-RESOLUTION RE: APPROVAL OF USE BY SPECIAL REVIEW FOR A DRY GRAVEL PIT MINING OPERATION - GARTRELL ENTERPRISES, INC. WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 23rd day of April , 1986 , at the hour of 2: 00 p.m. in the Chambers of the Board for the purpose of hearing the application of Gartrell Enterprises, Inc. , 13767 Weld County Road 8 , Fort Lupton, Colorado 80621 , for a Use by Special Review for a dry gravel pit mining operation on the following described real testate , to-wit: Bart of the SE', Section 25 , Township 1 North, -Range 67 West of the 6th P.M. , Weld County, Colorado WHEREAS, Section 24 . 4. 2 of the Weld County Zoning Ordinance provides standards for review of said Use by Special Review, and -WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1 . The submitted materials are in compliance with the application requirements of Section 24. 7 , 44 . 1 , 44 . 2 and 44. 3 of the Weld County Zoning Ordinance. 2 . It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24. 4 . 2 of the Weld County Zoning Ordinance as follows: a. This request is in compliance with the Weld County Comprehensive Plan which allows uses of an industrial nature to occur where the resources are available , (i.e. , sand and gravel operations as noted on pages 62-63 of the Comprehensive Plan) . b. The proposal is consistent with the intent of the agricultural Zone District in that the proposed use does not interfere with other agricultural activities in the area or the County, and as a Use by Special Review the activity can take place in the district. The activities proposed will be compatible with existing agricultural and rural residential uses in the neighborhood, as well as the projected development in the future. d. The City of Brighton has reviewed this request and has set forth no objections. e. No overlay districts affect the site. f. Use -by Special Review Development Standards will provide adequate protection of the health, safety and welfare of the -neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application for a Use by Special Review for a dry gravel pit mining operation on the hereinabove described parcel of land be, and hereby is, granted -subject to the following conditions: 1 . She attached Development Standards for the Use by Special Review permit be adopted and placed on the Use by Special Review plat -prior to recording the plat. 2. The -Use by Special Review activity shall not occur nor shall any building or electrical permits be issued on the property until the Use by Special Review plat has been delivered to the Department of Planning Services Office and the plat is ready to be recorded in the office of the Weld County Clerk and Recorder. 3. The following note shall be placed on the Use by Special Review Permit plat: NOT£: The Mined Land Reclamation Board has the authority to issue -permits for mining and reclamation activities. -Activities related to mining and reclamation are, therefore , under the jurisdiction of the Mined Land Reclamation Board; however, Weld County has jurisdiction of those matters outlined in the Development Standards. 4 . The Use by Special Review permit is for a dry gravel pit mining operation as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated herein. 2 . The haul route shall be from the point of ingress and egress south on Weld County Road 23-1/2 to Weld County Road 2 . No other haul route shall be used. 3 . The applicant and/or operator shall repair any damage on the entire haul route which is created by heavy truck traffic hauling from the gravel pit. Evidence of damage would include: a. Rutting b. Soft spots c. Wash boarding d. Gravel loss 4. The applicant/operator shall obtain the required Emissions Permit from the Air Pollution Control Division, Colorado Department of Health. 5 . The owner/operator shall be responsible for dust control from the pit area to Weld County Road 2 . Water, asphaltic emulsions , waste oil or commercially available chemicals may be used to control dust. Materials and methods used shall not be inconsistent with Federal, State or local laws, rules or regulations pertaining to hazardous materials, health or environmental protection. 6 . In the event truck traffic associated with the sand and gravel operation exceeds ten vehicles per day, the owner/operator shall be required to enter into a road maintenance agreement with Weld County. 7 . The dry gravel operation shall comply with Section 44. 4, Operation Policies of the Weld County Zoning Ordinance. 8 . All construction done on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 860388 Page 2 DEVELOPMENT STANDARDS - GARTRELL ENTERPRISES, INC. 9. The property owner or operator shall be responsible for complying with the Design Standards of Section 24 . 5 of the Weld County Zoning Ordinance. 10. The property owner or operator shall be responsible for complying with the Operation Standards of Section 24. 6 of the Weld County Zoning Ordinance. 11 . Personnel from the Weld County Health Department and Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to insure the activities carried out on the property comply with the Development Standards stated herein and all applicable Weld County Regulations. 