RESOLUTION RE: DENIAL OF RECORDED EXEMPTION NO. 1098 - BOB BOSLEY, ATTORNEY FOR THE ESTATE OF FRIEDA GAMBLE WHEREAS , the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on July 20 , 1988 , the Board considered a request from Bob Bosley, Attorney for the Estate of Frieda Gamble, for Recorded Exemption #1098 concerning a parcel of land located in part of the NE* of Section 6 , Township 5 North, Range 66 West of the 6th P.M. , Weld County, Colorado, and WHEREAS, the request was to divide the property into parcels estimated to be approximately 11 acres and 9 acres, and WHEREAS, the Board heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Planning staff and considered all of the evidence presented in this matter, and, having been fully informed, finds that this request shall be denied for the following reasons: 1 . The applicant has not demonstrated that an adequate water supply exists for both parcels. 2 . The applicant has not shown that efficient and orderly development would be achieved upon approval of this Recorded Exemption. 3 . The parcel of land on which this request is being made is described as part of the NE} of Section 6, T5N, R66W of the 6th P.M. , Weld County, Colorado. The property is located approximately 0.5 miles northeast of the City of Greeley and west of Weld County Road 27, or 83rd Avenue. The parcel under consideration is the total contiguous land holdings of the applicant. This request is to divide the property into two parcels of 11 acres and 9 acres, more or less. There is an existing residence on the western portion of this property. Based upon the submitted information and the policies of the County, the Department of Planning Services' staff recommends the request be denied for the following reasons: 1. The applicant has not demonstrated that an adequate water supply exist for both parcels. The City of Greeley currently supplies the existing residence, but in the City of Greeley's referral letter dated, July 5, 1988, it was indicated that no new taps for a proposed dwelling could be granted. 2. The applicant has not shown that efficient and orderly development would be achieved upon approval of this recorded exemption. The proposed lot is already one of twelve parcels existing in this quarter section. The City of Greeley, in its referral, indicated that this area is not within the MID range expected service area and if approved, would not be in compliance with the goals used in directing rural development. The City of Greeley's gross density goal of one unit per twenty acres and the 880712 Board of County Commissioners RE-1098 Page 2 County's rural residential policies are designed to direct development to areas where services are already available. These goals and policies are established so that when residential development occurs, the demand for road maintenance, police and fire protection, school bussing, snow removal, utilities, and other urban services are readily available. The total tract involved, consisting of approximately 20 acres , has been owned since 1946 by Frieda Gamble and her husband, both of whom are now deceased. The reason for requesting this recorded exemption is to enable final distribution of the Estate assets among the four heirs in the form cash, rather than undivided interests in real estate, thereby avoiding further conveyances , expense, and perhaps controversy among the heirs ; and at the same time to realize the most benefit from the property for the heirs , while remaining consistent with the Weld County Comprehensive plan. As attorney for the Frieda Gamble Estate, I am assured the sale of two separate lots will realize more for the heirs than would sale of the single tract . In my opinion , this proposal is consistent with the policies of the Weld County Comprehensive plan. The propery is presently zoned agricultural and the two lots could continue to be used for such purpose following division . Lot A, which is approximately the west half, is basically grass and pasture , while proposed Lot B, being the east half , is irrigated cultivated land. 880712 It is proposed that both proposed Lots A and B will be used for residential and agricultural purposes , which would be entirely compatible with existing surrounding land uses . With the existing small tracts in the immediate area , which are presently used as residential and agricultural , it would appear this proposed recorded exemption will be compatible with future development in the area , partilcularly in view of the gradual extension of residential areas to the east of this subject tract . I therefore am of the opinion that this application will not be inconsistent with efficient and orderly development . The sewage disposal for the dwelling and other improvements on proposed Lot A is an existing septic system. Water is furnished to this tract by the City of Greeley and a letter confirming that fact will be furnished to your office at a later date. The subject property is not located in a flood plain , geologic hazard, and/or Weld County Airport overlay district . The further items to be furnished to you to complete this application are: 1) Certification of Conveyances , which will be delivered to you by Stewart Title ; a plat of the property which will be delivered to you by Mr . Jerry MacRae of Greeley; and the City of Greeley letter , mentioned above, concerning water service. If you require something further in connection with this application , please advise me. This site is within the Long Range Expected Growth Area but not within the Mid Range Expected Service Area. Policy dictates no new taps (as would be required for a new dwelling proposed for City of Greeley water ) could be granted for hookup to a transmission line as the source of water . Since that hookup would be the only case in this location , municipal service could not be extended. (In special circumstances, tap requests may be made to the Water Board for special application. ) 2. Gross density would exceed one unit per twenty acres with this proposed recorded exemption. This density standard generally is the limit for rural residential development lacking a full complement of governmental services in the urban growth area. 3. 83rd Avenue is an arterial. 50 feet from centerline (total ) should be dedicated. Comprehensive Plan policy A-4. 8 stipulates individual lot access be limited on arterials , with access only at safest points. An additional lot as a traffic source would not be in conformance with this policy. As well , City of Greeley Subdivision Regulations would prohibit a platting of this nature due to the lack of direct access for the proposed Lot A . The applicant shall submit a mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The plat shall be prepared in accordance with the requirements of Section 9-2 C. (4) of the Weld County Subdivision Regulations. The plat shall be submitted within sixty (60) days from the date of approval by the Department of Planning Services. 2. The recorded exemption plat shall show a minimum thirty foot wide easement for ingress and egress to both parcels. 3. Prior to recording the plat, a copy of two deeds shall be submitted to the Department of Planning Services describing the two parcels, including conveyances of the right to use the 30 foot ingress and egress easement serving both lots. 4. The mylar plat shall be amended to show additional right-of-way reservation totaling 50 feet from the west of centerline of 83rd Avenue. 5. Weld County Septic permit is required for the proposed home septic system and shall be installed according to the Weld County Individual Sewage Disposal Regulations. 6.
