FREY WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 9th day of October, 1985 , at the hour of 2 :00 p.m. in the Chambers of the Board for the purpose of hearing the application of Vince P. Frey, 262 Yank Court, Lakewood, Colorado 80228 , for a Use by Special Review for a motocross race track facility on the following described real estate, to-wit: W1 of Section 5 , Township 2 North, Range 64 West of the 6th P.M. , Weld County, Colorado WHEREAS, Section 24 .4 .2 of the Weld County Zoning Ordinance provides standards for review of said Use by Special Review, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1 . The submitted materials are in compliance with the application requirements of Section 24 .7 of the Weld County Zoning Ordinance. 2 . It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24 .4 . 2 of the Weld County Zoning Ordinance as follows: a. The proposal is consistent with the Weld County Comprehensive Plan in that the use does not constitute an interference with agricultural activities in the vicinity or the County. The use is compatible with existing agricultural activities. b. The proposal is consistent with the intent of the Agricultural Zone District and is provided for as a Use by Special Review. c. Use by Special Review Operation and Design Standards provide adequate protection of the health, safety and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application for a Use by Special Review for a motocross race track facility on the hereinabove described parcel of land be, and hereby is, granted subject to the following conditions: 1 . The attached Standards for Use by Special Review be adopted and placed on the Use by Special Review plat prior to recording. 2 . The prescribed Use by Special Review activity shall not occur nor shall any building or electrical permits be issued on the subject property until the Use by Special Review plat has been delivered to the Department of Planning Services office and the plat has been recorded in the office of the Weld County Clerk and Recorder. 3 . The applicant shall offer and agree to an acceptable program of access easement maintenance with the Board of County Commissioners. The agreement shall mitigate impacts generated on the public right-of-way access easement along the south side of Section 6 , T2N, R64W by the users of the Use by Special Review site. 4 . Within forty-five days from the date of approval by the Board of County Commissioners, the applicant shall improve the public right-of-way access easement from Weld County Road 49 to the applicant' s property. The gravel base shall be a minimum depth of two inches of Class 6 aggregate base course. The minimum width of the travel surface shall be twenty feet. 5 . Within forty-five days from the date of approval by the Board of County Commissioners, the applicant shall extend or replace all cattle guards located on the public right-of-way access easement from Weld County Road 49 to the applicant' s property which are not a minimum of twenty feet in width. All cattle guards located on the public right-of-way access easement shall be a minimum of twenty feet in width. 6 . Prior to recording the Use by Special Review plat, the applicant shall submit an erosion and sediment control plan for the Use by Special Review Permit area approved Page 3 RE: USR - FREY by the Southeast Weld Soil Conservation District. The plan shall address the Soil Conservation District' s concerns identified in its letter of May 20 , 1985 . 7 . Prior to recording the Use by Special Review plat, the applicant shall amend the plat to delete the proposed outgoing access as shown on the submitted plat. 8 . Prior to recording the Use by Special Review plat, the applicant shall submit to the Weld County Health Department a copy of the agreement or contract between the applicant and the firm that is providing the service of emptying the portable toilets located on the property. The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 9th day of October, A.D. , 1985. The permitted use is a recreational facility for a motocross race track and accessory uses as described in the application materials on file in the office of the Department of Planning Services and subject to the Operation Standards listed hereon. Scheduled races shall be limited in number to one even per month, not to exceed eight per year. 2 . The hours of operation shall not exceed from sunrise to sunset. 3 . The vehicles used in any race shall be limited to two or three-wheel vehicles. 4 . A minimum of three uniformed licensed security personnel shall be retained and present for each event held on the property. Additional security personnel shall be employed at a rate of one for each 100 persons anytime the patrons exceed 1 ,000 people. 5 . An identification sign shall be placed at the public right-of-way access easement entrance on Weld County Road 49 . The sign shall not exceed sixteen square feet in area. The sign shall clearly identify the route to the subject Use by Special Review site for patrons and emergency vehicles. 