HomeMy WebLinkAbout851111.tiff RESOLUTION RE: APPROVE DESIGNATION OF THE WELD COUNTY DEPARTMENT OF SOCIAL SERVICES AS THE CASE MANAGEMENT AGENCY FOR THE ADMINISTRATION OF SENATE BILL 138 WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, under Senate Bill 138 , Home and Community Based Services are provided in the State of Colorado for the elderly and disabled on an individual basis , and WHEREAS , the Weld County Board of Social Services has informed that Board that a Case Management Agency must be designated for the administration of Senate Bill 138 , and WHEREAS , after review, the Board deems it advisable to designate the Weld County Department of Social Services as the Case Management Agency for said Program. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Weld County Department of Social Services be, and hereby is , designated as the Case Management Agency for the administration of Senate Bill 138 in Weld County. BE IT FURTHER RESOLVED by the Board that the Chairman be, and hereby is , authorized to sign a letter affirming such designation. Agencies which have been designated CMA's by boards of county commissioners must complete the attached forms and provide the specified information in order to be considered for certification as a case management agency. CMA designees will be certified by the Aging and Adult Services Division of the Colorado Department of Social Services on the basis of assurances signed by the director for the designated agency and the chairperson of the board of county commissioners. These assurances will constitute a contract between the Department of Social Services and the case management agency. Performance will be monitored, authorized services will be reimbursed, and future recertification will be considered in relation to these assurances. Specific county or programmatic issues that may impact on the HCBS program in that respective county. 2. Gretah Dussart will join the Department May 13 and assume full responsibilities as the new HCBS Administrator upon Paul's departure on June 1, 1985. GENERAL ASSURANCES REGARDING THE HOME AND COMMUNITY BASED SERVICES PROGRAM OF THE COLORADO DEPARTMENT OF SOCIAL SERVICES July 1, 1985 - June 30, 1986 We, the undersigned, hereby agree that each of the following assurances will be met in relation to the Home and Community Based Services Program of the Colorado State Department of Social Services. We understand that these assurances constitute the contractual terms of certification, against which performance will be monitored, authorized services will be reimbursed, and future recertification will be considered. A. The case management agency (CMA) designate has developed and submitted to the State a plan for local operations and program implementation for FY 84-85. The CMA agrees to either continue to operate under this plan or submit a new plan. This local operational plan conforms to a State-prescribed format and outlines the process by which the following assurances will be met. The agency can document that at least the following entities were invited to participate in the public input process which preceded the development of the plan: the board of county commissioners, the field supervisor of CDSS, the district health ;, department, the area agency on aging, county department(s) of social services, nursing home(s), hospital(s), city and town government(s), and the general public. Co. CommS CMA B. The CMA will have as a major objective that referrals to the agency of Medicaid long term care eligible clients will result in a percentage of diversions from nursing home placement that is not less than the statewide average of 12%. If that percentage of diversion is not achieved, the CMA will work with the Home and Community Based Services Unit in the Aging and Adult Services Division to develop and implement strategies to effect a steady increase in nursing home diversions until the statewide average can be achieved. Note: This assurance pertains only to HCBS cases which are not continued stay review 90-day referrals; the CSR 90-day referral case data should be maintained as a separate category. Co. Comm. CMA 051 C. The CMA will process paperwork in a timely and accurate manner so as to promote prompt service to clients and prompt payment of provider claims. All forms will be submitted within the time constraints and according to the processes set forth in the HCB rules and regulations. Co. Comm. Cc CMA L / General Assurances Page Two D. The agency will assume a lead responsiblity for coordinating and developing a local continuum of care for the elderly. Coordination responsiblities include the initiation of regular and adequate communications with providers, potential providers, and the other entities cited in Assurance A above. Co Comm \ CMA ' i E. 