RE: APPROVE SITE SPECIFIC DEVELOPMENT PLAN AND P.U.D. PLAN -
FIFTHCOFF COMPANY AND GRANT BROTHERS PARTNERSHIP
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners held a public
meeting on the 1st day of November, 1989, at the hour of 10 :00
a.m. in the Chambers of the Board for the purpose of considering
the Site Specific Development Plan and P.U.D. Plan, First Filing
and Second Filing, submitted by Fifthcoff Company and Grant
Brothers Partnership, c/o Doug Grant, 515 Kimbark Street,
Longmont, Colorado 80501 , and
WHEREAS, said Site Specific Development Plan and P.U.D. Plan,
First Filing and Second Filing, concerns the following described
real estate, to-wit:
Part of the NW} of Section 11 , Township 2
North, Range 68 West of the 6th P.M. , Weld
County, Colorado
WHEREAS, said applicant was represented by Donald Slack, of
Slack Ellerman Architects, and
WHEREAS, the Board heard all of the testimony and statements
of those present, has studied the request of the applicant and the
recommendations of the Weld County Planning Commission and all of
the exhibits and evidence presented in the matter and, having been
fully informed, finds that this request shall be approved for the
following reasons:
1 . The submitted materials are in compliance with the
application requirements of Section 28 . 9 of the Weld
County Zoning Ordinance.
2 . The Planned Unit Development (PUD) Plan application is
in conformance with Section 28 . 14 of the Weld County
Zoning Ordinance as follows:

a. The proposal is consistent with the Weld County
Comprehensive Plan. The PUD Plan is located within
the I-25 Mixed-Use Development Area. The uses
proposed for the PUD Plan are consistent with the
uses described in the 1-25 Mixed-Use Development
Area and Activity Centers Section of the
Comprehensive Plan;
b. The PUD Plan conforms to the PUD District. The
Utility Coordinating Advisory Committee reviewed
and approved the utility plan map at its September
14 meeting;
c. The application materials demonstrate that the uses
allowed under the proposed PUD Plan will be
compatible with existing and future development as
projected by the plans of affected municipalities;
d. The PUD Plan will conform with the performance
standards outlined in Section 35 .3; and
e. The PUD Plan is not located in an overlay district
area.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the application of
Fifthcoff Company and Grant Brothers Partnership for a Site
Specific Development Plan and P.U.D. Plan, First Filing and Second
Filing, on the above referenced parcel of land be, and hereby is,
granted subject to the following conditions:
1 . Prior to recording the PUD Plan plat, the applicant
shall:
a . Submit an original Subdivision Improvement
-Agreement and four copies to the Department of
Planning Services. The agreement shall also
address improvements to the east I-25 Frontage Road
required by the Colorado Division of Highways. The
agreement shall be approved by the Board of County
Commissioners and collateral shall be posted by the
owner or applicant.
b. Submit evidence that a Law Enforcement Authority
has been formed according to State law. The Law
Enforcement Authority to be formed shall be capable
of expanding to serve other areas within the 1-25

Mixed Use Development Area to avoid duplication of
overhead and other operating costs;
c. Amend the PUD Plan application materials to comply
with the general sign and identification sign
requirements in the Weld County Zoning Ordinance;
d. Amend the PUD Plan landscape plat to show that
adequate sight distance on the east I-25 Frontage
Road will be protected. The landscape plat shall
be approved by a representative of the Colorado
Division of Highways; and
e. Submit evidence to the Colorado Division of
Highways and Department of Planning Services that
the area for the future frontage road within the
PUD District has been dedicated to the Colorado
Division of Highways .
f. Amend the PUD Plan plat to show:
i. A design for ingress and egress from the east
I-25 Frontage Road. All access points shall
comply with the October 13, 1989 , letter
signed by Mr. Wallace R. Jacobson,
representative for the Colorado Division of
Highways;
ii. A 15 foot perimeter utility easement around
Filings 1 and 2;
iii. As a minimum, the parking space requirement of
1 space per 200 square feet of gross floor
area plus an adequate area for tour bus
parking;
iv. The location of mall identification signs; and
v. Dedication of additional rights-of-way, if
needed, to allow for turn lane construction on
the east I-25 Frontage Road.
2 . The following notes shall be placed on the PUD Plan
plat:

