SITTINGDOWN WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners of Weld County, Colorado, on the 30th day of November, 1988 , considered the request of Richard K. and Doris J. Sittingdown for a mobile home to be used as a principal dwelling, and WHEREAS, said mobile home is to be occupied in an A-Agricultural Zone District on a parcel of land being more particularly described as follows : Lot 5, Block 41 , Aristocrat Ranchettes Subdivision, Second Filing, Weld County, Colorado WHEREAS, the Board of County Commissioners, having heard the testimony, finds that said request should be granted subject to the following conditions: 1) The applicant shall obtain a building permit for the mobile home within thirty days from the date of approval by the Board of County Commissioners; 2) A septic permit shall be obtained and the site shall meet percolation test requirements prior to the issuance of a building permit; and 3) Prior to the issuance of a building permit, the owner shall submit evidence that Aristocrat Ranchettes Water Project is supplying water in such a manner as to be adequate in quality, quantity, and dependability for the proposed use. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the request of Richard K. and Doris J. Sittingdown This request is for one mobile homes to be used as a principal dwelling -Legal Description of Parcel: Lot 5, Block 41, Aristocrat Ranchettes Subdivision, Second Filing, Weld County, Colorado. Location: Approximately one mile north of the City of Fort Lupton The Department of Planning Services staff has reviewed this request and recommends that the request be approved for the following reasons: WILL WILL NOT X Be compatible with the Weld County Comprehensive Plan. X Be compatible with the surrounding area. X Be in harmony with the character of the neighborhood. g Adversely affect the immediate area. X Be adequately served by water and sewage disposal facilities. X Adversely affect the general health, safety, and welfare of the inhabitants of the area and the County. COMMENTS: This zoning permit for a principal dwelling is submitted for an existing mobile home on the lot. The records of the Department of Planning Services show no zoning permit has ever been issued for this lot. A violation notice was issued for this property when the applicant applied to replace an existing mobile home in November, 1987. The Weld County Attorney's office and the applicant agreed that if the applicant would apply for this zoning permit, the Department of Planning Services would state as part of our recommendation of approval, that this permit is to replace a permit of which there is no record, but which the applicant indicates was approved in 1969. The petition submitted by the applicant as part of the application did not contain the signatures of at least 70% of surrounding property owners. The Department of Planning Services' staff has not received any objections from any of the surrounding property owners. 881118 ZPMH-1481 -Richard and Doris U.
