RE: REAFFIRMING VACATION OF EASEMENT DESCRIBED AS LOTS 1 AND 2 ,
BLOCK 45 , TOWN OF BARNESVILLE - TOM BALL
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, on November 18 , 1985 , the Board considered the
request of Tom Ball to vacate an easement on Lots 1 and 2 , Block
45 , in the Town of Barnesville, and
WHEREAS, the Board referred this request to the Engineering
and Planning Departments for their recommendations, and
WHEREAS, after research, said departments found that those
portions which were requested to be vacated, had been vacated on
May 5 , 1955 , by the Board of County Commissioners , and
WHEREAS , said vacation of May 5 , 1955 , was recorded under
Reception #1204901 , File #587 , in the office of the Weld County
Clerk and Recorder, and
WHEREAS, the Board now deems it appropriate to reaffirm said
vacation which occurred on May 5 , 1955 .
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the vacation of Lots
1 and 2, Block 45 , Town of Barnesville, which occurred May 5 ,
1955, be, and hereby is, reaffirmed.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 16th day of
December, A.D. , 1985.

On November 18 , 1985 , you considered the request of Tom Ball to
vacate easement described as: Lots 1 & 2 , Block 45 , in the Town
of Barnesville. This matter was referred to the Engineering and
Planning Departments for their recommendation.
According to the research of these departments, the requested
easement was vacated on May 5 , 1955 . According to Mike Kelley,
County Attorney, no further Board action is necessary.

It would appear from the research completed by our office that the portions
of the street and alley that are being requested to be vacated were
previously vacated on May 5, 1955. Attached is a copy of the vacation plat
recorded on May 5, 1955 under Reception #1204901, File #587. It may be
appropriate to check with the County Attorney's office to determine if my
further action is necessary.

I am requesting that Weld County vacate the easement along the North
and East edge of my property located at:
33304 W.C.R. 61-3/4
Gill, Colorado 80624
aka: Lots 1 & 2, Block 45
Town of Barnesville
Weld County
State of Colorado
The North easement is presently a road right of way. I agree to share
the 75 feet with the adjoining land owner, Elmer Bruntz, located at:
306712 W.C.R. 68
Gill, Colorado 80624
Mr. Bruntz is in agreement with this proposal. I would also like the
County to vacate the 20 foot alley easement along the East side of my
property.

. Southeast Quarter (SEI) of Section Eighteen (18) , Township Six (6)
North, of Range Sixty-three (63) West of the 6th P. M. in Weld
County, Colorado, enclosed within the exterior red lines on the
accompanying plat and being otherwise designated as:
Beginning at the South Quarter corner of Section Eighteen
(13) , Township Six (6) North, of Range Sixty-three (63)
West of the 6th P. M. thence North along the center line
of Section 18, 2343.47 feet to the center of Madella Avenue
as platted; thence East along the center of Madella Avenue

RE: Proposed vacation in Barnesville
Dear Mr. Ball :
I' ve researched the property in question, Lot 1 and 2, Block 45,
Barnesville, Colorado with our records and have found the
following information:
Original map platted in 1910 and revised in 1911.
Our records show the lots in question were vacated on
May 5, 1955.
Everything shown within the red line on the attached map was
vacated, except for two parcels that are still platted as
lot and block. They are as follows :
Lot 23 and 24, Block 45 that is located at the south end
of your block and just south of Earl Avenue and Sanford
Street, the public school property, more specifically
identified as Lot 1, Block 44, approximately 1.43 acres .
See attached sheets for additional documentation.

RESOLUTION
RE: ACTION OF THE BOARD CONCERNING REQUEST FROM TOM BALL TO
VACATE STREET AND ALLEY EAST AND NORTH OF LOTS 1 AND 2 , BLOCK
45 , TOWN OF BARNESVILLE
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board has received a request from Tom Ball to
vacate a portion of a platted street and a portion of an alley
located in the Town of Barnesville, being described as north and
east of Lots 1 and 2 , Block 45 , and
WHEREAS, the Board deems it advisable to refer this request
to the Engineering Department and the Department of Planning
Services for their recommendation.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the request to vacate
a street and an alley in the Town of Barnesville be, and hereby
is, referred to the Engineering Department and the Department of
Planning Services for their recommendation.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 18th day of
November, A.D. , 1985 .