a. The use permitted in this PUD Plan shall be a
retail shopping mall as described in the
application materials and as permitted by Case
Number Z-447 on file with the Clerk to the Board of
County Commissioners;
b. Prior to issuing building permits, approval of a
site plan review on each lot is required in
accordance with Section 33 . 4.5 of the Weld County
Zoning Ordinance. The site plan review shall
comply with the PUD Plan and PUD District
application materials on file with the Clerk to the
Board of County Commissioners;
c. Prior to issuing building permits for construction
of the second filing, the future frontage road
shall be constructed by the owners of the Ni of
Section 11 , T2N, R68W of the 6th P.M. , Weld County,
Colorado, and/or via a local improvement district.
The Colorado Division of Highways shall verify that
the road has been constructed and approved;
d. Prior to approval of a site plan review, the
applicant shall amend the drainage and grading plan
application materials to meet the PUD Plan
requirements of Section 28. 11 .6 through 28. 11 . 14 of
the Weld County Zoning Ordinance. The amended plan
shall also address note #8 of Case Z-447 . The
amended plan shall comply with the Weld County
Subdivision Storm Drainage Regulations listed in
Section 8-11 and receive approval from the County
Engineer;
e. Prior to approval of a site plan review, the
applicant shall submit a road improvements master
plan in accordance with Note 6 of Case Z-447;
f. The Commercial Zone District Performance Standards
and supplementary regulations as listed in the Weld
County Zoning Ordinance shall be complied with;
g. A Subdivision Improvements Agreement shall be
approved by the Board of County Commissioners for
the second filing prior to approving its site plan
review; and

h. The requirements of the Longmont Rural Fire
Protection District and Weld County Sheriff ' s
Department shall be met; and
i. The shopping mall shall be allowed two free
standing identification signs unless a variance is
-granted by the Board of Adjustment for additional
identification signs.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 1st day of
November, A.D. , 1989 .

A public hearing was conducted on November 1, 1989, at 10:00 A.M. , with
the following present:
Commissioner C.W. Kirby, Chairman - Excused
Commissioner Gene R. Brantner, Pro-Tem
Commissioner Constance L. Harbert
Commissioner George Kennedy
Commissioner Gordon E. Lacy
Also present:
Acting Clerk to the Board, Mary Reiff
Assistant County Attorney, Lee D. Morrison
Planning Department representative, Rod Allison
The following business was transacted:
I hereby certify that pursuant to a notice dated August 23, 1989, and
duly published August 31, 1989, in The New News, a public hearing was
conducted to consider a Site Specific Development Plan and P.U.D. Plan,
First and Second Filing, for Fifthcoff Company and Grant Brothers
Partnership. Lee Morrison, Assistant County Attorney, made this matter
of record. He noted that this hearing was continued to this date from
October 4. Chairman Pro-Tem Brantner advised all present that three
affirmative votes are necessary for approval of this request and, if a
tie vote should result, the absent Commissioner would review the record
and listen to the tape of this hearing prior to casting the deciding
vote. Rod Allison, Planning Department representative, entered the
favorable recommendation of the Planning Commission into the record of
this hearing. He stated that the Planning staff recommends two minor
changes to the Conditions recommended by the Planning Commission, and
he made said changes of record. Donald Slack came forward to represent
the applicants. He explained that this area is to be developed into
factory outlet shops. Mr. Slack said there has been considerable
discussion with the Highway Department concerning the development of
this area in two phases. They have agreed that the necessary
realignment of the I-25 Frontage Road may be delayed until the second
development phase. Wally Jacobson, of the State Highway Department,
said that their letter of October 13, 1989, summarizes the main issues,
and that the realignment of the frontage road should be completed prior
to any development beyond the First Filing. During the discussion
about the I-25 Frontage Road, Wally Grant, one of the property owners,
and Jennifer Rodriguez, of Rocky Mountain Consultants, presented
information. Commissioner Lacy moved to approve this request, subject
to the Conditions proposed by the Planning Commission and amended as
recommended by the Planning staff. Commissioner Harbert seconded the
motion. Mr. Allison reminded the Board that these Conditions call for
the realignment of the Frontage Road prior to the issuance of building
permits for the Second Filing. Mr. Allison also asked if a request to
change this time schedule would be considered as a minor change to be
handled by the staff or if it would require consideration by the Board.
It was the consensus of the Board that this would be resolved at the
time such a request is received. The motion to approve the Site
Specific Development Plan and P.U.D. Plan, First and Second Filing,
carried unanimously.

