HomeMy WebLinkAbout890916.tiff RESOLUTION RE: APPROVE SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW PERMIT FOR COMMERCIAL USE (TRASH HAULING BUSINESS) IN THE A (AGRICULTURAL) ZONE DISTRICT - HARDEN AND HELEN SCHULTZ WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 16th day of August, 1989, at the hour of 10: 00 a.m. in the Chambers of the Board for the purpose of hearing the application of Harlen and Helen Schultz , 139 Weld County Road 46 , Berthoud, Colorado 80513 , for a Site Specific Development Plan and Special Review Permit for commercial use (trash hauling business) in the A (Agricultural) Zone District on the following described real estate, to-wit: Part of the W} SW} , Section 7, Township 4 North, Range 68 West of the 6th P.M. , Weld County, Colorado WHEREAS, said applicant was represented by Russell Anson, Attorney, and WHEREAS, Section 24 .4 .2 of the Weld County Zoning Ordinance provides standards for review of said Special Review Permit, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1 . The submitted materials are in compliance with the application requirements of Section 24 .7 of the Weld County Zoning Ordinance. 2. It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24 .4 .2 of the Weld County Zoning Ordinance as follows: a. The proposal is consistent with the intent of the Weld County Comprehensive Plan agricultural goals and policies. Prime farmground will not be affected by this request. 890916 Page 2 RE: USR - SCHULTZ b. The proposal is consistent with the Agricultural Zone District and is provided for as a Use by Special Review. c. The uses permitted will be compatible with the existing surrounding land uses which include agricultural production, rural residences, Weld County Road 46 , and Weld County Road 1 . The use will be compatible with the future development of the surrounding area as permitted by the Agricultural Zone District. Special Review Permit Development Standards will ensure continued compatibility with the surrounding land uses. One objection has been received from surrounding property owners. d. No overlay districts affect the site. e. Special Review Development Standards will provide adequate protection of the health, safety and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application for a Site Specific Development Plan and Special Review Permit for commercial use (trash hauling business) in the A (Agricultural) Zone District on the hereinabove described parcel of land be, and hereby is, granted subject to the following conditions: 1 . The attached Development Standards for the Special Review Permit shall be adopted and placed on the Special Review plat prior to recording the plat. The plat shall be delivered to the Department of Planning Services and be ready for recording in the office of the Weld County Clerk and Recorder within 15 days of approval by the Board of County Commissioners. 2. The Special Review activity shall not occur nor shall any building or electrical permits be issued on the property until the Special Review plat is ready to be recorded in the office of the Weld County Clerk and Recorder. 3 . The Site Specific Development Plan and Special Review Permit is for a trash hauling business as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated herein. This permit shall be limited to no more than seven trash trucks and five employees besides family members residing on the property. 2. Approval of this plan may create a vested property right pursuant to Article 68 of Title 24 , C.R.S. , as amended. 3 . No outside storage shall be permitted on the site except for the trash trucks and polycarts. The trucks shall be parked in the truck parking area as shown on the Special Review Permit plat. The polycarts stored on the site shall be screened from adjacent properties and rights-of-way. The screening plan shall be submitted to the Department of Planning Services for approval. 4. No waste brought to the site shall be stored on the site for more than one night. 5. Waste oil, antifreeze, and other associated liquid and solid wastes shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 6 . No permanent disposal of wastes shall be permitted at this site. 7. An ISDS Evaluation on all existing septic systems will be necessary prior to issuing the required septic permits on the existing systems. 8 . Trucks loaded with trash shall park, store and haul in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. 9 . Fugitive dust must be confined on this site. 890916 Page 2 RE: USR - SCHULTZ 10 . The maximum permissible noise level shall not exceed the industrial limit of 80dB (A) , as measured according to 25-12-102 , Colorado Revised Statutes. 11 . All construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 12 . The property owner or operator shall be responsible for complying with the Design Standards of Section 24 .5 of the 'Weld County Zoning Ordinance. 13 . The property owner or operator shall be responsible for complying with the Operation Standards of Section 24 . 6 of the Weld County Zoning Ordinance. 14 . Personnel from the Weld County Health Department, Berthoud Fire Protection District, and Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to ensure the activities carried out on the property comply with the Development Standards stated herein and all applicable Weld County Regulations. 