RE: APPROVE INTERGOVERNMENTAL AGREEMENT WITH CITY OF GREELEY FOR
PAVING OF A PORTION OF FIRST AVENUE
WHEREAS , the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS , the Board has been presented with an
Intergovernmental Agreement with the City of Greeley for the
paving of a portion of First Avenue, and
WHEREAS, the terms and conditions are as stated in said
Agreement, a copy being attached hereto and incorporated herein by
reference, and
WHEREAS, after study and review, the Board deems it advisable
to approve said Agreement.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the Intergovernmental
Agreement with the City of Greeley for the paving of a portion of
First Avenue be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chairman be, and
hereby is, authorized to sign said Agreement.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 27th day of
September, A.D. , 1989 .

CITY OF GREELEY AND WELD COUNTY INTERGOVERNMENTAL AGREEMENT
FOR THE PAVING OF A PORTION OF FIRST AVENUE
WITNESSETH, that Weld County, Colorado, a home rule county,
hereinafter known as "County" and the City of Greeley, Colorado ,
a home rule city, hereinafter known as "City" , do hereby agree
and covenant as follows:
1 . The parties mutually agree that the provisions of this
Agreement will benefit the health, safety , and welfare of the
people of both Weld County and the City of Greeley.
2 . The County agrees to repair and overlay the entire
width of First Avenue between Twenty-eighth and Thirty-first
Streets using County personnel and equipment .
3 . The City agrees to pay the County the City 's portion of
the cost of materials for this project . This amount shall be
Sixteen Thousand Two Hundred Seventy-two Dollars and Twenty-four
Cents ($16 ,272 .24) .

Dear Mr . Kirby:
Enclosed is a copy of Ordinance No . 50, 1989, authorizing the
Mayor of Greeley to enter into an Intergovernmental Agreement with
Weld County for the paving of a portion of First Avenue . Attached
to the ordinance is the original of the Intergovernmental
Agreement .
Please sign the Intergovernmental Agreement and return it to my
office . You may keep the copy of the ordinance for your files .

ORDINANCE NO. 50 , 1989
AN ORDINANCE AUTHORIZING THE MAYOR TO SIGN AN INTERGOVERNMENTAL
AGREEMENT WITH WELD COUNTY, COLORADO FOR THE PAVING OF A PORTION
OF FIRST AVENUE.
BE IT ORDAINED BY THE CITY COUNCIL OF GREELEY, COLORADO:
Section 1 . The City Council hereby declares that it is in
the public interest and for the benefit of the health, welfare
and safety of the citizens of Greeley, Colorado for the City to
enter into an intergovernmental agreement with Weld County to
provide for the paving of First Avenue between Twenty-eighth and
Thirty-first Streets .
Section 2. The Mayor of the City of Greeley, Colorado is
hereby authorized to sign an intergovernmental agreement with
Weld County , Colorado which is attached to this Ordinance and
incorporated herein in its entirety as Exhibit "A" for the paving
of First Avenue between Twenty-eighth and Thirty-first Streets.
Section 3. This ordinance shall become effective upon its
passage.
PASSED AND ADOPTED , SIGNED AND APPROVED THIS 5th DAY OF
September , 1989 .