MOTION:
Jerry Kiefer moved the request of Left Hand Water Association for
organization of a service plan as amended by the Planning Commission be
forwarded to the Board of County Commissioners with the Planning
Commission's recommendation for approval based upon the recommendation of
the Department of Planning Services' staff and the testimony heard by the
Planning Commission. Motion seconded by Judy Yamaguchi.
The Chairman called for discussion from the members of the Planning
Commission. Discussion followed.
The Chairman asked the secretary to poll the members of the Planning
Commission for their decision. Jerry Kiefer - yes; Bud Clemons - abstain;
Rick Iverson - yes; Judy Yamaguchi - yes; Ernie Ross - yes. Motion carried
with four voting for the motion and one abstaining.

David Faestel, Arrowstone Development, and Donald Slack, Architect and
Planner. David Faestel stated he understands there are problems with the
highway department, but would like to present the project and seek direction
from the Planning Commission. They would continue this request, if
necessary, to enable the applicant to work out an agreement regarding access
with the Colorado Department of Highways.

Planning Commission then make a recommendation to the Board of County

Stephen Janssen, Attorney, Boulder, Colorado, represented DCS Construction,
Inc. The applicants have reviewed the recommendation, conditions, and
Development Standards prepared by the Department of Planning Services'
staff. They are in concurrence with these. They have also reviewed the
screening requirement and will comply with these. They have met with the
surrounding property owners and there has been no opposition to their plan.
Larry Addison, Panhandle Eastern Pipeline Company, stated they --are not
against this proposal, but they do have a gasline running through the
property. Prior to any beginning any construction, they would appreciate
being notified so they can review the location of any proposed structures.

Appearance, Donald Slack, Architect and Planner, stated testimony was taken
at the September 19, 1989, Planning Commission meeting. Items still needing
to be completed for the Factory Outlet tenter at that time were State
Highway Department recommendations on the frontage road,and alignment and
access points into the property. They have met with the Highway Department
and they have agreed -with their plan. The staff has a letter from them
pertaining to this agreement. He has reviewed the staff's recommendation
and they do not have any real problem with it with -the exception of
paragraph 4 on the second page. He would like to see this paragraph changed
from prior to issuing building permits to prior to issuing a certificate of
occupancy so they can do construction on the road at the same time they are
constructing the building. Their agreement with the Highway Department _
allows this to be done. - -
Rod Allison _recommended this condition not be changed unless it was approved
by the Highway Department. He explained he would phone the Higway
Department for its recommended action. The applicant can present this
proposal at their hearing with the Board of County Commissioners and it can
be changed at that time if the Board so desires.

These determinations are based, in part, upon a review of the information
submitted by the applicant, other relevant information regarding this
request, and responses of referral entities reviewing the request. The
Planning Commission's recommendation for approval is conditional upon the
following:
1. Prior to recording the Planned Unit Development plan plat, the
applicant shall:
- Submit an original subdivision improvement agreement and four
copies to the Department of Planning Services. The agreement
shall also address improvements to the east 1-25 Frontage
Road required by the Colorado Division of Highways. The
agreement shall be approved by the Board of County
Commissioners.
- Submit evidence that a law enforcement authority has been
formed according to state law. The law enforcement authority
to be formed shall be capable of expanding to serve other
areas within the 1-25 Mixed Use Development area to avoid
duplication of overhead and other operating costs;
- Amend the PUD plan application materials to comply with the
general sign and identification sign requirements in the Weld
County Zoning Ordinance;
- Amend the PUD plan landscape plat to show that adequate sight
distance on the east I-25 Frontage Road will be protected.
The landscape plat shall be approved by a representative of
the Colorado Division of Highways; and
- Submit evidence to the Colorado Division of Highways and
Department of Planning Services that the area for the future
frontage road within the PUD district has been dedicated to
the Colorado Division of Highways.
- Amend the PUD plan plat to show:
- A design for ingress and egress from the east I-25
Frontage Road. All access points shall comply with the
October 13, 1989, letter signed by Mr. Wallace R.
Jacobson, representative for the Colorado Division of
Highways;
- A 15 foot perimeter utility easement around Filings 1
and 2;