6 . The applicant shall complete an access easement maintenance and improvements agreement with Weld County. The applicant shall be responsible for constructing, improving, and maintaining the public right-of-way access easement along the south side of Section 6 , T2N, R64W of the the 6th P.M. , from Weld County Road 49 to the subject Use by Special Review site. The gravel base shall be a minimum depth of two inches of Class 6 aggregate base course. The width of the travel surface shall be a minimum of twenty feet. 7. All cattle guards located on the public right-of-way access easement shall be a minimum of twenty feet in width. The applicant shall be responsible for installing, replacing, or extending the existing cattle guards to comply with the minimum twenty-foot width requirement. Page 2 OPERATION STANDARDS - FREY USR 8 . The applicant shall maintain a dust abatement program on the public right-of-way access easement to the subject Use by Special Review site and the subject site. Asphaltic emulsion, waste oil for commercially available chemicals may be used to control dust. The applicant is responsible for using materials and methods not inconsistent with any Federal, State, or local law, rules or regulations pertaining to hazardous materials , health or environmental projection. 9 . All activities shall be limited to the subject property and the public right-of-way access easement. 10 . Ingress and egress for patrons to the Use by Special Review Permit site shall be limited to the public right-of-way access easement along the south side of Section 6 , T2N, R64W of the 6th P.M. 11 . The Use by Special Review Permit shall not be transferable to any successors in interest to the described property and shall terminate automatically upon conveyance or lease of the property to others for operation of the facility. 12 . All litter shall be contained on the Use by Special Review subject site. All litter associated with the Use by Special Review shall be picked up following each event. 13 . Seventy (70) gallon capacity portable toilets shall be available for use on the Use by Special Review Site as required to be adequate by the Weld County Health Department. 14 . All food services shall be strictly limited to either licensed vending service vehicles or the sale of prepacked foods requiring no further preparation before consumption. No "homemade" food products of any kind shall be sold. 15 . The applicant shall submit to the Department of Planning Services an erosion and sediment control plan approved by the Brighton Soil Conservation District. The plan shall be implemented and maintained by the applicant. 16 . There shall be a 1 ,500 gallon water truck with pump available at all scheduled events. Page 3 OPERATION STANDARDS - FREY USR 17 . Prior to scheduling each event, the operator shall submit a copy of a liability policy in the amount of one million dollars ($1 ,000 ,000) insuring the operator and the County against all claims or causes of action made against either or both the applicant and the County for damages to persons or property arising out of the motocross facility. Such policies shall be written by a company authorized to do business in the State of Colorado. Evidence of the insurance policy shall be filed with the Department of Planning Services. In case the insurance policy required shall lapse or become void for any reason whatsover, the Use by Special Review permit shall cease to exist until a new insurance policy is provided and filed with the Department of Planning Services. 18 . The applicant shall comply with the design standards for the Use by Special Review, Section 24 .5 et seq. , of the Weld County Zoning Ordinance. 19 . The applicant shall comply with the Operation Standards for Uses by Special Review, Section 24 .6 et seq. , of the Weld County Zoning Ordinance. 20 . Representatives or members of the Weld County Health Department and Weld County Department of Planning Services shall be granted access onto the site at any reasonable time in order to insure the operations carried out on the site comply with the Operation Standards stated hereon and all applicable Weld County Regulations. 21 . The Use by Special Review area shall be limited to the plans shown hereon and governed by the Standards as stated above and all applicable Weld County Regulations. Any material deviations from the plans and/or Standards as shown or stated above shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans and/or Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 22 . The property owner and/or operator of this operation shall be responsible for complying with all of the above stated Standards and conditions of approval. Noncompliance with any of the above stated Standards and conditions of approval may be reason for revocation of the Permit by the Board of County Commissioners. HEARING CERTIFICATION DOCKET NO. 85-50 RE: USE BY SPECIAL REVIEW FOR A MOTOCROSS RACE TRACK FACILITY - VINCE P. FREY A public hearing was conducted on October 9, 1985, at 2:00 P.M. , with the following present: Commissioner Jacqueline Johnson, Chairman Commissioner Gene Brantner, Pro-Tem Commissioner C.W. Kirby Commissioner Gordon E. Lacy Commissioner Frank Yamaguchi Also present: Acting Clerk to the Board, Mary Reiff Assistant County Attorney, Lee D. Morrison Planning Department representative, Gloria V. Dunn The following business was transacted: I hereby certify that pursuant to a notice dated July 10, 1985, and duly published July 11, 1985, in the Johnstown Breeze, a public hearing was conducted to consider the application of Vince P. Frey for a Use by Special Review for a motocross race track facility. Lee