RE: APPROVE ROAD IMPROVEMENT AND MAINTENANCE AGREEMENT WITH
ASSOCIATED NATURAL GAS, INC. , AND AUTHORIZE CHAIRMAN TO SIGN
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home 'zi w
Rule Charter, is vested with the authority of administering the N w
affairs of Weld County, Colorado, and -401

WHEREAS , the Board has been presented with a Road Improvement 7J
and Maintenance Agreement with Associated Natural Gas, Inc. , and
WHEREAS, said Agreement involves increased truck traffic on a w
portion of Weld County Road 123 due to a Use by Special Review z o
Permit issued to Associated Natural Gas , Inc. , and %°

WHEREAS, after study and review, the Board deems it advisable t9w
to approve said Agreement, a copy of which is attached hereto and
incorporated herein by reference. H

NOW, THEREFORE , BE IT RESOLVED by the Board of County z U'
Commissioners of Weld County, Colorado, that the Road Improvement n N
and Maintenance Agreement with Associated Natural Gas, Inc. , be,
and hereby is, approved . H

THIS AGREEMENT, made and entered into this 10th day of November, 1988 by ui Lo

and between the COUNTY OF WELD, STATE OF COLORADO, hereinafter called "County" m
and ASSOCIATED NATURAL GAS, INC. hereinafter called "ANGI". Z n

WHEREAS, ANGI has been issued a Use by Special Review Permit to add a Gas 1<
Plant in NE 1/4 of Section 8, Township 7 North, Range 58 West of the Principal > o

WHEREAS, the Plant will increase truck traffic and nco

WHEREAS, the County Commissioners have requested the improvement of a ma—
portion
of Weld County Road 123. I-3 I,

NOW, THEREFORE, in consideration of mutual covenants and conditions z oi
hereinafter set forth, the County and ANGI mutually agree as follows: n �

1. Accesses onto Weld County Road 123 from the Plant will be limited to n• r
two.

2. Weld County Road 123 shall be improved from the Plant gate to n
Colorado Highway 14. n

3. Improvement shall consist of graveling Weld County Road 123 from Plant o
gate to Colorado Highway 14 with sufficient gravel to maintain that n o
portion traveled by ANGI trucks in good condition. Additionally, when o
average truck traffic by ANGI increases to ten semi-trailers per day, n o
ANGI will pave this section of road with a 4 inch thick by 24 foot e
wide layer of hot bituminous asphalt. n

4. All construction—and materials shall be in accordance with the State o
Department of Highways , Division of Highways, State of Colorado, o• w
Standard Specifications for Road and Bridge Construction.