- As a minimum, the parking space requirement of 1 space
per 200 square feet of gross floor area plus an adequate
area for tour bus parking;
- The location of mall identification signs; and
- Dedication of additional rights-of-way, if needed, to
allow for turn lane construction on the East I-25
Frontage Road.
2. The following notes shall be placed on the PUD plan plat:
- The use permitted in this PUD plan shall be a retail shopping
mall as described in the application materials and as
permitted by Case Number Z-447 on file with the Clerk to the
Board of County Commissioners;
- -Prior to issuing building permits, approval of a site plan
-review on each lot As required in accordance with Section
33.4.5 of the Weld County Zoning Ordinance. The site plan
review shall comply with the PUD plan and PUD district
application materials on file with the Clerk to the Board of
County Commissioners;
- -Prior to issuing building permits for construction of the
second filing, the future frontage road shall be constructed
by the owners of the Ni of Section 11, T2N, R68W of the 6th
Y.M. , Weld County, Colorado, and/or via a local improvement
district. The Colorado Division of Highway shall verify that
the road has been constructed and approved;
- Prior to approval of a site plan review, the applicant shall
amend the drainage and grading plan application materials to
meet the P.U.D. plan requirements of Section 28.11.6 through
28.11 .14 of the Weld County Zoning Ordinance. The amended
plan shall also address note #F8 of Case Z-447. The amended
plan shall comply with the Weld County Subdivision Storm
Drainage regulations listed in Section 8-11 and receive
approval from the County Engineer;
- Prior to approval of a site plan review, the applicant shall
submit a road . improvements master plan in accordance with
Note 6 of Case 2-447;

meeting. The applicants were asked to meet with =epreaentatives of the

The applicants have submitted additional information and two revised maps
addressing these concerns.

I have reviewed the letter of September 18, 1989 by Kurt Rollin of -Rocky
Mountain Consultants, Inc. Mr. Rollin's letter addresses the concepts of
a master drainage plan, but still does not provide specific engineering
information. The attached master drainage plan has a note pointing to the
100-year floodplain limits that states, "As this site is developed in the
future, a letter of map amendment will be 'obtained to revise the 100-year
floodplain limits." That does not address the intent _of a planned-unit
development, or the requirements of Section 8-11, "Storm mrainage and
Flood Plans", of the Weld County _Subdivision Regulations.
Because of the PUD concept, I understand that certain assumptions about
how the site is to develop, gill -lave to be made. However, the hydrology
and hydraulic information, along with concepts and details of how -runoff
is to be handled, most te supplied. A good example of how conceptual
master planning tan to completed, is the traffic analysis work that has
been provided by Felsburg, -Holt and Ullevig, for this site. I can
understand how the applicant may te -reluctant to delve into further
detail, while -there are other major issues that remain to be resolved with
this first site application. Therefore, I think it would be appropriate
to postpone additional -detailed information until the site plan review
stage. This would to consistent with Item No. 4 of Mr. Rollin's letter.
I am sure there will -need to to further discussion between -Mr. Rollin and
me regarding the engineering aspects of further submittals.
Please note no information for the master road improvements Tlan has been
submitted. This could be handled in the same light as the master drainage
plan.

