RE: APPROVE USE BY SPECIAL REVIEW FOR TWELVE DOG KENNEL - SUSAN

WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners held a public
hearing on the 17th day of December, 1986 , at the hour of 2: 00
p.m. in the Chambers of the Board for the purpose of hearing the
application of Susan M. Riegel, 1878 Old Highway 52 , Erie,
Colorado 80516, for a Use by Special Review for a twelve dog
kennel on the following described real estate, to-wit:
Part of the NWa, Section 5, Township 1 North,
Range 68 West of the 6th P.M. , Weld County,
Colorado
WHEREAS, Section 24 . 4. 2 of the Weld County Zoning Ordinance
provides standards for review of said Use by Special Review, and
WHEREAS, the Board of County Commissioners heard all of the
testimony and statements of those present, has studied the request
of the applicant and the recommendations of the Weld County
Planning Commission and all of the exhibits and evidence presented
in this matter and, having been fully informed, finds that this
request shall be approved for the following reasons:
1. The submitted materials are in compliance with the
application requirements of Section 24. 7 of the Weld
County Zoning Ordinance.
2. It is the opinion of the Board of County Commissioners
that the applicant has shown compliance with Section
24. 4 . 2 of the Weld County Zoning Ordinance as follows:
a. The proposal is consistent with the Comprehensive
Plan policies in that the use does not infringe on
continued agricultural use in the vicinity or
County. The proposal does not appear to have any
adverse impacts on the agricultural interests of
the County or the environment.

b. The proposal is consistent with the intent of the
Agricultural Zone District and is provided for as a
Use by Special Review.
c. The activities proposed will be compatible with
existing uses , as well as with the future projected
development in the immediate area. The proposed
use will not have any significant traffic or noise
impacts.
d. The proposal was reviewed by the Town of Erie and
was found to be compatible with their interests.
e. No overlay districts affect the site.
f. Use by Special Review Development Standards will
provide adequate protection of the health, safety
and welfare of the neighborhood and County.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the application for a
Use by Special Review for a twelve dog kennel on the hereinabove
described parcel of land be, and hereby is , granted subject to the
following conditions:
1. The attached Development Standards for the Use by
Special Review permit be adopted and placed on the Use
by Special Review plat prior to recording the plat.
2. The Use by Special Review activity shall not occur nor
shall any building or electrical permits be issued on
the property until the Use by Special Review plat has
been delivered to the Department of Planning Services
Office and the plat is ready to be recorded in the
office of the Weld County Clerk and Recorder.
3 . Evidence shall be submitted within thirty days from the
date of approval by the Board of County Commissioners
that an effective program for the control of insects and
ectoparasites has been approved by the Weld County
Health Department.

1 . The Use by Special Review permit is for a dog kennel as
submitted in the application materials on file in the
Department of Planning Services and subject to the
Development Standards stated herein. The maximum number of
dogs shall not exceed twelve.
2. All dogs shall be housed between the hours of 10: 00 p.m. and
6 : 00 a.m.
3. Animal wastes shall be removed from primary enclosures daily
or as often as necessary to prevent contamination of the
animals contained therein and to reduce disease hazards and
odors. No final disposal of wastes shall occur on the site.
4. Water shall be provided in adequate amounts and free from
contamination.
5 . The owner shall not sell or transfer twenty or more animals
per calendar year.
6 . Exercise areas shall be of sufficient size to allow any dog
to break into a run.
7. Building and grounds shall be kept clean, in good repair, and
free of trash. All wastes shall be removed on a weekly basis
and disposed in an approved landfill.
8 . The Use by Special Review permit shall not be transferable to
any successors in interest to the described property and
shall terminate automatically upon conveyance or lease of the
property to others for operation of the facility.
9. All construction done on the property shall be in accordance
with the requirements of the Weld County Building Code
Ordinance.
10. The property owner or operator shall be responsible for
complying the the Design Standards of Section 24. 5 of the
Weld County Zoning Ordinance.
11 . The property owner or operator shall be responsible for
complying with the Operation Standards of Section 24 . 6 of the
Weld County Zoning Ordinance.

12. Personnel from the Weld County Health Department and Weld
County Department of Planning Services shall be granted
access onto the property at any reasonable time in order to
insure the activities carried out on the property comply with
the Development Standards stated herein and all applicable
Weld County Regulations.

