HomeMy WebLinkAbout860228.tiff RESOLUTION RE: APPROVE CONTINUANCE OF SHOW CAUSE -HEARING TO CONSIDER REVOCATION OF USE RY SPECIAL REVIEW 46_86 ISSUED TO BERNARD AND CHERYL HOOGLAND WHEREAS, the -oarr of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on February 26 , 1986 , a Show Cause Hearing was conducted to consider revocation of Use by Special Review 4686 issued to Bernard and Cheryl Hoogland, and WHEREAS , the Board deems it advisable to continue said hearing one week, until March 5 , 1-986 , -to allow the Hooglands time to comply with Development Standard #2. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Show Cause Rearing to consider revocation of Use by Special Review U86 be, and hereby is, continued to March 5 , 198-6 , -at 2: 00 p.m. , to allow Bernard and Cheryl Roogl-and time to come into compliance with Development Standard 42 . The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 26th day of February, A.D. , 1-986 . Brantner C County Atto ney ✓ / jsa Frank Yamaguc //. ! , 8_60228 HEARING CERTIFICATION DOCKET NO. 86-7 RE: SHOW CAUSE HEARING TO CONSIDER REVOCATION OF USE AY SPECIAL REVIEW #686 — BERNARD AND CHERYL HOOGLAND A public hearing was conducted mn February 26, 1986, at 2:00 P.M. , with the following present: Commissioner Jacqueline Johnson, Chairman Commissioner Gordon E. Lacy, Pro-Tem Commissioner Gene Brantner Commissioner C.W. Kirby Commissioner Frank Yamaguchi Also present: Acting Clerk to the Board, Mary Reiff Assistant County Attorney, Lee D. Morrison Planning Department representative, Keith Schuett The following business was transacted: I hereby certify that pursuant to a notice dated January 22, 1986, and duly published February 13, 1986, in the Johnstown Breeze, a public hearing was conducted to consider revocation of Use by Special Review #686, issued to Bernard and Cheryl Hoogland. Lee Morrison, Assistant County Attorney, made this-matter of record and outlined the procedures to be followed in a hearing of this nature. Keith Schuett, Planning Department representative, presented the Board with copies -of a letter from Jansma Brothers Excavation and Trucking Corporation and memorandums from the Planning Department regarding comments from staff members of the Longmont Soil Conservation District and his recent inspection of the property which indicated that the Hooglands are not in compliance with certain Development Standards. Bernard Hoogland came forward to -explain his situati-on to the -Board. He stated that the weather has not allowed him to have a contractor complete the berming, and neither the Soil Conservation District nor the Health Department can sign the documents to to submitted to the Planning Department until after the berming is completed. After discussi-on, it was the consensus of the Board that persons in the audience should be allowed to speak, with the comments to be limited to only those areas -which were mentioned in the notice Af hearing. Ardon Hopkins came forward and commented regarding possible noncompliance of Development Standard #3, which was not being considered at this hearing. Commissioner Lacy moved to allow the Hooglands until March 26, 1986, to come into compliance on Development Standards #2, 6, 11 and 12. The motion was seconded by Commissioner Kirby; however, -it failed on a roll mall vote, with Commissioners Lacy and Kirby voting aye and Commissioners Brantner and Yamaguchi and Chairman Johnson voting nay. Mr. Morrison -suggested that the Board review the violations individually. During discussion, it was state-d that other violations exist due to the failure to comply with Development Standard #2. Commissioner Brantner moved to find that the Hooglands are in vi-olation of Development Standards #2, 6, 11 and 12. The motion was seconded by Commissioner Kirby and carried unanimously. The Board asked Mr. Hoogland to explain the amount of work which must be done to come into compliance. (TAPE CHANGE #86-14) Following Mr. -Hoogland's explanation, Commissioner Kirby moved to continue this hearing one week, with the expectation that the actual work will be completed during this period of time.
