RE: APPROVAL OF REPLAT OF LOTS 7 AND 8 , BLOCK 4 , CARRIAGE ESTATES
SUBDIVISION
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, on the 30th day of January, 1985 , a public meeting
was held before the Board of County Commissioners of Weld County,
Colorado, regarding the application of Carriage Estates, c/o James
Ricketts, for replat of the following described property:
Lots 7 and 8 , Block 4 , Carriage Estates, First
Filing; located in part of the 141/2 Sigh, Section
24 , Township 5 North, Range 66 West of the 6th
P.M. , Weld County, Colorado.
WHEREAS , the Board of County Commissioners has studied the
request and recommendations of the Weld County Planning Commission
and, having been fully informed, is satisfied that the proposed
replat of the above described property conforms in all respects
with the requirements of the Weld County Subdivision Regulations.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the replat of the
above described real estate in Carriage Estates Subdivision be,
and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that this approval is
subject to the applicant complying with the following
requirements : 1) Construction of two one-hour firewalls between
the townhouses at the property line (i.e. , property walls) ; 2)
separate utilities shall be provided to each constructed townhouse
unit; and 3) submission of a resubdivision plat in accordance with
the applicable requirements of Section 6-1 and 6-2 of the Weld
County Subdivision Regulations to the Department of Planning
Services Office.

Moved by Doug Graff that the following resolution be introduced for passage
by the Weld County Planning Commission. Be it Resolved by the Weld County

POSSIBLE ISSUES SUMMARIZED FROM APPLICATION MATERIALS:
Requests for changes to lot lines which do not create additional lots or
affect public rights-of-way can be handled through Section 6-4B of the Weld
County Subdivision Regulations. Pages 36 and 37 of the Subdivision
Regulations have been included in your packet for your information.
The Utility Board Coordinating Committee reviewed and approved the Replat on
January 10, 1985.
The Evans Planning Commission will review this Replat at their January 15,
1985 evening meeting.
The Greeley Planning Commission recommended no objections to the Replat at
their January 8, 1985 meeting. Both the City of Greeley and the Weld County
Building Inspection Department have voiced concern over the common wall and
the need for adequate fire protection.
The Department of Planning Services has received several phone calls
inquiring about this case; no objections have been raised concerning this
proposal.

easements, such change or parcel shall be approved by the
procedures delineated below in this Section 6-4 except that
changes only affecting lot lines and which do not create
additional parcels or affect public rights-of-way for street or
drainage purposes shall utilize Section 6-4 B below.
1 v'' B. Requests for changes to lot lines which do not create additional

purposes require the following procedure:
1 (1) Submittal requirements:
r (a) An application form as prescribed and furnished by the
Department of Planning Services.
(b) A copy of a deed, purchase contract, or other legal
instrument indicating that the applicant has interest
in said property. The deed, purchase contract, or
legal instrument should include a complete and accurate
1 legal description of the property.
(c) A Utility Service Statement with signatures of
1 representatives of each municipality or utility company
involved to verify that existing and proposed easement
designs are adequate for the respective utilities if
the lot line(s) being relocated affect an easement for
' utilities.
(d) A letter of explanation detailing the situation
1 indicating the reason(s) why the request for the
resubdivision or vacation has been made. The letter
should address the revisions or vacation being
y requested as compared to the previously recorded plat.
11 (e) A copy of the existing recorded plat.
r (f) A map of either 81" X 14" or 24" X 36" in size (a map
prepared on the 24" X 36" size must be accompanied by 6
copies) prepared in accordance with the applicable
t requirements of Sections 6-1 and 6-2 of these
Subdivision Regulations. The Director of the
Department of Planning Services may waive any
non-applicable requirements.
(2) Review Procedure.
1 (a) Upon determination that an application is complete, the
Department of Planning Services shall place the request
on the first available scheduled Planning Commission
r meeting.

