RE: DENIAL OF RECORDED EXEMPTION NO. 1045 - BRUCE D. REED
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, on September 23 , 1987 , the Board considered a
request from Bruce D. Reed for Recorded Exemption #1046 concerning
a parcel of land located in part of the Ni NEi of Section 34 ,
Township 5 North, Range 65 West of the 6th P.M. , Weld County,
Colorado, and
WHEREAS, Mr. Reed requested this Recorded Exemption to divide
the property into parcels estimated to be approximately 11 acres
and 7 acres, and
WHEREAS, the Board heard all of the testimony and statements
of those present, has studied the request of the applicant and the
recommendations of the Planning staff and considered all of the
evidence presented in this matter and, having been fully informed,
finds that this request shall be denied for the following reasons:
1 . The applicant has not demonstrated that the proposal is
consistent with efficient and orderly development.
2 . The proposal is inconsistent with the intent of the
Agricultural Zone District.
3 . The proposed Recorded Exemption is not compatible with
the existing or future development of the area.
4 . The applicant has failed to demonstrate that the
proposal is consistent with the Weld County
Comprehensive Plan as stated on page 1 : "The
Comprehensive Plan document is intended to be used for
the general purpose of guiding and accomplishing the
coordinated, adjusted, and harmonious development of
Weld County. "
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the application for a
Recorded Exemption on the hereinabove described parcel of land be,
and hereby is , denied.

Dear Commissioners:
This request is from Bruce D. Reed for a recorded exemption. The parcel of
land on which this request is being made is described as the part of the Ni
NE} of Section 34, T5N, R65W of the 6th P.M. , Weld County, Colorado.
The property is located approximately 2.5 miles east of La Salle, south of
Weld County Road 52, east of Weld County Road 43. The property is
approximately 18.28 acres in size and is not the total contiguous land
holdings of the applicant. The request is to divide the property into
parcels of 11 .3 acres and 7.0 acres, more or less. The Reed family wishes
to divide the property for future development.
Based upon the submitted information and the policies of the County, the
Department of Planning Services' staff recommends the request be denied for
the following reasons:
The applicant has not demonstrated that the proposal is consistent
with efficient and orderly development . The creation of the lot
owned by Bruce D. Reed occurred after the First National Bank of
Fort Morgan acquired the full northeast quarter from Mr. and Mrs.
Lohr in 1982. The First National Bank of Fort Morgan began
deeding parcels of land above the required 35 acres as outlined in
Section 2-1 of the Weld County Subdivision Regulations. The
parcel of land purchased by Mr. Reed equals a total contiguous
land ownership of 76.23 acres, more or less. This property is
divided into three lots by a deeded right-of-way of the Lower
Latham Ditch which traverses over the entire property. Mr. Reed
has three legal lots because of this right-of-way ownership and
not just one lot. At this time, Mr. Reed is requesting two
recorded exemptions, one on part of the Ni of the NE} and the

other in part of the E} of the NE} for the purpose of creating 4
lots for future development . Because of the deeding of the
property by the First National Bank of Fort Morgan, and the
right-of-way ownership of the Lower Latham Ditch Company, there
exists at this time 6 lots in the NE} of Section 34, T5N, R66W of
the 6th P.M. , Weld County, Colorado . Further land splitting by
use of the recorded exemption procedure would have a potential for
12 lots to eventually be developed prior to the availability of
urban services.
- The proposal is inconsistent with the intent of the Agricultural
zone district. Agriculture in Weld County is considered a
valuable resource which must be protected from adverse impacts
resulting from uncontrolled and undirected residential land uses.
The Agricultural zone district was established to maintain and
promote agriculture as an essential feature of Weld County. It is
intended to provide areas for the conduct or agricultural
activities without the interference and encroachment of other more
intensive land uses.
- The proposed recorded exemption is not compatible with the
existing or future development of the area. The area is made up
of large lots equaling an average of 89.5 acres, more or less.
The soil types existing on the proposed lot are identified as
Aquolls and Aquepts by the "Soil Survey of Weld County,
Colorado" published by the U.S. Department of Agricultural Soil
Conservation Service. Most of the acreage is subject to excessive
runoff. The water table is at or near the surface in the spring
and during peak irrigation season. In a letter dated September 4,
1987, the Lower Latham Ditch Company stated that future
development of this area would be undesirable because of the
following: seep water, mosquitos, unsatisfactory septic tanks
because of the high water table, and the possibility of the
underground water table being contaminated by further use. At
this time, Mr. Reed has the potential to build 3 dwellings on the
lots formed by the Latham Ditch. An addition of 2 more lots and
potentially 2 additional dwellings would be considered
undesirable.
- The applicant has failed to demonstrate that the proposal is
consistent with the Weld County Comprehensive Plan as stated on
page 1: "The Comprehensive Plan document is intended to be used
for the general purpose of guiding and accomplishing the
coordinated, adjusted, and harmonious development of Weld County."
It is through this guidance that the present and future needs and
resources will best promote efficiency and economy in the process
of development including population distribution and land use.