12. The Use by Special Review area shall be limited to the plans shown herein and governed by the foregoing Standards and all applicable Weld County Regulations. Any material deviations from the plans or Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans or Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 13. The property owner or operator shall be responsible for complying with all of the foregoing Standards. Noncompliance with any of the foregoing Standards may be reason for revocation of the Permit by the Board of County Commissioners. 14 . Morrison Planning Department representative, Debbie de Besche The following business was transacted: I hereby certify that pursuant to a notice dated April 7, 1986, and duly published April 10, 1986, in the Johnstown Breeze, a public hearing was conducted to consider the request of Gartrell Enterprises, Inc. for a Use by Special Review for a dry gravel pit mining operation. Chairman Pro-Tem Lacy advised the applicant that, only four Commissioners being present, should this hearing result in a tie vote, the absent Commissioner would review the record and listen to the tape of this hearing before casting the deciding vote. Lee Morrison, Assistant County Attorney, made this matter of record. Debbie de Besche, Planning Department representative, read the favorable recommendation of the Planning Commission into the record. She said four Conditions and fourteen Development Standards have been recommended for this proposed operation. She also stated that Condition #4 has been satisfied. Harlan Gartrell, the applicant, came forward to answer questions of the Board. No public testimony was offered concerning this request. Commissioner Kirby moved to approve the request of Gartrell Enterprises, Inc. for a Use by Special Review, subject to the Conditions and Development Standards recommended by the Planning Commission. Commissioner Yamaguchi seconded the motion which carried unanimously. This Certification was approved on the 28th day of April, 1986. LOCATION: Approximately 1.5 miles northwest of Brighton; south of Weld County Road 6 and east of Weld County Road 23. APPEARANCE: Harlan Gartrell, applicant, stated this is an old railroad turn-around. The owners want the gravel taken out to lower the land to pasture level and then reclaim it back to pasture. This is a triangular area and the gravel ranges from three to eighteen inches in depth. There will be about ten loads of gravel taken out per day. It is my understanding that the request is to remove the gravel in the Altvan soil to about the level of the Aquolls and Aquent soils, to make a more uniform field. SOILS INFORMATION: Soils on this area, -,ccording to the Soil Survey of Weld County, Colorado, southern part, is mapped in two units. They are Altvan loam, 1 -3 percent slopes and Aquolls and Aquents gravelly substratum. The Altvan appears to have been disturbed somewhat in the past, possibly when the railroad track ran through this area. For more information see the attached Soil Map, Soil Descriptions and Tables 8, 9, 11 , 12 and 13. VEGETATIVE INFORMATION: The vegetation on the Altvan loam soils was very sparce. Annual grasses and forbs appear to make up the majority of the composition. Plants present on this site were kochia, rag weed, russian thistle, musk thistle, goathead, cheatgrass, squirreltail , (oxtail , crested wheat and western wheat. Vegetation on the Aquolls and Aquents gravelly substratum soils was over 90 percent salt grass in the area where equipment would be working. Other vegetation consisted of foxtail , musk thistle and bull thistle. In wet areas about 100 foot away there were cattails sedges and rushes. RECLAMATION PLAN: 1 . Top Soil : During mining operations topsoil shoudl be stockpiled to be used in reclamation of the area. After mining operations are completed, the area should be shaped and graded with no slopes exceeding 4: 1 . Topsoil should be spread over the disturbed area and disced into existing soil before the area is seeded. 2. Fertilizer: Forty pounds of nitrogen and forty pounds of phosphorous (P205) per acre should be applied just prior to seeding. This fertilizer should be mixed into the soil . Barnyard manure could be used as a mulch and replace part of the fertilizer. 3. Seeding: Seeding should be done between October 15 and May 15. Seeding should be done when the ground is not frozen. The use of a grass seed drill is highly recommended. The seedbed should be firm, moist and clean of weeds. Should broad- cast seeding be used, the rate listed on the next page, should be doubled. Seeding depth should he 3 inch into the soil . v Page 2 The following is a seeding mix recommendation: GRASS OF MIX SEEDING RATE Alkali sacaton* 50 0.75 # PLS/Ac. Switchgrass 20 0.9 # PLS/Ac. Western wheatgrass 20 3.2 # PLS/Ac. Slender wheatgrass 10 1 . 1 # PLS/Ac. Seed source from within 150 miles •f planting site is recommended. # PLS/Ac = Pounds of Pure Live Seed per Acre. 4. Mulching: After seeding is completed apply at least 20 tons of dried manure on 1isturbed area. About 60% of the manure, by weight, should be chunks of 5 inches or more in diameter. In place of manure one could use about 4000 pounds per acre of straw or hay mulch. This mulch should be anchored "crimped" into the soil . 5. Weed Control : Weed control is necessary to insure a successful seeding . Weeds can be controlled by chemical spray or by mowing. If herbicides are used do not spray until the grass seedlings are at least four inches tall . If mowing is used, clip weeds when they are 11" to 12" tall , leaving a 3" to 4" stubble height. 6.
