RE: APPROVE REPLAT OF LOTS 1-6 , BLOCK 5 , AND VACATION OF PORTIONS
OF HARRISON STREET AND THE ALLEY IN BLOCK 5 , TOWN OF ROGGEN -
SOUTHEAST WELD FIRE PROTECTION DISTRICT
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, on the 10th day of December, 1986 , in a public
meeting, the Board considered the request of the Southeast Weld
Fire Protection District for a replat of Lots 1-6, Block 5 , and a
vacation of portions of Harrison Street and the alley in Block 5,
Town of Roggen , and
WHEREAS, the Board reviewed the submitted evidence and heard
the testimony of those present , and
WHEREAS, the Board , having considered the recommendation of
the Weld County Planning Commission , finds that the request
concerning the aforementioned lots, street, and alley in the Town
of Roggen shall be approved for the following reasons:
1. The submitted materials are in compliance with the
application requirements of Section 6-4 B. of the Weld
County Subdivision Regulations.
2. It is the opinion of the Board of County Commissioners
that the resubdivision conforms with the requirements of
Section 6-4 E. of the Weld County Subdivision
Regulations for the following reasons:
a. No lots are being created that are less than the
minimum requirements for area and dimension as
established by the Weld County Subdivision
Regulations. Six lots are being combined into one
lot.
b. Drainage easements or rights-of-way reserved for
drainage will not be altered.

c. The proposed plat will not adversely affect the
character of the Town of Roggen , as filed.
3. The following referral entities have reviewed this
request and set forth no objections:
a . Weld County Health Department
b. Weld County Engineering Department
4. The Weld County Utilities Coordinating Advisory
Committee recommended approval of this request at its
meeting on November 20 , 1986.
WHEREAS, the Board' s approval is subject to the following
conditions:
1 . No building or electrical permits shall be issued on the
property until the resubdivision plat has been delivered
to the Department of Planning Services Office and the
plat is ready to be recorded in the office of the Weld
County Clerk and Recorder.
2. Prior to recording the resubdivision plat, the Gullets,
Prestons, and Glenns shall convey a quiet title by quit
claim deed to the Southeast Weld Fire District by
conveying one-half of the alley between Blocks 5 and 6
to the east of Lot 25 and the west of Lot 17.
3. The septic system for the proposed fire station shall be
required to be designed by a Colorado Registered
Professional Engineer according to the Weld County
Individual Sewage Disposal Regulations as required by
the Weld County Health Department in its memorandum
dated November 24, 1986 .
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the request for the
replat of Lots 1-6, Block 5 , and a vacation of portions of
Harrison Street and the alley in Block 5 , Town of Roggen, be, and
hereby is, approved subject to the above listed conditions.

RESOLUTION OF RECOMMENDATION TO THE BOARD OF COUNTY COMMISSIONERS
Moved by Paulette Weaver that the following resolution be introduced for
passage by the Weld County Planning Commission. Be it Resolved by the Weld
County Planning Commission that the application for:

recommended approval of this request at its meeting on November
20, 1986.
This recommendation is based, in part, upon a review of the application
submitted by the applicant, other relevant information regarding the
request, and the responses of the referral entities which have reviewed this
request.
The Planning Commission's recommendation for approval is conditional upon
the following:
1. No building or electrical permits shall be issued on the
property until the resubdivision plat has been delivered to
the Department of Planning Services' office and the plat is
ready to be recorded in the office of the Weld County Clerk
and Recorder.
2. Prior to recording the resubdivision plat, the Gullets,
Prestons, and Glenna shall convey a quiet title by quit claim
deed to the Southeast Weld Fire District by conveying
one-half of the alleys between Blocks 5 and 6 to the east of
Lot 25 and the west of Lot 17.
3. The septic system for the proposed fire station shall be

Disposal Regulations as required by the Weld County Health

The Planning Commission also recommends that since there are no improvements
for the applicant to install or guarantee that the requirement to submit a
subdivision improvements agreement required by Section 11 of the Weld County
Subdivision Regulations be waived by the Board of County Commissioners.

The Brighton Soil Conservation District did not respond to the referral sent
to it.
One letter in favor of the proposal was received from a surrounding property
owner within 500 feet of the property under consideration.
The Department of Planning Services has not received any objections to the
proposal.

APPEARANCE:
Colleen Parsley, Attorney, Frank Hill and Associates, represented the
applicant. The Southeast Weld Fire Protection District is a volunteer fire
district. They plan to combine lots 1-6 and extend north to include the
alley and east to include Harrison Street which they are asking to be
vacated. The people who own property on these streets will still have
adequate access to their properties. The Fire Protection District intends
to erect a building on this site and will need additional parking for events
that will be taking place in the building.
Lee Morrison suggested quit claim deeds should be obtained from the owners
of the property.

AMENDMENT:
Louis Rademacher moved Condition #2 be replaced with the following:
"2. Prior to recording the resubdivision plat, the Gullets,
Prestons, and Glenns shall convey a quiet title by quit claim
deed to the Southeast Weld Fire District by conveying
one-half of the alleys between Blocks 5 and 6 to the east of
Lot 25 and the west of Lot 17.

The Chairman asked that reading of the recommendations and conditions into

permanent record of these proceedings.
MOTION:
Paulette Weaver moved Case Number S-271:86:16 for Southeast Weld Fire
Portection District for a replat of Lots 1-6, Block 5, and a vacation of
portions of Harrison Street and the alley in Block 5 in the Town of Roggen
be forwarded to the Board of County Commissioners with the Planning
Commission's recommendation for approval based upon the recommendations as
outlined by the Department of Planning Services staff, the conditions as
outlined by the staff and amended by the Planning Commission, and the
testimony heard by the members of the Planning Commission. Motion seconded
by Ann Garrison.
The Chairman called for discussion from the members of the Planning
Commission. Discussion followed.
The Chairman asked the secretary to poll the members of the Planning
Commission for their decision. Paulette Weaver - yes; Louis
Rademacher - yes; Ivan Gosnell - yes; Ann Garrison - yes; Jack Holman - yes.
Motion carried unanimously.
ADDITIONAL BUSINESS:
Consider endorsement of the City of Greeley's revised Comprehensive Plan.
Steve Hill, City Planner, stated he would like the Planning Commission to
approve a resolution recommending approval to the Board of County
Commissioners for approval of the City's proposed Comprehensive Plan. He
feels the Comprehensive Plan is compatible with the County's.
The Planning Commission asked that the City of Greeley keep them better
informed about possible annexations and plans which the City has that take
place within the three mile area included in the County's Comprehensive
Plan.
Steve Hill reported they could send referrals to the County, the same as the
County does to them, to let them now what is going on. If there are any
problems with interpretation in the beginning he asked that their Department
be contacted for further information.

Engineer according to the Weld County Individual Sewage
Disposal Regulations as required by the Weld County Health
Department in its memorandum dated November 24, 1986.
The staff also recommends that since there are no improvements for the

Southeast Weld Fire Protection District Street Vacation
Dear Staff Members:
Southeast Weld Fire Protection District is applying for approval of a Street
and Alley vacation. The District intends to build a new fire house on its
premises and is in need of more land around the structure to accomodate access
by the fire trucks and other emergency equipment vehicles.
Additionally, the District seeks to obtain more area surrounding the new
structure to accomodate parking for the numerous community events to be held
at the Fire Station.
It is with these purposes in mind that Southeast Weld Fire Protection District
submits its application for Roggen Resubdivision No. 1. The proposal therein
includes vacating Harrison Street to the east of the District's property as
well as the Alley to the north.