SUBJECT: Recorded Exemption for Bruce D. Reed, Part of the NE* of Sec. 34,
T. 5 N. , R. 65 W.
Dear Sir:
Applicant for the proposed recorded exemption is Bruce D. Reed. Mr. Reed's
address is 1850 Southern Street, Brighton, Co 80601 (phone 659-7100).
The total acreage is approximately 18.3 acres, and applicant seeks to divide it into
an 11.3 acre parcel and a 7.0 acre parcel. Domestic water (Central Weld County
Water District) is available to both parcels. Both parcels propose to use septic
systems. It should be noted that the 18.3 acre parcel is part of a 76.8 acre parcel
owned by Mr. Reed. However, since the Lower Latham Reservoir Company has a
right-of-way of 50 feet (not to exceed 66 feet) through the NE* of the subject
property, the. 18.3 acre parcel has, in accordance with the guidelines accepted by
the Weld County Planning Department, been split from the 76.8 acre parcel and is
eligible for a Recorded Exemption as a separate parcel. The applicant desires to
split the property in order to effectively utilize the site. At present the property
is used only for pasture so no prime agricultural land would be removed from use.
The existing usage is agricultural and that usage is expected to continue. Since
this property is within the Town of LaSalle's future development plan, it will be
necessary to review the proposed land split with the Town of LaSalle. The pro-
posed parcels would allow for future development and appear to be compatible with
existing surrounding land uses. In addition, both parcels have access to County
Road 50 and the split will not create either a land locked or non accessible parcel.
The property is located in an A-Agricultural zone and the proposed recorded
exemption is consistent with that zoning as both parcels will remain agricultural.
The proposed recorded exemption is compatible with future development of the area
and is not inconsistent with efficient and orderly development. The proposed re-
corded exemption is not located in a flood plain, geologic hazard or Weld County

outlined in the Weld County Zoning Ordinance.

Dear Members of Planning Committee:
We are in receipt of your letters regarding recorded exemption
requests from Mr . Bruce Reed near the outlet ditch of the Lower
Latham Reservoir east of LaSalle .
Our Board of Directors meet only once a month, and had a
chance to discuss this matter yesterday. The Board is quite
disturbed that this request is being considered and was greatly
surprised at Mr . Freese ' s letter stating this area is "compatible
with existing surrounding land uses" and "is not located in a
flood plain . " On the contrary, we have previously experienced a
disaster in this exact area . It is in a flood plain and is
quite unsafe because of the adjacent ditch. We also feel it is
an undesirable location for residents because of several reasons :
1 ) constant problem with seep water coming up into basements ,
21 mosquitos , and 3 ) septic tanks are unsatisfactory because
the water table is too high and our water system is in danger
of being contaminated .
As I am sure it is clear , the Board of Directors of the
Lower Latham Ditch and Reservoir is strictly against Mr . Reed ' s
request for future development of this area at the corner of
Weld County Roads 52 and 45 . Please notify this company of the
hearing date of this case as we would like our representative
to attend .
