RE: DENIAL OF RECORDED EXEMPTION NO. 797 - JUAN MANUEL AND LYDIA
A. GALLEGOS
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners , pursuant to its
authority under Section 30-28-101 (10) (d) , CRS, as amended, did, at
a public meeting held in the Chambers of the Board, consider the
request of Juan Manuel and Lydia A. Gallegos for Recorded
Exemption No. 797 concerning property which is located on the NWa
SW', Section 23 , Township 1 North, Range 67 West of the 6th P.M. ,
Weld County, Colorado, and
WHEREAS, this request was to divide the property into parcels
estimated to be approximately 15 acres and 25 acres, and
WHEREAS, a motion was made to approve the request for
Recorded Exemption No. 797; however, the motion failed on a 2-3
vote, with Commissioners Brantner and Kirby voting aye and
Commissioners Lacy and Yamaguchi and Chairman Johnson voting nay;
therefore, the request was considered to be denied.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the request of Juan
Manuel and Lydia A. Gallegos for Recorded Exemption No. 797 be,
and hereby is, denied.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted on the 16th day of October, A.D. , 1985 .

Dear Commissioners:
This request for a recorded exemption is submitted by Juan Manuel and Lydia
A. Gallegos. The parcel of land on which this request is being made is
described as the BrOl. SW14, Section 23, T1N, R67W of the 6th P.M. , Weld
County, Colorado. The property is located 3.25 miles northwest of Brighton;
east of Weld County Road 21. The parcel of land under consideration is the
total contiguous land holdings of the applicant.
The request is to divide the property into parcels of 15 acres and 25 acres,
more or less. Mr. and Mrs. Gallegos wish to sell the proposed 25 acre lot
and retain the 15 acres as a new rural residential site. Soils on the
existing 40 acre parcel consist of Kim loam and Olney fine sandy loam, both
designated by the Soil Conservation Service as prime agricultural soils.
Nay end alfalfa are harvested on this property. Flood zone A occupies the
northeastern one-third of the 40 acre site. A field inspection and a parcel
identification map of the property revealed that the surrounding ate? Is
composed of large farm parcels and few residences.
Pased upon the submitted information and policies of the County, the
Department of Planning Services staff recommends the request be d nied for
the following reasons:

- The subject site is located in an Agricultural Zone
district outside of a projected town growth area. The
minimum lot size in the Agricultural Zone district is
eighty (80) acres for irrigated land and one hundred
sixty (160) acres for dryland. The further subdivision
of a 40 acre parcel into two (2) lots is inconsistent
with efficient and orderly development in the
agricultural Zone district outside of a projected town
growth area;
- The agricultural district is intended to provide areas
for the conduct of agricultural activities and
activities related to agriculture and agricultural
production without the interference of other,
incompatible land uses. The further subdivision of a 40
acre parcel could promote the interference of
incompatible land uses in the immediate area. The
majority of surrounding parcels exist as 80 to 120 acre
farms.
- The applicant has not demonstrated that the proposed use
will be compatible with the future development of the
surrounding area as permitted by the existing zone and
with future development as projected by the
Comprehensive Plan of Weld County. The Weld County
Future Land-Use Map indicates the type of development at
the subject location is intended to remain agricultural
and the zone district is intended to remain
agricultural.
As explained in the Comprehensive Plan on page forty-four (44) , "Scattered
development in rural areas has other implications. Residential development
in rural areas necessitates an increase of public service to that area. . ."
More people in the area places additional demand on expenditures for road
maintenance, police protection, fire protection, and educational services.
The cost of County services can be reduced if development is encouraged
around existing population centers and future town growth areas.
Development in town growth areas reduces the conflict that arises between
rural and urban land-uses.

One residence, across Weld County Road 21, is located within 1/4 mile of the
property.

Dear Ms. Dunn :
We have reviewed the above referenced proposal to separate approximately
40 acres into lots of 25 and 15 acres. The proposed 25 acre lot would be
served by what appears to be a late registered well , no. 87773. The
conditions of approval do not prohibit the issuance of an additional permit.
We could issue an additional householdase_only well for the proposed 15
acre tract after approval of the exemption. Since a well permit would be
available, we can recommend approval . The availability of a well permit and
our recommendation for approval is subject to the following conditions:
1 . The property has not been previously subdivided or exempted since
1972. We consider this as a one-time exemption and will not make
t%additional permits available for future splits of either tract.
2. The well permit which will be available will be limited to use inside
one single-family dwelling only. Outside use for Tawn and garden
irrigation or livestock is prohibited. Plat notes and covenants
should reflect this limitation.
3. The applicant should provide proof that an evaporative wastewater
system will not be required. We could not issue the well permit if
any evaporative system is required.
4. Prospective lot purchasers should be made aware of the limitations on
water use and other information contained in this letter. We
recommend that a copy of this letter be given to lot purchasers and
submitted with the well permit application.

We have turned the permit application, including the submittal , over to
our groundwater section. They will probably return it to the applicant for an
application fee and more information. In the future, we ask that permit
applications be submitted separately to our groundwater section after the
exemption is acted upon. We will not issue a permit until the county approves
the exemption.

Dear Mr. and Mrs. Gallegos:
The Department of Planning Services staff reviewed the above-referenced
proposal today. This application was denied because the staff feels that it
does not meet the criteria for approval as stated in Section 9-2 E. of the
Weld County Subdivision Regulations.
The existing 40 acre parcel in question is in an agricultural zone
surrounded by many larger parcels used for farming; few of these have been
split. Further division of the 40 acres does not appear to be compatible
with neighboring lot size.
This location is et least 3 miles from the nearest incorporated
municipality, Brighton. The Weld County Comprehensive Plan states that
urban-type growth should be discouraged in areas that are not within the
planned development area of an incorporated municipality. Ry granting a
recorded exemption on this property, a new residential site is created in a
location not served by city services.
When the Planning staff denies a land-use request, the applicant is allowed
to appeal the decision to the Board of County Commissioners. I have,
therefore, scheduled your application to be considered by the Board of
County Commissioners on October 16, 1985, at 9:00 a.m. It will be necessary
that you or a representative of the recorded exemption proposal be present
at the hearing.