A public hearing was conducted on December 17, 1986, at 2:00 P.M. , with

The following business was transacted:
-I hereby certify that pursuant to a notice dated November 26, 1986, and
duly published December 4, 1986, in the Johnstown Breeze, a public
hearing was conducted to consider the request of Susan M. Riegel for a
Use by Special Review for a twelve dog kennel. Lee Morrison, Assistant
County Attorney, made this matter of record. Keith Schuett, Planning
Department representative, read the favorable recommendation of the
Planning Commission, containing three Conditions and fourteen
Development Standards, into the record. Susan Riegel, the applicant,
came forward to answer questions of the Board. She stated that she has
no problems with the proposed Development Standards. No public comment
was made concerning this application. Commissioner Lacy moved to
approve this Use by Special Review, based upon the Conditions and
Development Standards recommended by the Planning Commission. The
motion, seconded by Commissioner Yamaguchi, carried unanimously.
This Certification was approved on the 22nd day of December, 1986.

The Chairman asked Mr. Rhinesmith if he had reviewed the recommendations,
conditions, and development standards as outlined by the Department of
Planning Services staff. He stated he had and has no objection to anything
stated.
The Chairman called for discussion from the members of the audience. There
was none.
The Chairman asked that reading of the recommendations, conditions, and
_development standards as outlined by the Department of Planning Services
-staff be dispensed with and that they be filed with the summary as a
-permanent record of these proceedings.
Lee Morrison reminded the Planning Commission that this is considered a
major facility of a public utility. Therefore, the Planning Commission's
action is final unless their decision is for denial, in which case the
applicant may request a hearing with the Board of County Commissioners.
MOTION:
Lydia Dunbar moved Case Number USR-763:86:44 for Weld County for a Use by
Special Review permit for -a major facility of a public utility (370 foot
high radio transmission tower) be approved by the Planning Commission based
upon the recommendations, conditions, and development standards as outlined
by the Department of Planning Services staff and the testimony heard by the
members of the Planning Commission. Motion seconded by Louis Rademacher.
The Chairman called for discussion from the members of the Planning
Commission. Discussion followed.
The Chairman asked the secretary to poll the members of the Planning
Commission for their decision. Ivan Gosnell - yes; Lydia Dunbar - yes;
LeAnn Reid - yes; Louis Rademacher - yes; Paulette Weaver - yes; Ann
Garrison - yes; Jack Holman - yes. Motion carried unanimously.

APPEARANCE:
Susan Riegel, property owner and applicant, reported she is asking for a Use by Special Review permit so she can have more than four dogs on her
property. She currently has eight dogs,- but is asking for a total of twelve
in this permit. This will not be a boarding kennel and she does not raise
any puppies. The dogs she has are primarily for show. This is a four acre
site which is fenced on three sides. The dogs are in the backyard within a
five foot privacy fence.

The dogs are not allowed out at night. They are iu the house with her at
night and if she is gone for a day or so the dogs are boarded out. The
reasons she is asking for twelve dogs is because she works with rescued and
mistreated dogs and wants a place for these dogs to stay until homes can be
found for them. She has reviewed the recommendations, conditions, and
development standards as written by the Department of Planning Services
staff. She does not agree with development standard #8---all kennel
operations will cease upon her residing on this property, but she is willing
to abide by it.
The Chairman called for discussion from the members of the audience.
Larry Bierle, surrounding property owner, stated he is concerned about
barking, which is not continual, but they do sometimes bark. He also
presented a letter from Floyd Price, another surrounding property owner who
is unable to be here today, and he is also opposed to this request.
Lee Morrison stated today's letter is a different letter from the one the
Planning Commission members have in their packets, but it is very similar to
the first letter.
The Chairman asked Debbie deBesche to read the recommendations, conditions,
and development standards as outlined by the Department of Planning Services
staff into the record.
Debbie deBesche reported she had received a phone call from Mr. Anderson, a
surrounding property owner, who is not opposed to this request if the kennel
is not transferable.
Henry Giesert, adjacent property owner on the north, stated he does not have
any problem with the dogs as long as the development standards are complied
with.

Ann Garrison moved Case Number USR-765:86:46 for Susan M. Riegel for a Use
by Special Review permit for a dog kennel be forwarded to the Board of
County Commissioners with the Planning Commission's recommendation for
approval based upon the recommendations, conditions, and development
standards as outlined by the Department of Planning Services staff and the
testimony heard by the members of the Planning Commission. Motion seconded
by LuAnn Reid.