Dear Rod:
Enclosed please find twenty copies of the revised PUD Plan for
the referenced project. Changes to note:
1) Access points by number and location.
2) Incorporation of realigned frontage road into plan.
3) Incorporation of internal circulation road South of
site into Plan.
The Highway Department has indicated that they will allow Filing
#1 to proceed without the construction of the realigned frontage
road . Walley Grant is still working with them on the details
regarding when and how it will be completed . We have revised
the number and location of access points to comply with the
access code for the design speed of 45 mph which has also bean
accepted by them. We assume, but have no confirmation as yet
that this plan will be acceptable to them. Also , we have indicated
to them that the accel lane they asked about is not necessary.
We are awaiting their response to that point as well .
We should be able to reach an agreement with them by this Friday,
October 13th, on these issues. Clearly as we view these points ,
we believe we have compromised sufficiently to allow them to
accept the revised proposal as is. We have indicated to them
that we cannot have any less access than shown to sustain this
project, so it will be our intent to ask the County to approve
this configuration.

Dear Mr. Slack:
Following our meeting this morning, it is our understanding
that you will be revising the proposed site plan on the above
referenced project to reflect the following access plan:
o Two accesses to serve delivery trucks only. One access
would be on the north end of the site, while the other
would be at the south end. If the internal road for the
overall P.U.D. is to be located adjacent to the south
boundary of the factory stores site, the southern truck
access would then be designed off the internal road
instead of directly accessing the frontage road.
o Two accesses serving the general public. These two
accesses would be the middle two accesses shown on your
previously proposed plan.
Thus, the two primary accesses would be separated by approxi-
mately 350 feet and the distance between these accesses and
the service accesses would be about 41O feet.
The effect of this proposed reduction in the number of access-
es would be to concentrate the traffic, resulting in higher
volumes at each access. Based on the projected traffic vol-
umes illustrated on Figures 5 and 6 of the previous traffic
study, the following table summarizes the approximate peak
hour volumes which would be expected at each of the two public
access-es under the revised access plan.

A review of these volumes suggests the following regarding the
need for additional turn lanes on the frontage road:
o The need for the continuous left turn lane to accommodate
the vehicles turning into the site from the north remains
important.
o Even with the reduced number of accesses, the traffic
volumes expected to come to the site from the south on
the frontage road are very low. Based on these volumes,
right turn deceleration lanes would not be justified
(Access Code Section 4 .7 . 2) .
o According to Section 4 .7 . 3 of the Access Code, right turn
acceleration lanes from the accesses would be warranted.
However, our experience indicates that acceleration lanes
at such accesses are seldom used properly (if at all) .
This is particularly true on roadways with operating
speeds of 40 MPH or less. Because of this experience and
because the through volumes on the frontage road are
relatively low, we believe that the value of acceleration
lanes at these accesses is questionable.

Dear Rod:
In response to the issues raised by the State Highway Department and the
Weld County Engineering Department concerning the Mountain View Factory Stores
final PUD application, the applicant has met with representatives of the State
Highway Department. The following items have been mutually agreed upon in
order to proceed:
1 . The frontage road realignment will be reserved or dedicated at the
option of the State Highway Department upon approval of the Final
PUD. A revised Utility Plan Map and Site Plan identifying the
location of the relocated frontage road are attached.
2. Based upon the location of the relocated frontage road, which
utilizes a 45 mph design speed, a revised proposal for access to
the Mountain View Factory Stores has been submitted to the State
Highway Department. The revised access points are also identified
on the attached Utility Plan Map and Site Plan. Please note that
the Mountain View Factory Stores site has been moved 20 feet to
the south in order to minimize the impact of the frontage road
realignment on the site de-sign. The Final Plat Map for the site
will reflect this change.
3. The relocated frontage road will be constructed when the State
Highway Department determines it is needed based upon a subsequent
Traffic Analysis Addendum.
4. The cost of constructing the relocated frontage road will be borne
by the owners of the N 1/2 of Section 11, via a Local Improvement
District comprising the N 1/2 of Section 11 or a part thereof.

