RESOLUTION RE: APPROVE SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW PERMIT FOR A LIVESTOCK CONFINEMENT OPERATION (600 HEAD MAXIMUM CAPACITY DAIRY) - BILLY AND PATRICIA SHUTTS WHEREAS, the Board of County Commissioners of Weld County, rolorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 14th day of September, 1988 , at the hour of 2:00 p.m. in the Chambers of the Board for the purpose o₹ hearing the application of Billy and Patricia Shutts, 8217 South County Road 5 , Fort Collins, Colorado 80525 , for a Site Specific Development Plan and Special Review Permit for a livestock confinement operation (600 head maximum capacity dairy) on the following described real estate, to-wit: Part of the Si of the NW} of Section 18 , 'Township 6 North, Range 67 West of the 6th R.M. , Weld County, Colorado WHEREAS, Billy Shutts, one of said applicants was present, and WHEREAS, Section 24 . 4 .2 of the Weld County Zoning Ordinance provides standards for review of said Special Review Permit, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons : 1 . The submitted materials are in compliance with the application requirements of Section 24 . 7 of the Weld County Zoning Ordinance. 2 . It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 2-4 .4 .2 of the Weld County Zoning Ordinance as follows: a. The proposed Special Review site is within the Town of Windsor' s Urban Growth Boundary Area and is consistent with the Weld County Comprehensive Plan ' s Urban Growth Boundary Goals and Policies. Windsor' s Comprehensive Plan designates this area n` - <7 -7; �' 'f 880907 Page 2 RE: USR - BILLY _AND PATRICIA SHUTTS as an open urban growth area. On August A , 1988 , the Town of Windsor' s Planning Commission recommended favorably on this proposal. b. The proposal is consistent with the intent of the district in which the use is located. The Agricultural Zone District is established to maintain and promote agriculture as an essential feature of Weld County. The Agricultural Zone District is intended to provide areas for agricultural activities without the interference of other incompatible land uses . The proposed use is provided for as a Use by Special Review. c. The proposed use is compatible with the existing surrounding land uses . They include the agricultural production of corn, sugar beets , and beans . The use will be compatible with the future development of the surrounding area as permitted by the Agricultural Zone District. Special Review Permit Development Standards will ensure compatibility with the surrounding land uses . d. The applicant has demonstrated a diligent effort to conserve productive agricultural land in the locational -decision for the proposed use. e. No overlay districts affect the site. f. Special T eview Permit Development Standards will provide adequate protection of the health, safety and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Poard of County Commissioners of Weld County, Colorado, that the application for a Site Specific Development Plan and Special Review Permit for a livestock confinement operation (B00 head maximum capacity dairy) on the hereinabove described parcel of land be, and hereby is, granted subject to the following conditions: 1 . The -attached Development Standards for the Special Review Permit shall be adopted and placed on the Special Review plat prior to recording the plat. The plat shall be delivered to the Department of Planning Services and be ready for recording in the office of the Weld County Clerk and Recorder within 15 days of approval by the Board of County Commissioners. 880907 Page 3 RE: USR - BILLY AND PATRICIA SHUTTS 2 . The Special Review activity shall not occur nor shall any building or electrical permits be issued on the property until a Special Review plat is ready to be recorded in the office of the Weld County Clerk and Recorder. 3 . Within 60 days of approval by the Board of County Commissioners , the applicant shall submit evidence to the Department of Planning Services Office that the facility is in conformance with the Colorado Guidelines for Feedlot Runoff Containment Facilities. 4 . An ISDS Evaluation shall be necessary prior to the issuance of the required septic permits on the existing systems. The Site Specific Development Plan and Special Review Permit is for a livestock confinement operation (600 head maximum capacity dairy) as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated herein. 2 . Approval of this plan may create a vested property right pursuant to Article 68 of Title 24 , C.R.S. , as amended. 3. The applicant shall be responsible for compliance with the Colorado Guidelines for Feedlot Runoff Facilities as well as any additional requirements issued by the Colorado Department of Health, Water Quality Control Division. 4 . The applicant shall comply with all State Health Department requirements for construction and operation of a dairy. 5 . All construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 6 . The property owner or operator shall be responsible for complying with the Design Standards of Section 24 .5 of the Weld County Zoning Ordinance. 7 . The property owner or operator shall be responsible for complying with the Operation Standards of Section 24 .6 of the Weld County Zoning Ordinance. 8 . The applicant shall remove, handle, and stockpile manure from the livestock confinement area in a manner that will prevent nuisance conditions. The manure piles shall not be allowed to exist or deteriorate to a condition that facilitates excessive odors , flies, insects, pests, or pollutant runoff. The manure storage site shall have a water-tight surface which does not permit seepage or percolation of manure pollutants into the ground. 9 . No permanent disposal of wastes shall be permitted on this site. 880907 Page 2 DEVELOPMENT STANDARDS - SHUTTS 10. An individual sewage disposal system is required for the proposed mobile home. The septic system shall be installed according to the Weld County Individual Sewage Disposal Regulations . 