RE: APPROVE ROAD IMPROVEMENTS AND MAINTENANCE AGREEMENT WITH DEL
CAMINO CENTER PARTNERSHIP AND AUTHORIZE CHAIRMAN TO SIGN
WHEREAS , the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with a Road
Improvements and Maintenance Agreement between Weld County and Del
Camino Center Partnership, and
WHEREAS, the terms and conditions are as stated in said
Agreement, a copy of which is attached hereto and incorporated
herein by reference, and
WHEREAS, after review, the Board deems it advisable to
approve said Agreement.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the Road Improvements
and Maintenance Agreement between Weld County and Del Camino
Center Partnership be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chairman be, and
hereby is, authorized to sign said Agreement.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 31st day of
July, A.D. , 1989.

WHEREAS, DCCP has applied to the County for a PUD Plan, Case No. 5-300, for
an industrial park development located in the W1 of the NWT, Section 14, m (+
T2N, R68W of the 6th P.M. , Weld County, Colorado and < O

WHEREAS, the development will increase traffic on County Road 22, and z m

WHEREAS, the County Commissioners have requested the paving of a portion tr, 0n
of Weld County Road 22, tCr J

NOW, THEREFORE, in consideration of the mutual convenants and conditions H
hereinafter set forth, the Counth and DCCP mutually agree as follows: i-i o

A. To execute an agreement pursuant to the Weld County Policy Regarding f co
Collateral for Improvements prior to the initiation of any development
activiites in the Del Camino Center PUD which shall include provisions x F
as follows:
1. Access onto Weld County Road 22 from the property shall be limited x w
to three, two of which may be shared accesses.
2. DCCP agrees to pay 37% of the total improvement costs for Weld County b
Road 22. The total improvement costs are currently estimated to be M0
$51,000 by the County. DCCP's share of the improvements is based Z0
upon a projected traffic count of 38.3 trips/acre on the property t`' o
adjacent to Weld County Road 22. O

3. Weld County Road 22 shall be improved from DCCP's east property line O
west to the existing pavement at the intersection of Weld County o
Road 22 and the I-25 frontage road. The improvements shall consist p o
to
of a 3 inch thick by 24 foot wide hot bituminous asphault with (2)
6 foot wide shoulders. The base course shall be 10 inches thick
and shall be Highway Class 6 aggregate.
4. DCCP, through the paving contractor yet to be named, will warranty
and maintain the improved portion of Weld County Road 22 for a period
of one year, after Such time the County shall be responsible for
maintenance.
5. All construction and materials shall be in accordance with
the State Department of Highways, Division of Highways, State
of Colorado, Standard Specifications for Road and Bridge
Construction, latest edition.

6. The County will provide testing and inspection for the o N

7. No lots shall be platted or sold that access Weld County Road
22 until such time that the above mentioned portion of Weld X) n

B. DCCP agrees to participate in a Local Improvement District pursuant Z o
to CRS 530-20-601 et seq. in the event one is established to fund ht tn
the improvements to Weld County Road 22 provided that the projected m' "'
assessment is equal to or less than the estimated cost of improve- m J
rnents in Paragraph A. In the event a Local Improvement District is o o
established, DCCP shall not be required to enter into the agreement H co
set forth in Paragraph A. DCCP shall agree to pay whatever amount HO
is assessed according to the benefit to the z J
property by the Local
Improvement District which is currently estimated at $18,870.00 r` o'
