THE DEPARTMENT OF PLANNING SERVICES STAFF RECOMMENDS THAT THIS REQUEST BE APPROVED FOR THE FOLLOWING REASONS: 1 . The submitted materials are in compliance with application requirements of Section 24.7 of the Weld County Zoning Ordinance. 2. It is the opinion of the Department of Planning Services staff that the applicant has shown compliance with Section 24.3 of the Weld County Zoning Ordinance as follows: - All mineral resources are fixed in location. The mineral extraction industry is, therefore, restricted in its operation to those areas where the resources lay. The subject site is zoned R-1 (low density residential) , but is not platted for residential development. The Comprehensive Plan policies encourage mineral extraction prior to development. Residential development on the subject site could reduce the feasibility of ever developing the minerals in question. Therefore, the proposal is consistent with the policies of the Weld County Comprehensive Plan; - The proposal is allowed as a Use by Special Review in the R-1 (low density residential) zone district; - The Greeley Planning Commission has recommended no objection to this proposal. Their concerns, however, are addressed in the Development Standards; - The attached Development Standards will make the proposal compatible with existing and future development of the surrounding area as permitted by the existing zoning; USR-717:85:64 Energy Minerals Corporation January 21, 1986 Page 2 - No overlay districts affect the site; and - Use by Special Review Development Standards will provide adequate protection of the health, safety and welfare of the neighborhood and County. This recommendation is based, in part, upon a review of the application submitted by the applicant, other relevant information regarding the request and the responses of the referral entities which have reviewed this request. The Department of Planning Services staff recommendation for approval is conditional upon the following: 1. The attached Development Standards for the Use by Special Review permit be adopted and placed on the Use by Special Review plat prior to recording the plat. 2. The Use by Special Review activity shall not occur nor shall any building or electrical permits by issued on the property until the following items have been accomplished: - The Use by Special Review plat has been delivered to the Department of Planning Services office and the plat is ready to be recorded in the office of the Weld County Clerk and Recorder. - The applicant/operator shall submit evidence to the Department of Planning Services that the required emissions permit for the Air Pollution Control Division, Colorado Department of Health has been obtained. - The applicant/operator shall submit a copy of an insurance policy to the Department of Planning Services in the amount of five hundred thousand dollars ($500,000.00) insuring the applicant and the County against all claims or causes of action made against either or both the applicant and the County for damages to persons or property arising out of the drilling, maintenance, production, or other work done with respect to such proposed oil and gas wells. The policy shall be written by a company authorized to do business in the State of Colorado. 060185 USR-717:85:64 Energy Minerals Corporation January 21, 1986 Page 3 If the insurance policy lapses or becomes void for any reason whatsoever, the Use by Special Review Permit shall cease to exist until a new insurance policy is provided and filed with the Department of Planning Services. All well activity shall be shut-down and all operations and production shall be suspended and discontinued, consistent with safety considerations, until the operator provides evidence of insurance in the prescribed amount. The applicant/operator provides a list of the maximum quantities of hazardous substances expected at the site and emergency phone numbers and addresses of operators to the State Health Department, Division of Waste Management, the Weld County Emergency Response Coordinator, and the Western Hills and Eaton Fire Protection District. Evidence shall be delivered to the Department of Planning Services indicating the this has been done. Section 3: NW/4NW/4 550185 ADDENDUM Attached to and made a part of that certain Application for Use for Special Review before the Weld County Planning Commission submitted by Energy Minerals Corporation dated December 10, 1985 The purpose of this Application is to drill and produce oil and gas wells located in the E/2NW/4, NE/4, W/2SW/4 of Section 33, Township 6 North, Range 65 West of the 6th P.M. and N/2NE/4 of Section 4, Township 5 North, Range 65 West, of the 6th P.M. , Weld County, Colorado. Energy Minerals Corporation (EM) believes that this proposal will be consistent with the Weld County Comprehensive Plan and that a very small amount of acreage (approximately 1 - 2 acres) will actually be taken out of agricultural production for each well. EM's object is to preserve the agricultural land and to reimburse the landowner for any actual loss incurred because of oil and gas production. EM also believes that the oil and gas production on this tract of land will he consistent with the development of the County of Weld. This area has been zoned R-1, although the area is basically land supporting agriculture. The wellsites will be located no closer than approximately 300' from the nearest dwelling and/or structure. This district has not been developed for residential housing and EM believes the proposal is consistent with the intent of the district, both now and in the future. Since there are no perceivable plans for residential development in this area, by the time, if ever, residential housing becomes desirable, the production life of the well should be completed and the signs of the well removed. Oil and gas production on the subject tracts of land will be compatible and consistent with the existing surroundings and land uses. The surrounding area is farmland growing crops or raising livestock. There are in fact many oil and gas wells within less than a mile of the proposed locations. Also there are three producing wells less than a half a mile to the West. EM is therefore not the first to drill in the area, and not the first to drill a well in Section 33 which is zoned R-1. There are some well locations in the Airport Overlay District, Instrument Approach Zone subclassification. All height limitations prescribed by the Weld County Ordinance will be strictly observed. The tallest permanent structure on the site will not exceed 20' in height. Equipment and structures at each wellsite will consist of one 300 barrel oil holding tank, one horizontal separator and one wellhead structure. As mentioned above, the highest structure will not exceed 20' . All of the essential requirements of the Colorado Oil and Gas Conservation Commission, Weld County Ordinances will be observed. A berm will be built around the tank and will be of sufficient height to contain liquids in the tank in the event of a leak. The tanks will be setback over 400' from any building. Upon the abandonment of the well, the hole will be plugged in accordance with the Colorado Oil and Gas Conservation Commission regulations, and the abandoned wellsites will be restored to a condition substantially similar to the original condition. The underlying theme throughout drilling and production is safety, not only for the people working at the site, but for the people living in the area. EM is well aware of the hazards involved and we will conduct all operations accordingly. EM presently operates approximately 200 producing oil and gas wells within the Denver—Julesburg Basin. The vehicular traffic into each wellsite will be minimal and will consist of daily inspections made by employees and pumpers in pickup trucks, and approximately once a week a tanker truck will go into the site on the access road to load oil from the 300 barrel oil holding tanks. Tank batteries will be located approximately 300' from the wellhead, the wellsite is more than 300' from the nearest structure. EM will comply with the Weld County Ordinance as well as any other requirements. EM has been working in conjunction with the landowners in order to minimize damage to the agricultural producing lands, to the extent that the well location itself will only consist of a wellhead. As mentioned above the tank batteries and separators will be located as close to an entrance and existing access as possible. (360185 Weld County Planning Commission December 10, 1985 Page 2 In conclusion, EM respectfully requests that the Weld County Commissioners grant EM a special permit to drill for oil and gas in an area zoned R-1. EM has been drilling for oil and gas for the past sixteen years, and we feel that our expertise will not inconvenience the City of Greeley or the County of Weld.