(b) In the event that a utility easement is affected, the
Department of Planning Services shall first place the
matter for review on the first available Utilities
Review Advisory Committee meeting before presenting the
request to the Planning Commission.
(c) The Board shall review the request within ten (10) days
of the Planning Commission action. If the Board
determines the request complies with the applicable
requirements of those regulations, they shall endorse
on the plat in the space provided.
(d) The map shall be recorded as provided in Section 6-3E
of these Subdivision Regulations.
C. Requests for resubdivision for the purpose of redesign, addition
of new lots, or vacation of all or portions of a subdivision
shall be subject to the resubdivision submittal requirements of
the 6-4D below. These revisions shall be submitted to the
Planning Commission and Board of County Commissioners for their
review. The request shall be reviewed in accordance with
Section 6-3 of these regulations.
D. The applicant shall submit to the Office of the Department of
Planning Services the following items with the appropriate fee
for a request for a resubdivision or vacation in the 1
unincorporated area of Weld County, Colorado:
(1) An application form as prescribed and furnished by the
Department of Planning Services.
(2) A copy of a deed, purchase contract, or other legal
instrument indicating that the applicant has interest in
said property. The deed, purchase contract, or legal
instrument should include a complete and accurate legal
description of the property.
(3) 12 copies of a plat showing the existing lot divisions and
the proposed lot changes in accordance with the Final Plat
drawing requirements of Section 6. 1.B. of the Subdivision
Regulations.
(4) A Utility Service Statement with signatures of
representatives of each municipality or utility company
involved to verify that existing and proposed easement
designs are adequate for the respective utilities.
(5) A letter of explanation detailing the situation indicating
the reason(s) why the request for the resubdivision or
vacation has been made. The letter should address the
revisions or vacation being requested as compared to the
previously recorded plat.

COMMENTS:
The subject site is in a Residential-Four (High Density) Zone District and
covers approximately one-fourth (4) acre. The site has been excavated for
two (2) townhouses, and footings for the foundation have been set.
Approximately thirty-five (35) feet would separate the existing structure to
the south from the proposed construction. Access is to Park View Drive, a
paved street. Curbs, gutters, and sidewalks are present in the subdivision.

The City of Greeley' s Planning Commission reviewed the Subdivision Replat
of Lots 7 and 8, Block 4, Carriage Estates submitted by Jim Ricketts at
the January 8, 1985 , meeting . The Commission recommended no objection to
this replat . The Commission noted that if the units to be constructed on
these lots are to be sold to separate owners that separate utilities and
adequate fire separations between units should be provided .

The Weld County Planning Commission will conduct a public hearing on
Tuesday, January 22, 1985 at 1:3O p.m. to review a request
for approval of a Replat of Lots 7 & 8, Block 4, Carriage Estates
Subdivision for James and Kathleen Ricketts
on a parcel of land described as Lots 7 & 8 , Block 4, Carriage Estates
Subdivision, 1st Filing; Pt. W1 5A, Section 24, T5N, R66W of the
6th P.M. , Weld County, Colorado.

This public hearing to be held by the Weld County Planning Commission
for the consideration of the above referenced request will be conducted
in the Weld County Commissioners' Hearing Room, First Floor, Weld
County Centennial Center, 915 10th Street, Greeley, Colorado. Comments

To whom it may concern;
This letter is an explanation detailing the situation indicating the
reason why I wish to replot lots 7 and 8, in Block 4, of Carriage Estates.
Lot 8 has been divided into two parcels, a North and a South parcel .
The South parcel has a building on it. I purchased the North parcel .
This parcel of Lot 8 in its present state is not usefull . Combining
the North parcel of Lot 8 and part of Lot 7 makes sense for use as a
dwelling. I want to build a duplex townhouse on replotted Lots 8 & 7.
By moving the exsisting North Lot line of 8 to the requested position
and maintaining a common wall between the duplex townhomes I could then
deed off as two residences.
This request is similar to the previous replotting of the fourolex
adjacent to the south boundary of my property in which four deeds can
be conveyed from residences that have cotton walls.
This replot would give Lot 8-9 409 sq. ft. and Lot 7-8 871 sq. ft. This
is ample footage even for R-1 zonning.
This is the best and highest usage for the property.
I courteously request that this rePot request be approved.
