I am also enclosing our law office check for $200. 00 to pay the application fee for the Subdivision Exemption. You will recall in our recent telephone discussion you mentioned that Exhibit B attached to the Application For Recorded Exemption required an additional statement in it as to the Applicant' s willingness to install a septic tank and leaching system on the 69 .457-acre tract that will remain if the 10-acre tract that Mr. Gustafsen has contracted to buy is sold to him. The owner of the larger tract after the sale of the smaller tract to Mr. Gustafson will have an easement for a pipeline and the right to the use of water from this well for limited irrigation use on the larger parcel. Preliminary Statement. Applicant, Fort Vasquez • Club Ltd. , has owned the NW4NW4 of Sec. 31, Twp. 3 N. Range 66 W. of the 6th P.M. and the E'NE4 of Sec. 36, Twp. 3 N. , Range 67 W. of the 6th P.M. since 1976. These parcels of land are contiguous. Several months ago, a contract was entered into with Mr. Reuben O. Gustafson to sell him a ten- acre tract located in the southeast corner of the E=NE4 of Sec. 36. The breaking out of this parcel of land from the ExiNE4 of Sec. 36 is the subject matter of an Application for Recorded Exemption, which has also been filed with the Weld County Department of Planning Services. On August 26 , 1988 , the Applicant, Fort Vasquez Nurseries Co. , a Colorado corporation,' which is the general partner of Fort Vasquez Club, Ltd. , purchased a 2. 352-acre tract from Roland Miller and Carol Miller.
