile north of
Platteville, and the Town of Platteville ' s
inability to annex this site because of the town' s
lack of a capital improvement plan for those areas
outside the incorporated town, the municipality and
the County shall coordinate plans, policies , and
standards relating to land use , zoning regulations ,
and other closely related matters affecting the
orderly development within the Urban Growth
Boundary Area. In a phone conversation with Bob K.
Thorson, Platteville Town Administrator, on July 2 ,
1987, Mr. Thorson indicated that the Council of
Governments in 1980 projected a future growth of
Platteville equaling 3 , 060 by the year 2000 . This
increase in population would have the incorporated
boundaries at . 5 miles from the Use by Special
Review site. It was further stated that at this
time, Platteville is losing population and the
projection could not be considered relevant. The
proposed site is zoned Agricultural and any future
development of the surrounding area is intended to
remain agricultural in nature and regulated as
agricultural.
c. The Urban Growth Boundary Policies #1 states that
land use development proposals within an Urban
Growth Boundary shall be encouraged so long as they
conform to the desires of the municipality. The
Town of Platteville in its referral dated June 9 ,
1987 , indicated that the proposal is consistent
with the Town' s Comprehensive Plan and would not
conflict with its present or future interests. The
proposal will not cause a significant service
impact or require additional public facilities .
d. The proposed use is consistent with the intent of
the agricultural district and is provided for as a
Use by Special Review. The proposal is that of an
agri-service establishment, wood mulch operation,
to be used by the agricultural industry. The
surrounding area is zoned for agricultural uses .
It is the Board' s opinion that the proposal is
compatible with the future development of the
surrounding area as permitted by the Comprehensive

Plan of the County and the Town of Platteville.
The proposed use will not interfere with the
agricultural activities or other activities related
to agriculture .
e. The proposed use is not located in an overlay
district.
f. The applicant has demonstrated a diligent effort to
conserve productive agricultural land in the
locational decision for the proposed use .
g. The Use by Special Review Development Standards
will provide adequate protection of the health,
safety and welfare of the neighborhood and County.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the application for a
Use by Special Review for an agri-business , wood mulch operation,
on the hereinabove described parcel of land be , and hereby is,
granted subject to the following conditions :
1 . The Use by Special Review plat shall be amended to show
the exterior dimensions for all structures and
dimensions from other structures and lot lines.
2 . Prior to beginning the Use by Special Review activity on
the property, the applicant shall submit to the
Department of Planning Services a plan approved by the
Platteville Fire Protection District showing the
following:
a. An adequate water source capable of -supplying 500
gallons per minute.
b. An automatic fire sprinkler system for all
structures.
3 . The attached Development Standards for the Use by
Special Review Permit being adopted and placed on the
Use by Special Review plat prior to recording the plat.
4 . The Use by Special Review activity shall not occur nor
shall any building or electrical permits be issued on
the property until the Use by Special Review plat has
been delivered to the Department of Planning Services
Office and the plat is ready to be recorded in the
office of the Weld County Clerk and Recorder.

1 . The Use by Special Review permit is for an agri-business
(wood mulch operation) as submitted in the application
materials on file in the Department of Planning Services and
subject to the Development Standards stated herein.
2 . Wood shavings and waste materials shall be handled, stored,
and disposed of in a manner that controls fugitive dust,
blowing debris, and other potential nuisance conditions .
3 . All off-street loading and unloading and parking areas shall
be surfaced with either gravel, asphalt or concrete, and
shall be maintained to alleviate dust and to prevent drainage
problems.
4 . The applicant shall provide and maintain a water source
capable of generating 500 gallons per minute for fire
protection.
5 . All construction on the property shall be in accordance with
the requirements of the Weld County Building Code Ordinance.
6 . The property owner or operator shall be responsible for
complying with the Design Standards of Section 24 . 5 of the
Weld County Zoning Ordinance.
7 . The property owner or operator shall be responsible for
complying with the Operation Standards of Section 24 . 6 of the
Weld County Zoning Ordinance .
8 . Personnel from the Weld County -Health Department, Platteville
Fire Protection District, and the Weld County Department of
Planning Services shall be granted access onto the property
at any reasonable time in order to insure the activities
carried out on the property comply with the Development
Standards stated herein and all applicable Weld County
Regulations.
9 . The Use by Special Review area shall be limited to the plans
shown herein and governed by the foregoing Standards and all
applicable Weld County Regulations . Any material deviations
from the plans or Standards as -shown or stated shall require
the approval of an amendment of the Permit by the Weld County
Planning Commi-ssion and the Board of County Commissioners
before such changes from the plans or Standards are
permitted. Any other changes shall be filed in the office of
the Department of Planning Services.