11 . Personnel from the Weld County Health Department and Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to ensure the activities carried out on the property comply with the Development Standards stated herein and all applicable Weld County Regulations . 12 . The Special Review area shall be limited to the plans shown herein and governed by the foregoing Standards and all applicable Weld County Regulations. Major changes from the plans or Development Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans or Development Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 13 . The property owner or operator shall be responsible for complying with all of the foregoing Development Standards. Lee Morrison, Assistant County Attorney, made this matter of record. Rod Allison, Planning Department representative, entered the favorable recommendation of the Planning Commission into the record. Billy Shutts, one of the applicants, came forward to explain this request. He said he has been operating a dairy at this site for about six years and recently learned that a Special Review Permit was necessary. He stated that he has no problem with the proposed Conditions and Development Standards. No public testimony was offered concerning this request. Commissioner Lacy moved to approve the request of Billy and Patricia Shutts for a Site Specific Development Plan and Special Review Permit, subject to the Conditions and Development Standards recommended by the Planning Commission. The motion, seconded by Commissioner Yamaguchi, carried unanimously. This Certification was approved on the 19th day of September, 1988. F8091141 July 8 , 1988 Weld County Commisioners and planning Staff 915 10th Street Greeley, CO 80631 We are requesting a use by special review for our dairy operation consisting of approximately 15 acres of our 53 acre farm located at 6427 Weld County Road 68 1/2. A dairy has operated at this site for the past 25 years. We purchased the farm in 1981 at which time the herd consisted of 350 head of cattle. Due to economic conditions we have gradually increased the size of the herd from 350 to approximately 600 head , of which only 350 are mature cows. The balance are calves under 6 months old . The intermediate cattle are kept on adjacent farms and used to replace dry cows which are eventually slaughtered . The only changes we are proposing are to add an additional mobile home to accomodate an assistant herdsman. Currently the house is occupied by our herdsman and the exsisting mobile home is occupied by a milker . We have been in the dairy business for 39 years now, and feel this dairy is essential to maintain our livlihood. The surrounding uses are not of the same magnitude as ours , but are certainly similar in use. To the North, East and South are irrigated farms with small feed lot operations. To the West are two small acreages with dwellings, one of which does maintain several head of livestock. The distance from the dairy to the surrounding residences are as follows: 2 residences approximately 1/2 mile West; 1 residence approximately 1/2 mile North; 1 residence approximately 1/3 mile East. As for the types and frequency of vehicles associated with this operation; we have a milk tanker which comes on a daily basis, Semi trucks containing feed delivered on a bi-weekly schedule, feeder trucks which are used to disperse the feed to the cattle twice a day, four employees which commute to the farm eveyday, and several salesman that call on us every week. For a two week period during harvest time, we have as many as 20 loads of silage hauled to the silage pits per day. The majority of this traffic utilizes the following access route: State Highway 392 to County Road 15 (paved) 1/2 mile North to county Road 68 1/2 (gravel) 1/2 mile West to the Dairy. This dairy employs six fulltime employees and several part- time seasonal employees during the harvest time. There are three daily milking shifts beginning at 4 :00 A.M. and again at 12 Noon and 8 :00 P.M. Each shift operates for 6-7 hours. 8809°? All deliveries are done during normal business hours. The existing house and mobile home are served by North Weld County Water District as would be the proposed mobil home . (See attached letter of commitment from Weld County Water District. ) The existing dwellings have seperate septic tanks with leech fields as would the proposed mobile home. Most of the flammable materials are kept in isolated areas away from the buildings including haystacks and fuel tanks. In the event of a fire we are located within 2 miles of the Windsor—Severance Fire Station, which is well known for it' s quick response time. Presently both dwellings are landscaped with a variey of trees and bluegrass lawns. We would also provide this type of landscaping for our proposed mobile home . All the cattle pens are cleaned and harrowed weekly . The manure is stockpiled on about an acre on the North side of the dairy and spread on adjacent fields twice a year . The liquid wastes generated by cleaning the barn are piped to a settling pond North of the dairy where any solids settle out. The liquids then run in an open ditch to the Northeast corner of the farm where a tail water pond exists. (size 100' x 45' x 8 ' deep) . This water is then diluted and pumped back to the top of the fields and used for irrigation. All other trash disposal is handled by dumpster located near the barn and is emptied once a week. This proposal is consistent with the Weld County Comprehensive Plan in the following ways 1.) The dairy operations encompasses approximately 15 acres of the farm. The remaining 38 acres are still used for crop production. 2 .) It does create employment within the agricultural district by providing Seven fulltime positions and several part—time seasonal positions. The existing dairy operation has no history of safety problems.