5. The improvements required in order to accommodate the Mountain
View Factory Stores 1st Phase will be as specified in the Traffic
Analysis Addendum, Mountain View Factory Stores, prepared by
Felsburg, Holt & Ullevig, August, 1989. (See attached road
improvement cross sections) .
In addition to addressing the comments received form the State Highway
Department, the applicant has contacted Mr. Drew Scheltinga, County Engineer,
regarding his comments. Please find attached a copy of correspondence
from Mr. Kurt Rollin, RMC, addressing those issues and a subsequent letter
from Mr. Scheltinga indicating his concerns have been resolved with respect
to the current Final PUD application. In a subsequent conversation with
Drew, he indicated the ROW width for the internal road system would need
to be either 60' or 80' depending upon the road configuration and class-
ification. This will be determined as further site designing for the overall
PUD District is completed.
It has been our intent to resolve these issues in order to proceed with
review of the proposal by the Weld County Planning Commission at their
October 17, 1989 meeting. Please contact me if you have any questions. Thank

We have just revi-ewed your comments on the -Drainage 2lan submitted for
the Mountain View Factory Stores site in the Crossroads at Del Camino P.U.D.
These comments were contained in a memorandum from you to Mr. Rod Allison im
the Weld _County Planning Department dated September 11, 1989.
We would like to submit the following reply to the comments for your
review:
1. The originally submitted drainage plan that was labeled as
"Mountain View Factory Stores, -Grading and -Drainage Plan" was
intended to also serve as a Master Drainage Plan for the
Crossroads at Del Camino site. -Since details as to the long range
plans for the development of the Crossroads site -are not complete,
the revised Master Drainage Plan will show our proposed temporary
solutions to the drainage detention.
2. The proposed storm runoff -detention ponds to be located in the
greenbelt area east of this project are to be reclaimed gravel
mines that will be constructed in the future. To provide
temporary detention storage for the 5 year historic release rate
required by the County, a temporary detention pond will be
constructed on the Crossroads site in the corner where the
existing west edge of the 100 year floodplain limit crosses Road
24. This pond would be sized to detain runoff from Crossroads
site west of the floodplain and release it into Godding Hollow at
the 5 year historic runoff rate. This temporary pond will be
removed once the permanent detention ponds are constructed.

3. To help minimize the size of a internal storm sewer system for the
Crossroads site, each individual site will be required to provide
on-site detention storage for the 100 year storm runoff. The
runoff from these ponds will be released into the large detention
ponds tote located in the greenbelt area along Godding Hollow.
4. A more detailed _grading and drainage plan for the Mountain View
Factory site will de provided at the time of the final site plan
submittal . Details on the sizing and release structure for the
temporary detention pond will also be provided -at this time.
5. The temporary waste ditch that will be used to tarry the runoff
from the Mountain View Factory stores site to the temporary
detention pond will be located completely within the Crossroads at
Del 'Camino P.U.D. and therefore no off-site landowners will be
affected by the sheet flow from the site.
-A copy of the revised Master Drainage Plan shall be included with this
letter for your review. If you have any questions or comments, please feel
free to contact me.

I have reviewed the letter of September 18, 1089 by Kurt Rollin of Rocky
Mountain Consultants, Inc. Mr. -Rollin's letter addresses the concepts of
a master drainage plan, but still does not provide specific engineering
information. The attached -master drainage plan has a note pointing to the
100-year floodplain limits that states, 'its this site is -developed in the
future, a letter of 'map amendment will be obtained to -revise the 100-year
floodplain limits." That -does not address the intent of a planned-unit
development, -or the requirements of Section 8-11, "Storm Drainage and
Flood plans", of the Wel-d County Subdivision Regulations.
Because of the PUD concept, I understand that certain assumptions about
how the site is to -develop, will have to be made. However, the hydrology
and hydraulic information, along with concepts and details of how runoff
is to he handled, must be supplied. A good example of how conceptual
master planning can be completed, is the traffic analysis work that has
been provided 'by Felsburg, Holt and Ullevig, for this site. I can
understand how the applicant may be reluctant to delve into further
detail, while there are other major issues that remain to be resolved with
this first site application. Therefore, I think it would be appropriate
to postpone additional detailed information until the site plan review
stage. This would be consistent with Item No. 4 of Mr. Rollin's letter.
I am sure there will teed to be further discussion 'between Mr. -Rollin and
me regarding the engineering aspects of further submittals.
Please note no information for the master road improvements plan has been
submitted. This could be handled in the same light as the master drainage
plan.