10 . The property owner or operator shall be responsible for
complying with all of the foregoing Standards. Noncompliance

The following business was transacted:
I hereby _certify that pursuant to a notice dated July 15, 1987, and
duly published August 6, 1987, in the Johnstown Breeze, a public
hearing was conducted to consider a request submitted by Gary Sandstead
for a Use by Special Review for an agri-business, mood mulch operation.
Lee Morrison, Assistant County Attorney, made this matter of -record.
The favorable recommendation of the Planning Commission, -subject to
four Conditions and ten Development Standards, was read into the record
by Keith Schuett, representing the Planning Department. Cary Sandstead
-was present to answer questions of the Board. After discussion, it was
the consensus of the Board to amend Condition #2a to read, "-An adequate
water source capable of supplying 500 gallons per minute." Margaret
McGlothin, adjacent property owner, also spoke concerning the water
source. Commissioner Kirby moved to approve the Use by Special Review
application of Gary Sandstead for an agri-business for a wood mulch
operation, subject to the Conditions and Development Standards. The
motion, seconded -by Commissioner Yamaguchi, carried unanimously.
This Certification was approved on the 24th day of August, 1987.

future growth of Platteville equaling 3,060 by the year 2000.
This increase in population would have the incorporated
boundaries at .5 _miles from of the Use by Special Review
site. It was further stated that at this time, Platteville
is losing population and the projection could not be
considered relevant. The proposed site is zoned agricultural
and any future development of the surrounding area is
intended to remain agricultural in nature and regulated as
agricultural.
- The Urban Growth Boundary Policies #{1 states that land use
development proposals within an urban growth boundary shall
be encouraged so long as they conform to the desires of the
municipality. The Town of Platteville in its _referral dated
June 9, 1987, indicated that the proposal is consistent with
the Town's Comprehensive Plan and would not conflict with its
present or future interests. The proposal will not cause a

and other potential nuisance conditions.
3. All off-street loading and unloading and -parking areas shall be
surfaced with either gravel, asphalt or concrete and shall be
maintained to alleviate dust and to prevent drainage problems.
4. The applicant shall provide and maintain a water source capable of
generating 500 gallons per minute for fire protection.
5. All Construction on the property shall be in accordance with the
requirements of the Weld County Building Code Ordinance.
6. The property owner or operator shall be responsible for complying with

any building within that easement area. The owner or developer shall have the
right to construct and maintain utility lines, streets, sidewalks, and

pipeline and maintain 18 inches clearance from our pipeline. No paved or

The soil where this Special Review permit is proposed is
Prime Farmland according to the Important Farmland Map for
Weld County, Colorado. Soils for buildings have -a moderate
limitation due to low soil strength. This should be con-
sidered along with the proposal.
The land around the buildings should be gravelled or seeded
to grass to protect the area from erosion. Landscaping with
-grass, shrubs and trees would help protect the area from ero-
sion and provide a more pleasing appearance.

The Platteville Fire District has recieved the use by special review
-permit request from Mr. Sandstead and find that as presented it is not in
the best interest of the Fire District.
Based on past experences with wood shaving storage we know this is a
high fire hazard operation, we feel that by moving this type of operation
inside a building they are greatly increasing the difficult in fighting a fire
and the amount of damage that will result in a fire.
If this operating must be moved inside these buildings we asked that the
following requirements be met.
1 . Due to the fact that this building is 1* miles from the nearest source of
water with a flow usable by the Fire Department we ask that a water source
of at least 500 GPM be installed within 500' of the buildings. The water
supply shall have F.D. connections. The proposed fire flow of 15 GPM would
be of no use to the Fire Department.
2. Due to the rapid rate of fire spread and difficulties that the Fire Department
will face in fighting a fire in these buildings we ask that they be equipt
with automatic fire sprinkler systems of a size to contain a fire untill
the Fire Department arrives.
I will gladly work with Mr. Sandstead to supply him with more details
about sprinkler systems and F.D. water sources. We appreciate this chance to
vioce our concerns and hope they will be given full consideration.

