RE: APPROVAL OF RECORDED EXEMPTION NO. 737 - BOB AND DOROTHY
WEIDENKELLER
WHEREAS , the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS , the Board of County Commissioners , pursuant to its
authority under Section 30-28-101 (10) (d) , CRS , as amended , did
determine at a public meeting held in the Chambers of the Board,
that a certain parcel of land, to be divided into two parcels , as
shown on the plat known as Recorded Exemption No. 737 , does not
come within the purview of the definition of the terms ,
"subdivision" and "subdivided land" , and
WHEREAS , the request for Recorded Exemption No. 737 was
submitted by Bob and Dorothy Weidenkeller for property which is
located in Part of the NW4, Section 14 , Township 7 North, Range 66
West of the 6th P.M. , Weld County, Colorado, being more
particularly described in the plat which shall be provided by the
applicant and known as Exhibit "A" , said plat to be recorded, and
WHEREAS , this request is to divide the property with both
parcels estimated to be approximately 1 acre each.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the hereinabove
described parcel of land be , and hereby is , exempt from the
definition of the terms , "subdivision" and "subdivided land" .
BE IT FURTHER RESOLVED by the Board that this approval is
conditional upon the following conditions : 1) the applicant shall
submit a mylar plat to the Department of Planning Services to be
recorded in the office of the Weld County Clerk and Recorder. The
plat shall be drawn in accordance with the requirements of Section
9-2C. (4) of the Weld County Subdivision Regulations. The plat
shall be submitted within ninety days from the date of approval by
the Board of County Commissioners; 2) the eastern approximately
two hundred feet of the site is within a one-hundred-year floor
plain (Mead Lateral) . Any future development within this area
shall comply with Section 26 of the Weld County Zoning Ordinance;
and 3) the mylar plat shall show a perpetual easement for ingress
and egress from Weld County Road 33 to the larger parcel.

Re: Recorded Exemption #RE-737
Dear Commissioners:
The attached application, plat and related items are in reference to a
request from Bob & Dorothy Weidenkeller for a recorded exemption. The
parcel. of land on which this request is being made is described as part of
the NW1.7, of Section 14, T7N, P66W of the 6th P.M. , Weld County, Colorado.
The property is located 1 mile west of Ault on Weld County Road 33. The
parcel of land under consideration is the total contiguous land holdings of
the applicant.
The request is to divide the property into parcels of 1.0 acres and 1 .45
acres, more or less. Mr. & Mrs. Weidenkeller propose to sell the smaller
one (1) acre parcel. They will retain the larger parcel for their personnel
use.

Based upon the submitted information and policies of the County, the
Department of Planning staff recommends the request be approved for the
following reasons:
1. The applicant has demonstrated in the submitted application
materials that the request complies the submission
requirements of Section. 9-2 C. of the Weld County Subdivision
Regulations submission requirements.
2. The applicant has demonstrated in the submitted application
materials that the standards and conditions of Section 9-2 E.
(1) (a) through (m) of the Weld County Subdivision
Regulations have been met.
The Department of Planning Services staff recommendation for approval is
conditional upon the following:
1. The applicant shall submit a mylar plat to the Department of Planning
Services to be recorded in the office of the Weld County Clerk and
Recorder. The plat shall be drawn in accordance with the requirements
of Section 9-2 C. (4) of the Weld County Subdivision Regulations. The
plat shall be submitted within sixty (60) days from the date of
approval by the Board of County Commissioners.
2. The eastern approximate two hundred (200) feet of the site is within a
one hundred (100) year flood plain (Mead Lateral) . Any future
development within this area shall comply with Section 26 of the Weld
County Zoning Ordinance.

Gentlemen :
Applicant for the proposed recorded exemption is Bob R.
and Dorothy Jean Weidenkeller. The Weidenkeller ' s address
is 39580 Weld Co. Rd. 33, Ault , Colo. 80610 (Phone 834-2643) .
The total acreage of the parcel to be divided is 2 . 45 acres ,
and the applicant seeks to divide the property into a 1. 0
acre parcel (Lot "A") and a 1. 45 acre parcel (Lot "B") .
Domestic water is available to Lot "A" , and well water to
Lot "B" ; sewer service will be provided by septic systems
to each parcel. Access to both parcels is from Weld Co .
Rd. 33.
The Weidenkellers desire to split their property due to
economic and health reasons . Lot "A" would be sold and
they would retain Lot "B" as their personal residence .
It appears that the proposal is consistent with the Weld
County Comprehensive Plan. The parcel is probably not con-
sistent with the current county zoning however , since the
lot to be split is such a small size that agricultural use
is uneconomical. The proposed land split would not be in-
consistent with efficient and orderly development of the area.
Approximately the rear 200 feet of the parcel is located
within the 100 year flood plain of the Mead Lateral Ditch .
However, as shown on the sketch plan , this does not effect
either existing residence , or the proposed residence .

The parcel is not located in a geologic hazard and/or
Weld County Airport Overlay District . The application
complies with Section Fifty (50) Overlay District regula-
tions as outlined in the Weld County Zoning Regulations .