LOCATION: Approximately 2 miles southeast of Fort Lupton, west of Weld
County Road 37, and south of Highway 52.
Howard Duckworth, property owner and applicant, reported he is the owner of
Colorado Disposal Systems. The purpose of the septage reclamation system is
to safely dispose of septic waste. The counties of Larimer, Adams, Weld and
Boulder need a place to safely dump these wastes. Currently, waste is just
being dumped on farmlands and allowed to leach into underground water
tables. They will receive septage from licensed haulers. All loads will be
checked by their operators and routine laboratory tests will be made to be
certain no unauthorized materials are being dumped. He explained the
difference between septic system and sewer system waste materials. He
explained the system for treatment of the septage wastes. It will take
approximately two years before anything will be able to be sold as
fertilizer. All ponds will have a four foot clay liner. There will be
eight test well sights and these will be sampled quarterly. This is a badly
needed facility, and it is the most environmentally safe type of septage
disposal system there is.

the application materials on file in the Department of Planning
Services and subject to the Development _Standards stated hereon. The
maximum number of dogs shall not exceed twelve (12) .
2. All dogs shall be housed between the hours of 10:00 p.m. And 6:00 a.m.
3. Animal wastes shall be removed from primary enclosures daily or as
often as necessary to prevent contamination of the animals contained
therein and to reduce disease hazards And odors. No final disposal of
wastes shall occur on the site.
4. Water shall be provided in adequate amounts and free from
contamination.
3. The owner shall not sell or transfer twenty (20) or more animals per
calendar year.
6. Exercise areas shall be of sufficient size to allow any dog to break
into a run.
7. Building and grounds -shall be kept clean, in good repair, and free of
trash. -All wastes shall be removed on a weekly basis and disposed in
an approved landfill.
8. The Use by Special Review permit shall not be transferable to any
successors in interest to the described property and shall terminate
automatically upon conveyance or lease of the property to others for
operation of the facility.

10. The property owner or operator shall be responsible for complying with
the Design Standards of Section 24.5 of the Weld County Zoning

Dear Mr. Schuett,
Please consider this letter in strong opposition to the above request. As a
property owner within the 500 ft. boundary, it is my Dpinion that a kennel
would prove to be a major distraction to the present residents. Unfortunately
barking dogs, more often than not, cannot be contolled.
Because of the decrease in value of farm land it appears -evident that the
value of my land lies in the possibility of residential development. I feel
a kennel would be a major deterent for such development and reduce property
values.

kennel, and/or animal shelter.
The following recommendations were made:
1) Enclosur-es shall be structurally sound and maintained in good repair.
Runs, if gravel, must be replaced several times each year or as needed.
2) Exercice areas - One sun/18 dog kennels. These shall be of sufficient
size to allow any dog to break into a run.
3) Animal wastes shall he removed from primary enclosures daily or as often
as necessary to prevent contamination of the animals contained therein
and to reduce disease hazards and odors. No final disposal of wastes
shall occur on the site.
4) An effective program for the control of insects, and ectoparasites
shall be maintained.
5) Water shall he adequate and free from contamination.
6) Owner shall not sell or transfer twenty (20) or more animals per
calendar year.

2. DESCRIPTION OF PROPOSED USE AND OPERATION:
1. Proposed Use: I am seeking the Use by Special Review in order to allow for a
more intensive use of my property, permitting me to keep more than the number
of dogs currently allowed.
2. Need for Proposed Use: I currently have more dogs than the existing zoning
allows and am in violation of the county ordinance. In order for me to keep my
AKC registered show dogs, I am seeking this Use by Special Review.
3. Surrounding Properties: The surrounding properties are all acreages of 1.5 to 5
acres, are single family dwellings, and many of the larger properties are planted
in alfalfa and grass. Several adjacent properties maintain horses, goats, cattle,
and chickens in addition to dogs and cats.
4. Distance to Other Structures: The closest residential structures to the barn
where my dogs will be kept during the day are listed below. The dogs are all
brought in the house at night.
North - approximately 800 feet (one house)
East - approximately 350 feet (two houses)
South - approximately 100 feet (one house)
West - approximately 2000 feet (one house)
5. Maximum Number of Users: N/A
6. Number of Employees: N/A
7. Water Source: Water source for the dogs will be the household domestic water,
supplied by the Left Hand Water Company. A copy of my membership is at-
tached to this application.
8. Access Route: The access route to my property is via Colorado State Highway
52 to Old Colorado Highway 52, which is an unmarked paved loop running south
of Highway 52.
9. Traffic: Only my car or my motorhome are used into the property for transport-
ing my dogs to shows and other competitions.
10. Sewage: Waste from the dogs is disposed of at an approved local landfill.
11. Fire Protection: The barn will have a fire extinguisher located in it for emer-
gency use. The house and property as a whole are protected by Dacono,
Longmont Rural, and Brownsville Fire Stations.
12. Number and Type of Animals: The type of dog I own and show is the Keeshond.
It is a medium size dog, standing 16-18 inches at the shoulder and weighing
23-45 pounds. It is considered to be a "companion dog", and is not used for
coursing game, attack or guard work, or hunting. The maximum number to be
on the property at any one time will be 12.
13. Stockpile of Waste: The waste is taken on a weekly basis to an approved landfill
for disposal.
14. Storm Water Retention: I am not increasing the number of structures on the
property which would cause a change in storm water retention.
15. Associated Waste Removal: Yard and dog runs are cleaned of waste daily. The
waste is stored in trash bags and removed weekly to an approved local landfill.
16. Proposed Landscaping: Landscaping around the barn and dog runs is pro-
posed as follows:
Dog runs: Solid wood fencing will be added along the entire length of
the east and west dog run fencelines and integrated into the existing wood pri-
vacy fence around the back yard;
Barn: Various trees and shrubs will be planted and maintained around
the east and west sides of the barn and dog runs in order to integrate that sec-
tion of the property with the front yard of the house. The planting for this land-
scaping will be completed at such time in the spring as to guarantee maximum
viability (survival rate), in light of our unpredictable spring weather. The view,
therefore, from the street and from the homes to the south and east should be
pleasing and in keeping with the residential character of the area.
17. Reclamation Procedures: N/A
18. Timetable: Proposed finish date of dog run construction should be two months
following final approval of the use by special review by the Planning Commis-
sion and the County Commissioners, and approval of the dog runs by the Weld
County Building Department. Landscaping will start in spring 1987. Solid fenc-
ing on the east and west sides of the dog runs will be completed immediately
upon special use permit approval.