15 . The Special Review Permit area shall be limited to the plans shown herein and governed by the foregoing Standards and all applicable Weld County Regulations. Major changes from the plans or Development Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans or Development Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 16 . The property owner or operator shall be responsible for complying with all of the foregoing Development Standards. Lee Morrison, Assistant County Attorney, made this matter of record. Lanell Curry, representing the Planning Staff, read the favorable recommendation of the Planning Commission into the record. Ms. Curry noted that the Development Standards allow for seven trash trucks, and the addition of more trucks would be a major change requiring an amendment of the Permit. (Let the record reflect that Commissioner Kennedy is now present.) Russ Anson, Attorney, came forward to represent the applicant. Mr. Anson traced the history of this business, and he stated that Mr. and Mrs. Schultz own 80 acres, but only three of the acres are included in the Special Review Permit area. Mr. Anson presented exhibits which were submitted at the Planning Commission hearing. Mr. Schultz came forward to answer questions of the Board. Dan Stroh, the owner of adjacent property, _came forward to voice concerns. After comments by Mr. Anson and Mr. Schultz, Commissioner Brantner moved to approve the request for a Site Specific Development Plan and Use by Special Review, subject to the Conditions and Development Standards contained in the Planning Commission's recommendation. The motion was seconded by Commissioner Zacy, and it carried unanimously. This Certification was approved on the 21st day of August, 1989. APPEARANCE: Russ Anson, Attorney at Law, represented the applicants. He presented a plat map showing the arrangement of the house, other outbuildings, and trash hauling equipment on the lot. He distributed a brochure showing the small trash trucks, an aerial photo showing the special review site, six photographs showing the site, and three photographs showing polycarts en the property. All four exhibits were retained as evidence. No business is conducted on the prcperty except for an office, and the trucks are parked on the property when not in use. Employees park their vehicles on the property while they are using the trash trucks. Three acres of this property is all that will be taken up by the use by special review site. The use will not have a negative impact on the land or the environment. The Chairman called for discussion from the members of the audience. Dan Stroh, adjacent property owner, spoke in opposition to this request. He felt this type of business is appropriate only in an industrial or commercial zone district. MOTION: Rick Iverson moved Case Number USR-882 for a Sire Specific Development Plan and a Special Review permit for a commercial use (trash hauling business) in the agricultural zone district he frowarded to the Board cf County Commissioners with the Planning Commission's recommendation for approval based upon the recommendation, conditions, and development standards presented by the Department of Planning Services staff and the testimony heard by the Planning Commission. Motion seconded by Jerry Burnett. The Chairman called for discussion from the members of the Planning Commission. CASE NUMBER: USR-883 APPLICANT: Colorado Department of Highways REQUEST: A Site Specific Development Plan and a Special Review permit for a major facility of a public utility (office and maintenance facility) . LEGAL DESCRIPTION: Part of the Si of Section 1, T5N, R65W of the 6th P.M. , Weld County, Colorado LOCATION: Southeast of the intersection of Weld County Road 47 and State Highway 263. APPEARANCE: Rose McDonald, Engineer, State Highway Department. The State Highway Department plans to relocate some of its office and highway maintenance facilities to this site. All utilities are available to the site except sewer. A septic system will be installed. Ann Garrison reported on the on—site inspection she had done. There are enormous steel beams and other road and bridge supplies on this site. It appears, to her, to be a dangerous situation to even try to remove these supplies. Rose McDonald reported the supplies on—site belong to the County who has been renting the site. If they were moving the supplies, they would have flag people to regulate the traffic. Also, when they develop the site, they will comply with all necessary accel and decel lanes required by the State Department of Highways for this site. The Chairman called for discussion from members of the audience. There was none. The Chairman asked Ms. McDonald if the recommendaticu, conditions, and development standards outlined by the staff had been reviewed? She stated they had no problem with any of these. The Chairman asked that these items be filed with the summary as a permanent record of these proceedings. This application is for a major facility of a public utility. Therefore, the Planning Commission's decision for approval is final. The Site Specific Development Plan and Special Review permit is for a trash hauling business as submitted in the application materials on file in the Department of Planning Services and subject to the development Standards stated hereon. No outside storage shall be permitted on the site except for the trash trucks and polycarts. -The trucks shall be parked in the truck parking area as shown on the special review permit plat. No waste brought to the site shall be stored on the site for more than one night. 