RE: APPROVE RENTAL REHABILITATION PROGRAM APPLICATION TO BE
SUBMITTED TO THE COLORADO DIVISION OF HOUSING AND AUTHORIZE
CHAIRMAN TO SIGN
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with an application for
Rental Rehabilitation Program funds, said application to be
submitted to the Colorado Division of Housing, and
WHEREAS, after study and review, the Board deems it advisable
to approve said application, a copy of which is attached hereto
and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the application to be
submitted to the Colorado Division of Housing for funds for the
Rental Rehabilitation Program be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chairman be, and
hereby is, authorized to sign said Application.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 22nd day of
November, A.D. , 1989 .

dollars. The WCHA will manage both the rehabilitation of the units
and the administration of housing vouchers/certificates.

PART III: NEIGHBORHOOD PROFILE

Complete and attach the Neighborhood Profile analysis that is provided with
this Request for Funding. Remember to complete a Profile for each neighborhood
targeted. If the neighborhood has not been selected, attach a narrative
describing the procedures or methods which the city intends to use in selecting
a target neighborhood(s) . Refer to the Division's Rental Rehabilitation
Program Design. a

PART IV: • PROJECT .DESCRIPTION_
Attach a narrative describing what procedures and standards to be used in
selecting projects ( i . e. : , individual buildings) . Refer to the Division's
Rental Rehabilitation Program Design. If you have a waiting list of selected
projects, please attach and include the number of units in each project, the
rental rehabilitation, amount and the total estimated project cost.

PART V: LOWER INCOME BENEFIT
Attach a narrative explaining how the city intends to fulfill the lower income
benefit requirements of the program (section 511 . 10) . Refer to the Division's
Rental rehabilitation Program' Desian.

PART VI: FINANCIAL DESIGN
The Division will accept the following financing techniques for use in the
Rental Rehabilitation Program:

cl1J Deferred Payment Loan with Forgiveness (essentially, a grant) .
Deferred Payment Loan with specific terms and conditions for repayment.
. 3. Below Market Interest Rate Loan.

You may use one or all of the above financing techniques.
Please indicate which technique(s) will be used. If numbers 2 or 3 will be
used, indicate the terms, conditions, and interest rates being considered.
Also indicate the city's plan for use of interest generated from the loans
(program income) .
List names and addresses of lenders who have indicated a willingness to
participate in the program. Note if any firm commitments have been received.
If lenders have not been identified, describe how the program will be marketed
to lenders.
Program participants are responsible for securing their funding through any means
they choose. The WCHA shall not participate in assisting applicants with securing
their match funds.
PART VII: IMPLEMENTATION SCHEDULE
The federal regulations require that the state have 100 percent of its funds
committed within 15 months of the execution of the grant agreement, which for
1963 funds would be July, 1990. Obviously, due to this time frame, the state
is interested in projects that are ready to move quickly.
Explain how your project(s) will meet this goal and outline your project
completion schedule.
As the WCHA has many of the units proposed for rehabilitation already identified,
meeting the fund-commitment deadline will pose no problem. We expect to have • .
50% to 75% of funds committed by 30 March 1990, and the program should be completed
by 30 June 1990.
PART VIII: TENANT ASSISTANCE POLICY
Cities must adopt the Division' s Tenant Assistance Policy, amending the Policy
as needed to account for local directives, policies, or concerns. The amended
Tenant Assistance Policy must be adopted within thirty (30) days of the
submission of the Request for Funding Proposal and a copy of the adopted policy
sent to the Division of Housing. A model TAP will be provided at the
Application Workshop. The WCHA will comply with the Tenant Assistance Policy as
outlined by the Colorado Division of housing. The TAP will be adopted and presented

execution with the state DOH.

PART IX: . AFFIRMATIVE MARKETING
Attach a narrative describing the methods and procedures that will be used to
ensure the affirmative marketing of rehabilitated units, plans for assessing
the owner's affirmative marketing efforts, and the corrective actions that will
be taken if an owner fails to follow affirmative marketing procedures. Refer
to the Division's Rental Rehabilitation program Design. A copy of the Division
affirmative marketing guide lines is enclosed.