3. OTHER SUPPORTING DOCUMENTATION AND MATERIALS:
1. This proposal is consistent with the Weld County Comprehensive Plan as it
takes no agricultural land out of active production.
2. This proposal is consistent with existing intent of the District, as it maintains the
agricultural and residential environment of surrounding lands.
3. Location Decision: The barn used to contain the dog runs already existed on
the property. I am only adapting it to my needs.
4. Protection: The dog runs will be 6 feet high and are enclosed by a five foot
privacy fence. Additionally, the entire property of 4 acres is fenced with four foot
field fencing.
5. Adjacent Land Use: Land use of existing adjacent properties is agricultural. The
use requested in this proposal is consistent with the adjacent land use.
6. Future Development Compatibility: The proposed use will be compatible with
future development of the surrounding areas and will not detract from any future
development of the area.
7. Hazards: The property is not located in a flood plain, in a geologic hazard area,
or in the Weld County Airport overlay district area.
8. Water Supply: Left Hand Water Company supplies household water and will be
_adequate to support this proposal. A copy from Left Hand Water Company is
attached showing this adequacy.
9. Property Owner: Copy of deed is attached.
10. Noise Report: The noise report has been waived by the Weld County Planning
Services. However, the addition of solid fencing along the east and west fence
lines of the dog runs, the landscaping around the barn, and the addition to the
barn of insulation and doors, should minimize any noise during the daytime. At
night, my dogs are all brought in the house.

I. Residential Memberships (Revised 3-5-83)
A. Definition:
(a) A residence for the purpose of this membership classification
is defined to be a structure normally occupied by one family.
Water use under this residential classification may also include
the following: Farm operations and livestock raising; a business
if such business is operated by the occupant of the residence and
both the business facility and the residence are situated in the
same structure under the common ownership of the person holding
the residential membership.
(b) A condominium, cooperative, or townhouse unit, which has
characteristics more similar to that of a residence than an
apartment, shall be classified as a residence and each such
unit shall meet the residential membership requirements.
B. Membership Requirements:
1. A Membership consists of the following
a. Membership fee
b. Front footage fee
c. One acre foot raw water (Per Board Policy March, 1984)
2. The Membership fee shall be at current Membership price for each
Membership purchased.
3. a. Each membership shall allow maximum of 100,000 gallon;
average monthly usage. Whenever the average monthly usage
exceeds the maximum allowed during any six (6) consecutive
months an additional membership or memberships must be
purchased to comply with the Membership Requirement on
average monthly gallons usage.
b. Each Residential Membership allows water service for only
one household or living unit occupied by one family.
c. Any additional living units on the same property location
requires a membership per each additional living unit
receiving water service.
C. Service Connections:
Each service connection for a residential membership shall be
a 5/8" x 3/4" meter service connection to the distribution lines
of the company unless a larger connection is granted by action
of the Board of Directors and upon such terms and conditions
as may be fixed by the Board of Directors, from time to time.