Morrison, Assistant County Attorney, made this matter of record. At the hearing of August 28, 1985, there was a motion to approve the Use by Special Review with certain Operation Standards amended, which was still before the Board at this hearing. Gloria Dunn, Planning Department representative, stated that the applicant had submitted a sign—posting certificate, a letter from the Hudson Fire Protection District and a racing rule book, with its update for 1985. She also stated that the Planning staff had not received these items in time to prepare Operation Standards as requested at the hearing held on August 28. Vince Frey came forward to answer further questions of the Board. Rod Allison, Planning Department representative, read a proposed Operation Standard concerning insurance into the record. It was recommended that Operation Standard #14 be amended to address the issues raised by a letter from the Soil Conservation District. (Tape Change #85-88) During discussion regarding the issue of adequate fire protection, Mr. Frey stated that they always have a 1,500-gallon truck at the track while racing and it was recommended that an Operation Standard be added requiring that this type of truck be on the site during the races. It was also recommended that an Operation Standard be added to allow racing only from dawn to dusk. Chairman Johnson reviewed the changes to the Operation Standards which were discussed at this hearing. Commissioner Lacy moved to amend the motion for approval of this Use by Special Review with the additions to the Operation Standards as reviewed by Chairman Johnson. Commissioner Brantner seconded the motion and it carried unanimously. Chairman Johnson stated that she will vote against approval of this Use by Special Review and stated her reasons. The motion to approve the Use by Special Review carried with Commissioners Brantner, Kirby and Lacy voting aye and Commissioner Yamaguchi and Chairman Johnson voting nay. Frey REQUEST: Use by Special Review permit for a motocross race track facility. LEGAL DESCRIPTION: The W1 of Section 5, T2N, R64W of the 6th P.M. Weld County, Colorado. LOCATION: Approximately 5 miles northwest of Keenesburg APPEARANCE: Vince Frey, Vice—President of Prairie Hill Promotions, reported they have built a motocross facility on this site and they would like to continue holding competitive events at this site. Prior to installing the motocross facility he did call the Department of Zoning to see if this was a use that could be conducted in the Agricultural Zone District. He had checked with the owner of another motocross facility and he also had Agricultural Zoning, therefore, he wrongly assumed that he could go ahead with this project. While his intentions were good, he just did not check far enough or he would have discovered that the existing motocross facilities were grandfathered in and he would need a Use by Special Review permit to install their facility. He explained the various regulations pertaining to safety, size of bikes, distance of the audience from the racing activities, insurance requirements, food and beverage requirements, etc. , that pertain to these racing events. There are two ambulances on site when competitive events are held as well as a pumper—type water truck and other types of fire chemical fire extinguisher just in case there would be a fire. �xi+iv.r e Summary of the Weld County Planning Commission Meeting June 4, 1985 Page 7 Re stated they have reviewed the recommendations, conditions, and operation standards as outlined by the Department of Planning Services staff. There is the possibility of leasing the property for a day to hold dune buggy races. Lee Morrison explained the proposed motocross racing facility only went with the current owners and not with the land. A lease, even for one day, constitutes revocation of the permit. Therefore, they would want to be involved in some way for the Use by Special Review Permit to remain active. Mr. Frey reviewed possible changes they would like to have made to Operations Standards #1 and 3. Tape 205 - Side 2 The Chairman called for discussion from the audience. Charlotte Harkis, surrounding property owner, spoke in opposition to this request because of the noise, danger of fire, and the possibility of decreased land values. Pat Delaney, Attorney, represented John and Molly Andrews, surrounding property owner, who oppose this request because of noise, traffic, decreased land values, etc. , in the event that they should build a house on this property or try to sell their land. The Chairman asked Rod Allison to read the recommendations, conditions, and operation standards as outlined by the Department of Planning Services staff into the record. Sharon Linhart - yes; Jack Holman - yes, he agrees with Sharon, and with the standards we have to use on determining this Use by Special Review he comes up with four reasons not to have it and only two have it. Louis Rademacher - no; Paulette Weaver - yes; Bob Ehrlich - no. Motion carried with three voting for the motion and two voting against the motion. Chcuk Cunliffe reported that the amendments to Section 9 of the Zoning Ordinance does not really affect the Planning Commission as these are cases that routinely go to the Board of County Commissioners. These changes have been discussed with the Board of County Commissioners and they