ATTACHMENT A
• CERTIFICATIONS
•
The zAty/town / county of Weld hereby
assures and certifies that:
It possesses the legal authority to administer the Rental Rehabilitation
Program as described in 24 CFR Part 511 and that the submission of this
proposal is authorized by the city/town/county.
It has developed this proposal after consultation with the public and copies of
this proposal have been made available to the public.
It will adopt a Tenant Assistance Policy, which will reflect local directives,
policies, and concerns, and will submit to the Division of Housing a copy of
the amended Policy within thirty (30) days of the execution of a RRP contract
with the Division of Housing.
It will ensure that the city/town/county will conduct and administer its Rental
Rehabilitation Program in conformance with the requirements of section
551 . 10(m) , Affirmative Marketing.
It will submit to the Division of Housing for its approval a local affirmative
marketing strategy within sixty (60) days of execution of a RRP contract with
the Division of Housing.
It will conduct and administer its Rental Rehabilitation Program in accordance
with the requirements of 24 CFR 511 .

Part IV. Project Description
Applicants expressing an interest in participating in the Rental Rehabilitation
Program, who are owners of record of the properties they wish to rehabilitate, and
who have the ability to provide or secure match funds,are eligible for the
Rental Rehab Program, administered through the WCHA.
Applicants in the communities of Nunn, Ault and Hudson have expressed
interest in rehabilitating a total of approximately fifteen two- and three-
bedroom units.
Once eligibility has been established, the WCHA looks to the feasibility of
a project. This is determined by data based on inspections conducted by the
WCHA's Rehab Specialist and the locality's building inspector, and information
regarding the property's value, equity, the costs of repair, and the potential
of tenant displacement (due to the possible higher rent inflicted to cover
debt service, operating expenses, and profit) .
The WCHA's Rehab Specialist shall conduct frequent inspections to ensure
code compliance, and that rehabilitation is completed according to the owner's
description of work. The owner is responsible for hiring and supervising his/
her own general contractor, subcontractors and suppliers. The WCHA's inspections
will also serve as progress-payment inspections. Projects must be inspected and
finaled building permits, as well as lien waivers, must be submitted prior to
disbursal of final payment.

1) Judy Hobart, Nunn, 5 units, $37,500;
2) Robert Masden, Hudson, 5 units, $25,000;
3) Everett Wilson, Ault, 5 units, $37,500.

Part V. Lower Income Benefit
The WCHA has identified most of the properties that are to be rehabilitated.
Once a property is identified, it is the policy of the WCHA to survey each
unit to identify the low-income tenants, those who may be eligible for Section
8 subsidies, those who wish to remain in residence during rehab activites, and
those who must be temporarily relocated.
After rehab of the properties has been completed, Section 8 Vouchers and
Certificates shall be utilized in the following manner:
1) Current low-income tenants shall be allowed to maintain residency
in their newly rehabbed units;
2) Relocated tenants shall be able to continue to utilize their Section
8 subsidies; and/or
3) Applicants on the Section 8 waiting list shall be allowed to occupy
any vacant rehabilitated units.
Because the WCHA is both the sub-recipient for the rehabilitation program, and
the agency responsible for the Section 8 Rental Assistance Program, the low-income
benefit activities shall be monitored very closely.

Part IX. Affirmative Marketing
To ensure compliance with all federal fair housing laws by all agencies and
persons involved with the Rental Rehab Program, the WCHA shall adhere to the
affirmative marketing guidelines as set forth by the Colorado Division of Housing.
The following methods for informing the public shall be employed:
1) use of the Equal Housing Opportunity logo in publications
(required of owner participants for marketing rehabbed units) ;
2) distribution of HUD's Fair Housing USA brochure;
3) outreach to local media and community groups; and
4) posters and signs explaining the programs.
The WCHA shall monitor and record information regarding racial, financial and
gender characteristics of tenants who occupy pre-rehab and post-rehab units.
The same information shall be obtained regarding participating owners and their
contractors. This data shall be made available for public review at the WCHA offices.