5. My family and I own the adjacent farm consisting of approx- imately eighty acres to the east of the proposed site. At the present time, Mr. and Mrs. Schultz already have three residences on the 68-acre parcel and have made application for an additional residence by way of a recorded exemption, which I understand is on hold at this time due to a boundary dispute between our two farms . Therefore, there could poten- tially be four residences and a commercial trash business on this property. My concerns are fairly obvious. First of all, the County Road was not designed for, nor is it being maintained for commercial purposes and the amount of additional traffic necessary for commercial use. As it stands, in the summer time the roads are extremely dusty and always in a rutted condition. They simply are not maintained for this type of employee and commercial traffic. Secondly, in the past, this trash business has always in- cluded the outside storage of trash receptacles as well as other parts , fuel and vehicles . Necessary maintenance is being performed in the loafing sheds and shops of the ex- isting farm. I am also understandably concerned by the effect that all of these existing residences and now the addition of a commercial trash business and an additional residence will have on the property values , as well as the effect on the overall condition of the neighborhood itself. DETAILED DESCRIPTION OF THE PROPOSED OPERATIONS PROPOSED USE: The proposed use is a waste removal business to be managed by the family members who reside on the premises. The business provides waste removal services for primarily residential customers . The business has approximately 3400 customers and serves the towns of Mead, Berthoud and the suburban area of Loveland . The business has a small office located on the premises in an existing structure which is used solely for storage of the business records and receiving telephone calls and is managed by the daughter of the owner. There will be four trash compactor trucks of gross vehicle weight of 14 , 000 pounds (the standard trash hauling truck weighs between 36 , 000 and 72,000 pounds GVW) . There will also be one truck of the standard weight ( 36 ,000 GVW) which will generally be used only once a week for special jobs or if one of the smaller trucks is unavailable. There will be four additional employees who will be drivers of the trucks that are used in the business . Normal operating hours are between 8 : 00 a.m. and 4 : 00 p.m. on weekdays only. The drivers simply come to the site to pickup the trucks and then drive them off the premises for trash hauling and return between 2 : 00 p.m. and 4 : 00 p.m. the same afternoon. 90% of the trash is hauled to Larimer County Landfill and 10% to the landfill in Milliken. At some point in the future applicant will increase the size of the existing garage to accommodate enclosed parking for the trash compactor trucks . NEED FOR USE: This business provides trash hauling services to approximately 3400 customers , nearly all of which are residential customers in the areas of Mead, Berthoud and Loveland. TYPES OF EXISTING USES ON SURROUNDING PROPERTIES : The surrounding properties as well as this property consist of farms with crops such as hay, corn, sugar beets and beans . NEARBY RESIDENTIAL STRUCTURES : The distance of the proposed use to residential structures toward the East is approximately 300 yards, to the Southwest is approximately 300 yards , and to the North approximately 700 yards. MAXIMUM NUMBER OF USERS , PATRONS, MEMBERS AND BUYERS : Customers are not normally on the premises except on a rare occasion to pay a bill . 99091.3 EMPLOYEES, SHIFTS AND HOURS OF OPERATION: The owner' s daughter manages the office located on the premises . The owner' s son does odd jobs as needed and there are four permanent employees who are not relatives and are drivers of the four trucks . The business operates only during the weekdays between the hours of 8 : 00 a.m. and 4 : 00 p.m. The only activity on the premises during that time is when the drivers pick up the trucks at 8 :00 a.m. and return them between 2 : 00 p.m. and 4 : 00 p.m. There is no weekend activity. WATER SOURCE: The only water source needed for the property is for the residential use of the property supplied by Little Thompson Water. Any cleaning of the trucks is done solely in the City of Loveland at an approved wash facility (the Mayo business is presently being used) . ACCESS ROUTES : The route used by the drivers of the trucks in the morning is to leave the premises on to Weld County Road 46 for approximately 220 yards to Larimer County Road 10 , then proceeding along Larimer County Road 10 for approximately 1 mile to U.S . Highway 287 , thence in North or South direction to serve customers in Mead, Berthoud and Loveland . VEHICULAR TRAFFIC: There will be four (4 ) small sized trucks of 14 ,500 pounds GVW and one ( 1 ) medium sized truck of 36 , 000 pounds GVW. The larger truck will only be used for special pickups for large amounts of trash or if another one of the smaller trucks breaks down. It is expected that this larger truck would only be used approximately once per week. The trucks leave the property once in the morning at 8 : 00 a.m. and return once in the afternoon between 2 : 00 p.m. and 4 : 00 p.m. SEWAGE FACILITIES : The only sewage facilities needed for the premises are for residential use and those facilities consist of a septic system. FIRE PROTECTION MEASURES: Fire protection to the property is presently served by the Berthoud Fire Department and it is not expected that any special measures should be taken for this property because of the proposed use. 2 890916 ANIMALS : This category is not applicable to this use. There are no animals on the property. WASTE STOCKPILES OR STORAGE AREAS: There are no waste stockpiles or