have directed that the proposed amendments be presented to the Planning Commission. The criteria would remain the same. If requests for recorded exemptions and subdivision exemptions were staff approved it would cut down on the cost of expenses for handling the cases tremendously. If the staff were to deny a request, the applicant still has the right to request a hearing before the Board of County Commissioners. This sandy soil is fragile. The vegetation on this soil will deteriorate with traffic and will become bare of vegetation on high traffic areas. This soil is listed as Other Land on the Important Farmland Map for Weld County, Colorado. Erosion and Sediment Control : This sandy soil is highly susceptible to blowing and blowout conditions can occur. The proposal states that water will be used for dust control . Does this mean all year or only when an event is scheduled? A wind storm can occur any time of the year. However, the windy season is generally November through May. Are there any erosion control measures planned for this time of year? Do they plan to confine vehicles to roads, track, pit area and parking areas? If not what are the plans to protect these areas? Will the roadsides be seeded? Reclamation procedure upon cessation calls for replanting the track area to buffa- lo grass. We believe that buffalo grass is a poor choice for this area. We sug- gest that any area where the vegetation has been reduced or removed be reseeded. Suggested reclamation seeding would include grasses that are there now, or in the surrounding area at the time of seeding. The first concern deals with potentially limited emergency vehicle access to the area both from parking of the patrons vehicles and the soil condition when wet from heavy rain or moisture. Patron parking will require some specific plan and regulation to ensure sufficient access is possible even when an event has just ended and traffic flow out of the area has peaked. Parking will also have to be done in such a manner to allow large emergency vehicles (fire, ambulance) direct access to every area of the parking area and pits. We also have a concern that a sudden heavy rain would sharply limit fire pumper and ambulance mobility in the area. Our second concern is security for a crowd of nearly 1,000 persons including parking lots and crowd viewing areas. The potential for vandalism, vehicle break-ins, and injury to patrons is a reality and would add to our existing service demand. To avoid this added demand, we would request some consideration be given requiring a minimum of three security personnel for any event with an additional security personnel at a rate of one for each 100 persons. We would also request that security personnel be clearly identified by a uniform or other easily observable identification. In this way, we might be able to prevent property damage and/or injuries. The maxium number of users ,patrons , members , and buyers is approx 1000 . There will be approximately one 12 hour shift per month, for 6 months out of a year at this present time. The portable chemical toilets will also be emptied after each event. • Proposed landscaping plans is that we have taken the natural landscaping and rope off a track for the riders and no erosion control measures have been taken. Reclamation procedures to be employed anon cessation would be to remove the roping off of where the track is and replant an} buffalo grass that has been remove where track was layed. The time table for construction has already been completed . The reason this sight was choosen was because it is the least desirable plot in the area for any agricultural activity. On the sight nothing grows there and the topigraphical elvation changes are extremely prohibted for any agricultural use . This is a professionally organized event sanctioned by organization such as Sport Riders Association Club and American Motorcycle Association . Stringent dust control measures are practiced for the safety of the participants and spectators as well as residents of adjacent properties to proposed sight . Greeley, Colorado We are drafting this letter to correct several inco`r"rect statements made by Mr. Vince Frey at the August 28, 1985 hearing on his request for a Use by Special Review for a motorcross race track. In Mr. Frey's response to neighbors ' complaints of excess noise , he stated that a normal car produces noise at a level of about 80 decibels, while the motorcross bike produces a level of 120 decibels. Thus, he stated, the motorbike only makes twice the noise of a car. This is incorrect . Actually, a car produces 50-60 decibels according to the attached illustration. The bel scale (named- for Alexander Gra- ham Bell) is a logarithmic scale which shows that each increase of one bel (10 decibels) is an increase in intensity of 10 times. Using Mr. Frey's own figures, then, the motorbike produces 120-80=40 deci- bels (4 bels) higher noise than does a car. The intensity of noise , therefore , is 10 or 10, 000 times higher for the motorcross bike . If there are 30 bikes in each race , the noise level is 300,000 times higher than that produced by his 80 decibel car. (Note : the threshold of pain, i . e . , the intensity of sound which produces pain and results in permanent hearing loss, is also 120 decibels. ) So just how loud will these races be at the Haught residence?