Explain proposed use. --We plan to store loose wood shi. v:i ngs in one
building and then bail them up in a bai 1 approximately 40 to 45
_pounds , in another building.
Explain need for use. -People use them to bed livestock , and mulish in
the ground for erosion purposes.
Explain the types of existing USE on surroundi rig
properties. - (Agriculture) To the. north is onions, to the south is
is
potatoes, to the east and west _r_orn.
The distance of the proposed use to residential structures in each
direction. -2,000 feet to the south , =',00C) feet to the east , 1 ,000 feet
to the west and 2,000 feet to the north.
The maximum number of users, patrons, remembers, and buyers. --The maximum
number of users or buyers is hard to say as it changes every time
someone buy or sells livestock , or a feed store opens or closes. We
do not plan on selling directly to the general public as this business
will only be a retail business.
The number of employees, number of shifts, and hours of operation. --We
will have one employee and he will work one shift from the hours of 8
a. m. to 5 p. m. five days a week.
The type of water source for the proposed use. -We will need no water
for the processing of the shaving , but we have a domestic well that is
for the house and have a hydrate located in front of the building for
our employees to use.
Explain the access routes) to be utilized -for the proposed use. -We
will use the county road 25 to U.S. highway 85.
Explain type, size, weight and frequency of vehicular traffic
-associated with the proposed use. -We will have semi -truck-trucks bring
the bulk shavings to us no more than three times a week from different
locations in the mountains. We will use a semi-truck truck to deliver the
bailed shavings in no more than three to four times a week. The total
weight of these trucks loaded is approximately 60,000 pounds.
The type of sewage facilities for the: proposed use. -We plan on having
our employees use the house for any facilities they might need.
A description for the proposed -fire protection measures associated
with the proposed use. -We have an irrigation well located on our
property and plan to put a fire hydrate near the building so we can

help put out a fire, plus have fire extingui=h-ers located around the
building. The well i l l put out 15 gallons D grater per minute. See
Appendix A (copy of a..._i1 permit)
The types and maximum number of animals to be concentrated on the Use
-by Special Review area at any one time. -We will have approximately ten
horses on the property , but are not considered part of the -business.
The type and size of any waste, stockpile or storage area=_ associated
with the prapc'ced use. ---We wi 1 1 have no waste products and we will
store the shavings in ..a building 100 x 140, and store the bailed
shavings in a building 100 x 40.
Type of storm water retention facilities associated with the proposed
use. -The water run of f from any storm will probably be absorbed into
the ground around the buildings, but if the ground will not absorb all
the water there is a ditch that will carry the storm water to G-a sump
pond located on our property.
The t.i me schedule and method of removal and disposal of debris, junk
and other wastes associated with the proposed use. --We will have DFI
Disposal Company carry off all waste on a weekly-basis.
Explain proposed landscaping plans and erosion control measures
associated with the proposed use.--We plan to build the two bsti l di ngs
described above (a building 100 x 140 feet and another building 100 x
40) . The remainder of the property is in crop production.
Reclamation procedures to be employed upon -cessation of the Use by
f3peci al Review activities. -If this company should not make it
financially we can put the ground back to -crop production and use the
buildings for agriculture machine storage.
A time table showing the periods of time required for construction and
start--up of the proposed use.-We plan to start construction right away
-and would like to be finished and start bailing the shavings by the •
first of August.

County Comprehensive Flan. -You should have received a letter from the
Town Hall of Platteville explaining how we fit into this.

of the district in which the use is located. --Yost should have received

explaining this.
If applicable, a statement explaining what efforts have been made, in
the ideation decision for the proposed use, to conserve productive
agricultural land in the acgricultur.al zone district . -Me will use five
acres for the business and have purchased sed a total of 3 acres. We
will also build a house and a barn and raise feed for our livestock
on the rest of the acreage. The majority of the property will remain
agricultural and the business is an agricultural service.