storage areas for this proposed use other than the fact that the trucks used in the business will be stored when not in use on the West side of the property which is naturally screened on the west and north by trees and shrubs and on the east by the residential buildings of the property. STORM WATER RETENTION FACILITIES : This category would be non-applicable to the use proposed . REMOVAL OF WASTE: The only type of waste that is ever brought back to the property is one or two yards that may be stored in a truck overnight that has been picked up on the end of a route. It is never stored over the weekend and is simply left in the truck for one evening and would not include any animal waste or restaurant waste but simply waste that may come from a residential property. LANDSCAPING PLANS AND EROSION CONTROL MEASURES : Landscaping will be used to screen the property on the West and North sides where the trucks are stored . No erosion control measures would be associated with the proposed use. RECLAMATION PROCEDURES : Not applicable. TIMETABLE: The property is presently being used as outlined above. The property owner was unaware that he needed to apply for a Use By Special Review because of the fact that the only business being conducted was the storage of the trucks on the premises and a small office within the residential building for a telephone and record keeping. The business had originally started out with simply one truck that was used to haul trash to local dumps for residential customers in the local area and gradually expanded over the past few years . 3 890916 3 . STATEMENT REGARDING THE WELD COUNTY COMPREHENSIVE PLAN AND SUPPORTING INFORMATION FOR THE REQUIREMENTS UNDER THE ZONING ORDINANCE: A. The proposed use is consistent with the Weld County Comprehensive Plan for the following reasons : ( 1 ) The particular site does not remove "prime" agriculture land from farming. ( 2 ) The proposed use would not require new infra- structure, utilities and other services . The road traffic to and from the site would not impose any significant adverse impacts on roads or highways . ( 3 ) No natural resources are being used or impeded at the site by the use or operation. The use of the site would in no manner retard or prevent future mining of mineral resources . (4 ) Air noise and surface pollution would be very minimal and would consist of only a slight amount of dust that may be generated as four trucks leave the premises at 8 : 00 a.m. in the morning and return in the afternoon between 2 : 00 p.m. and 4 : 00 p.m. ( 5 ) No conversion of agricultural land to any other use would be done to accommodate this use. ( 6 ) There would be no adverse impact on the County ' s tax base. ( 7 ) Public facilities and services such as sewer, water, roads , schools and fire and police protection would not have to be increased or adversely impacted because of the proposed use. ( 8 ) The proposed use would have no adverse impact on soil, ground water, and water aquifer conservation practices and protection. B. The proposed use is consistent with the intent of the District in which the use is located. (1 ) The use is located in agriculturally zoned land . The proposed use would not take away any agricultural land nor have an adverse impact on such agricultural property. It would still maintain and promote agriculture as an essential feature in this area. Home business is allowed as a Use by Special Review under Section 31 .4 . 15 of the Weld County Zoning Ordinance on an agricultural zoned property. 4 890316 C. The location of the proposed use on this parcel will not adversely affect productive agricultural land nor remove any agricultural land from production. D. There is adequate protection of the health, safety and welfare of the inhabitants in the neighborhood and of the County. The only visible use of the property for the proposed use will be the parking of the trucks on the property. There will be appropriate screening of the parking area on the east by the residential buildings, and on the west and north by shrubs and trees . E. The proposed use will be compatible with the existing surrounding land uses . The proposed use on the property will be very minimal and will consist of only parking of the trucks and the area proposed for parking will be appropriately screened . Also, there will be a small office with simply a telephone and business records and will be conducted entirely within the residential premises . None of the employees for the business will be working on the property. They will simply drive the trucks from the property at 8 :00 a.m. in the morning and return them between 2 : 00 p.m. and 4 : 00 p.m. in the afternoon. The only other employees are family members . F. The proposed use will be compatible with the future development of the surrounding area as permitted by the existing zone and with future development as projected by the Comprehensive Plan of the County or the adopted Master Plans of the affected municipalities . None of the adopted Master Plans that effect municipalities include this area. The proposed use will have a very minimal impact on the surrounding area and therefore will not in any manner affect the prime use of this area for agricultural uses . It is simply a home business , mainly operated by the residents and their family. G. The proposed use is not located in a flood plain, geologic hazard, or the Weld County Airport Overlay District. H. A water supply is presently available for the property from the Little Thompson District and there is no special water supply that is needed for the proposed use.