'The agency will guard the clients' rights within the HCBS program. Clients have the right to apply for services, to have their eligibility for services determined, to receive an adequate quantity and quality of the services for which they are eligible, to appeal denials of service, and to have their communications with the agency dealt with confidentially. The CMA will notify each client of his/her right to appeal, and will facilitate appropriate access to advocacy services from the Colorado Long Term Care Ombudsman, Adult Protective and Supportive Services, and the Area Agency on Aging/Title III 0y�\1Advocacy Sery�s. Co. Comm CMA jj�� F. The CMA assures competent and professional operation of the agency and of the Home and Community Based Services Program. Case managers and their support staff will be qualified, both by education and experience, to carry out their assigned duties. The agency will provide them with adequate training and supervision to maintain on ggipgg quality of ice. Co. Comm. \ CMA G. The case management agency may certify and use individual providers in accordance with state rules. However, a case management agency will be certified as an agency to provide other services only when it demonstrates and receives state approval that: a) No other provider in the community can provide that service, or b) The case management agency can provide the service more cost effectively than other providers. Co. Comm. CMA H. The CMA will extend HCBS provider certification only to individuals who are qualified to perform their assigned duties. The agency will provide adequate monitoring and assure that adequate training takes place to maintain the ongoing quality of service. The Home and Community Based Services (HCBS) program authorized under SB 138 (1982) and pending reauthorization under SB 119 (1985), provides services to eligible clients in home or community settings as an alternative to nursing home care when cost effective. Services provided under HCBS include case management, home health, personal care, homemaking, adult day care, respite care, home modification and electronic monitoring, and non-medical transportation. Section 26-4.5-103(2) of SB 119, authorizes the board of county commissioners in each county to designate a case management agency for its county. Currently the case management agency must be a public agency. However, effective July 1, 1985, with the enactment of SB 119, any qualified agency may be designated as a case management agency. In addition, the same agency may be designated by one or more counties to serve as that county's case management agency. Once the case management agency has been designated by the board of county commissioners, the agency must be certified according to State Department of Social Services regulations (Volume VIII, 8.488.20) as meeting all standards and criteria to serve as a case management agency. The role and responsibility of the case management agency includes confirming Medicaid eligibility, assessing client need for services, developing and implementing a case plan, ensuring that cost effectiveness is maintained, coordinating and monitoring service delivery, evaluating service effectiveness, and periodically reassessing client need. It also includes administrative responsibility for the HCBS program including assessing PETI payments, maintaining case records, collecting data and reporting to the State as required. Annually, since the inception of the HCBS program in 1982, the board of county commissioners in each county has been asked to designate a case management agency. Thereafter, the State has certified each case management agency in accordance with State regulations which specified that a local operational plan be developed and submitted for State approval prior to certification. The initial local operational plans covered the period from February 7, 1983 through June 30, 1984; the second certification period covered July 1, 1984 through June 30, 1985. Boards of County Commissioners May 8, 1985 Page Two Prior to the expiration of the current certifications, the Department is again initiating the process to certify case management agencies. As part of that process, we are requesting that each board of county commissioners review the case management agency designation in its county and take the following action(s): 1. Designate the same case management agency or; 2. Designate a different agency to serve as the case management agency; and 3. Notify the State Department of Social Services in writing no later than June 14j_ 1985 of its decision. (If a change in case management agencies is anticipated, additional time may be requested for the actual designation process.) Pending the receipt of the above information, currently designated case management agencies will be advised regarding the preparation of the local operational plan required for the period July 1, 1985 through June 30, 1986. If the designation is changed, the Aging and Adult Services Division will contact both the old and the new agency directly and either temporarily extend the previous agency's certification or issue a conditional certification to the new agency to avoid any discontinuity of services. S'nce ely, 1 George S. dstein, Ph.D. Executive Director CASE MANAGEMENT NARRATIVE - LOCAL OPERATION PLAN 1985-86 With an increase in development of housing units available from senior citizens, a major concern for our community is the ability of existing service providers and agencies to keep pace with supportive services that will be needed. The AAA is operating with the same budget allocations as previous years, which will make expansion of services difficult. The Long Term Care Committee will continue to pursue the development, recruitment and training of volunteers to assist in a financial advisory, conservatorship, or guardianship role. Development of this resource will enable clients that can no longer manage their funds to enjoy living in a less restrictive environment. As the ACF program continues to grow and develop we hope to refine skills in assessing placements to ensure success of this resource. Training needs of case managers and other HCB providers will need to be addressed as program changes are implemented or identified. State Department personnel as well as local resources will be used as appropriate. Goals and objectives as stated in the 1984-85 Local Operation Plan have been reviewed and reassessed.
