RE: APPROVE CHANGE NUMBER 1 TO HAZARDOUS MATERIALS EMERGENCY
RESPONSE PLAN
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board did, by Resolution dated October 23 , 1985 ,
approve a Hazardous Materials Emergency Response Plan, and
WHEREAS, the Board has been presented with Change Number 1 to
said Plan, and
WHEREAS, after review, the Board deems it advisable to
approve said Change, a copy being attached hereto and incorporated
herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that Change Number 1 to
the Hazardous Materials Emergency Response Plan be, and hereby is,
approved.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 7th day of
September, A.D. , 1988 .

IX. CONCEPT OF OPERATIONS
J. Disposal of Hazardous Material
1. All clean-ups and disposals will be done in accordance with applicable
Federal, State and County Laws.
2. In the event the spill is on a federal, state or county roadway the
Colorado State Patrol will be responsible for disposal(29-22-102(c))
per their Standard Operating Proceedure.
3. In the event the spill is on public or private land and the spiller is
known the responsibility of disposal will be that of the spiller.
4. In the event the spill is on public or private land and the spiller is
not known the responsibility of the disposal of the hazardous substance
is on the landowner.
5. Private industry accidents involving hazardous substances will be the
sole responsibility of the private industry for disposal of the
hazardous substance.
6. The incident commander will stabilize the incident and contain the
spill, if possible, and then turn the scene over to the appropiate
responsible party.
7. Disposal will be supervised by the Weld County Health Department and
the appropiate State and/or Federal Agency.