PUD DESIGN OBJECTIVES :
The plan of the PUD is designed to provide a marketplaceeicretdi!i•it' ,0assweS'j
environment , to allow easy visual and directional access , and
to provide a safe and pleasant mix of automobile and pedestrian
traffic at this destination oriented site .
The architecture of the PUD is desi-fined to provide a quality
mixed-use retail environment, and as such, incorporates a variety
of architectural styles and details to achieve a pleasant pedestrian
environment within the factory shops . The observation tower
is intended to not only serve as a focal point to draw visitors
into the site , but to provide an important amenity that renders
spectacular views of Longmont and the Rocky Mountains . The
height of the tower is expected to be up to 75 ' to take full
advantage of its potential as a strong visual amenity to the
project and the area. It is fully integrated into the architectural
style of the center and it is for these reasons that allowing
it to be 75 ' should be considered a minor or technical change
to the PUD ' s 50 ' height limitation . In other words , this is
not a change in the allowable building height per say , but a
minor change to allow the tower as a project focal point -and
feature.
Major materials will be of brick , block , stucco, and decorative
metal . Colorful accents will be provided by signage , canvas
awnings , flags/banners, and landscaping . The predominant colors
of the center will be balanced between warm and cool colors
in order to provide a pleasing variety of architectural environments .
SIGNAGE -PROPOSAL
PROJECT/JOINT TENANT SIGN:
One major project sign is anticipated . In order to take advantage
of the highway frontage ( the reason the tenants are here at
all ) , while preserving a sign type that is a positive visual
addition to the project, we are proposing a sign that contains
the Shopping Center identification as well as an electronic
reader board that allows tenant identification, sales information ,
specials , arid the like to be displayed at intervals ratter than
the clutter of too much information in one place at one time .
We propose this sign to be no greater than 35 ' in height or
400 square feet in area, per side , and two sided . The specific
design of the sign will be worke-d out with Site Plan approval .
WALL SIGNAGE: Per PUD Zone Ordinance
Directional/Informational Signage: As required to insure smooth ,
safe , convenient traffic and pedestrian flow.

The proposed location is compatible with other possible uses
within the PUD District due to its focus on and to Interstate
25 . This focus allows future development to occur without conflicts
or negative impacts. It is anticipated that the rear of surrounding
building sites will back to the rear of this development thereby
minimizing service area impacts to the District as a whole .
Access to the site will be from the highway frontage road , widened
along the developed frontage to 40 ' of pavement width . This
will allow for through traffic to continue along the property
unobstructed while allowing turns into the project to occur
within a center designated turn lane .

Mountain View Factory Stores , one large strip shopping center ,
to be built in two filings , will be operated as a specialty
retail center featuring retail operations owned and operated ,
for the most part , by nationally recognized manufacturers of
name brand merchandise . Items such as shoes , clothing , toys ,
household goods and luggage , as well as other items will be
sold by the estimated 30 stores .
In addition to retailers, space may be occupied by food establish-
ments as well as a visitor information center and public areas
including a bus driver ' s lounge .
Stores are expected to have average sales of $200 . 00 per square
foot per year .
It is anticipated that the 30 stores would each have a full
time store manager and assistant manager , plus numerous full
and/or part time sales or stock personnel .
Mountain View Factory Stores will support from 300-400 jobs
when both filings are completed .
Hours of operation may be from as early as 8 : 00 a.m. daily to
10 : 00 p.m. . Stock personnel or management would of course arrive
earlier and/or leave later .
Restaurants may choose to have extended hours . If a sit down
restaurant would occupy the center , it might want a 24 hour
operation.
As a separate structure the developer is considering constructing
a photo observation tower where tourists and locals may take
photos , or simply admire the views of the twin peaks area of
the front range.
Parking ratios shall be designed at more than 6 cars per 1 , 000
square foot of retail area, as filed .
A service drive will be provided around the perimeter of the
project to keep large vehicles out of the pedestrian area .

Mountain View Factory Stores has a 6 ' wide landscape strip planned
around the perimeter of the project at the loading areas to
insure proper buffering of that area . The street edge landscape
strip is 20 ' wide to provide for a smooth visual transition
from street to parking lot .

No public open space is intended . Private open space will be
in two forms. 1) Passive landscaped areas either at the perimeter
or within the parking area of the project and 2) Active sidewalk
areas along the store fronts to create a shopping "street" which
will be designed to enhance the shopping experience .

Since all open space is private , it will be owned and maintained
by the Developer or his successors and/or assigns.

We expect to develop the project in two filings , essentially
one half at a time , beginning with the North half . We will

Mountain View Factory Stores shall be financed as two separate
issues involving possibly more than two financial vehicles.
One issue is on site improvements . The other is off site improve-
ments . — —
On site improvements will be financed via a construction loan
through a local area bank. Permanent financing will be provided
by an insurance company .
Off site improvements may be financed through joint efforts
of the state highway commission, and a newly formed municipality
or the developer via formation a special improvement district .
All utilities except sewer are to the site , therefore , the major
consideration for off site improvements deals with improvements
to the existing frontage road adjacent to filing one of Mountain
View Factory Stores . Sewer will be executed to the site from
existing lines as a Seller cost .
Storm detention is being provided by the developer of Crossroads
Business Park in a dedicated green belt area East of the project.
Storm water will be transferred to the detention area via closed
pipe and an open ditch.

I am writing in connection with the Crossroads PUD application recently submitted
by Donald R. Slack of Slack Ellermann Architects, P.C. on behalf of Arrowstone
Development Corporation. There are three matters which I wanted to address.
1 . Law enforcement authority. As required by the PUD rezoning, we will be
submitting a request to the Weld County Commissioners to establish a Law Enforcement
Authority pursuant to the Law Enforcement Authority Act of 1969 (C.R.S. 30-11-401 ,
et. seq. ) . Our request will be to establish the Law Enforcement Authority to include
at least the northwest quarter of Section 11, Township 2 North, Range 68 West of the
6th P.M. and such other property as the County Commissioners and we agree upon.
Grant Brothers supports the creation of the Authority and will do everything which
we are able to do to assure its creation.
2. Road Improvements. A traffic analysis addendum to the Traffic Impact Study
submitted by Felsburg, Holt and Ullevig (October 1988) was submitted with the PUD
application. Arrowstone Development Corporation will be responsible for any frontage
road improvements adjacent to its site and Grant Brothers and Arrowstone will be
responsible for the financing and construction of other improvements which may be
required by the Arrowstone Project and agreed upon with the County and State Highway
Departments.
3. Weed Control . The portion of the Crossroads at Del Camino PUD not included
in the recent PUD submittal will continue to be farmed. All weeds will be
controlled, as they have been in the past, both in the fields and along roads and
ditches.

2. If the proposed Insured has or acquires actual knowledge of any defect, lien, encumbrance, adverse claim or other matter

Re: Drainage Plan and Calculations - Mountain View Factory Stores
Dear Rod:
As part of the Final P.U.D. submittal for Mountain View Factory Stores, we
have provided a grading and drainage plan, and calculations for the site.
Three (3) copies of this plan have been submitted for your review.
The 100 and 10 year storm runoff quantities were calculated using the Rational
Method (Q=CIA) . Values for the Runoff Coefficients (C) and Rainfall
Intensities (I ) were taken from charts provided by the Boulder County Storm
Drainage Criteria Manual . A copy of these charts are provided to you with the
site drainage calculations.
Detention storage for the site was calculated using the Equation Detention
Method as developed by the Urban Drainage and Flood Control District. A copy
of the explanation of this method is also provided as part of the drainage
calculations.
The runoff released from the detention ponds on the site will be carried by an
on-site storm sewer system that will release into a temporary waste ditch that
will carry runoff through the rest of the Crossroads - Del Camino site to
Godding Hollow Ditch. Due to grading constraints, this ditch will carry
approximately 40 percent of the 100 year release flow from the site. Any
overflow from the ditch will naturally sheet flow across the Crossroads - Del
Camino site to Godding Hollow Ditch.
