RESOLUTION RE: APPROVE SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW PERMIT FOR A LIVESTOCK CONFINEMENT OPERATION (600 HEAD DAIRY) IN THE A (AGRICULTURAL) ZONE DISTRICT - FRANCIS ARENS WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 18th day of January, 1989 , at the hour of 10 :00 a.m. in the Chambers of the Board for the purpose of hearing the application of Francis Arens, 21508 Weld County Road 44 , La Salle, Colorado 80645 , for a Site Specific Development Plan and Special Review Permit for a livestock confinement operation (600 head dairy) in the A (Agricultural) Zone District on the following described real estate, to-wit: Part of the SE} , Section 15, Township 4 North, Range 65 West of the 6th P.M. , Weld County, Colorado WHEREAS, said applicant was represented by Thomas E. Hellerich, Attorney, and WHEREAS, Section 24 .4 .2 of the Weld County Zoning Ordinance provides standards for review of said Special Review Permit, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons : 1 . The submitted materials are in compliance with the application requirements of Section 24 .7 of the Weld County Zoning Ordinance. 2 . It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24 .4 .2 of the Weld County Zoning Ordinance as follows: a. The proposal is consistent with the intent of the Weld County Comprehensive Plan. The Weld County Comprehensive Plan' s Agricultural Goals and Policies are intended to support and preserve the agricultural industry. fs % ,, ,�,a< - .� 890077 Page 2 RE: USR - ARENS b. The proposal is consistent with the intent of the Agricultural Zone District in which the use is located. The Agricultural Zone District is established to maintain and promote agriculture as an essential feature of Weld County. The Agricultural Zone District is intended to provide areas for agricultural activities without the interference of other incompatible land uses. The proposed use is provided for as a Use by Special Review. c. The proposed use is compatible with the existing surrounding land uses which include farm production and a dairy operation. The use will be compatible with the future development of the surrounding area as permitted by the Agricultural Zone District. Special Review Permit Development Standards and Conditions of Approval will ensure compatibility with the surrounding land uses. No objections have been received from surrounding property owners. d. The applicant has demonstrated a diligent effort to conserve productive agricultural land in the locational decision for the proposed use. e. No overlay districts affect the site. f. Special Review Development Standards will provide adequate protection of the health, safety and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application for a Site Specific Development Plan and Special Review Permit for a livestock confinement operation (600 head dairy) on the hereinabove described parcel of land be, and hereby is, granted subject to the following conditions: 1 . The attached Development Standards for the Special Review Permit shall be adopted and placed on the Special Review plat prior to recording the plat. The plat shall be delivered to the Department of Planning Services and be ready for recording in the office of the Weld County Clerk and Recorder within 15 days of approval by the Board of County Commissioners . 2 . The Special Review activity shall not occur nor shall any building or electrical permits be issued on the property until the Special Review plat is ready to be 890077 Page 3 RE: USR - ARENS recorded in the office of the Weld County Clerk and Recorder. 3 . Prior to recording, the Special Review plat shall be amended to show a 10-foot reservation north of and adjacent to the right-of-way of Weld County Road 44 and all existing and proposed structures. 4 . Within 60 days of approval , the applicant shall provide evidence to the Department of Planning Services staff that the milk barn effluent retention and containment facilities have been reviewed and approved by the Weld County Health Department. The Site Specific Development Plan and Special Review Permit is for a livestock confinement operation (600 head dairy) as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated herein. 2. Approval of this plan may create a vested property right pursuant to Article 68 of Title 24 , C.R.S. , as amended. 3. The applicant shall remove, handle, and stockpile manure from the livestock confinement area in a manner that will prevent nuisance conditions. The manure piles shall not be allowed to exist or deteriorate to a condition that facilitates excessive odors , flies or insect pests, or pollutant runoff. The manure storage site shall have a watertight surface which does not permit seepage or percolation of manure pollutants into the ground. 4 . The facility shall be maintained in compliance at all times with the Colorado guidelines for Feedlot Runoff Containment. 5 . The applicant shall comply with all State Health Department requirements for construction and operation of a dairy. Milk barn effluent retention and containment facilities shall be maintained in compliance with State Statutes. 6 . No permanent disposal of wastes shall be permitted at this site. Spent drug containers , empty livestock dip containers, and other associated liquid and solid wastes shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 7 . Fugitive dust shall be confined on this site. 8 . All construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 9 . The property owner or operator shall be responsible for complying with the Design Standards of Section 24 .5 of the Weld County Zoning Ordinance. 890077 -Page 2 DEVELOPMENT STANDARDS - ARENS 10 . -The property owner or operator shall be responsible for complying with the Operation Standards of Section 24 . 6 of the Weld County Zoning Ordinance. 11 . Personnel from the Weld County Health Department and Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to -ensure the activities carried out on the property comply with the Development Standards stated herein and all applicable Weld County Regulations. 12 . The Special Review area shall be limited to the plans shown herein and governed by the foregoing Standards and all applicable Weld County Regulations. Major changes from the plans or Development Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans or Development Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 13 . -The property owner or operator shall be responsible for complying with all of the foregoing Development Standards . Mr. Arens is the owner of the farm described in the application, consisting of approximately 20 +/- acres located in the West Half (Wi) Southeast Quarter (SEk) Section 15, Township 4 North, -Range 65 West of 6th P.M. , Weld County, Colorado. Mr. Arens was the previous owner of the property for a substantial number of years and conducted a dairy farm operation on the site, and subsequently sold the _farm to Richard and Carlene Shirey. Subsequent to the sale, the Shireys defaulted and the property was deeded back to Mr. Arens by Public 'Trustee Deed. The dairy operation has continued from its original inception by Mr. Arens, and Mr. Arens is continuing to conduct a dairy operation on the property. A photo copy of the dairy operation as it has existed for approximately the last fifteen (15) years is attached to the application. Mr. Arens is requesting this Use by Special Review to approve his dairy operation and to approve the use of additional mobile homes on the -property for use by employees, to provide housing for the employees. 'The dairy operation that Mr. Arens conducted and what he proposes is to continue an operation as a 400-head dairy herd, with 200 head of replacement and dry cows. The structures that presently exist on the property are the main milking barn, three 20-foot diameter silos, seven pens for the cattle, two metal support buildings, three sheds for the cattle, two mobile homes, a former schoolhouse that has been converted into a residence, and a residence. All cattle pens are properly fenced to provide for the safety of the cattle and the abutting property owners. an addition, there is an existing two-lagoon sewer disposal system for the cattle pens. These lagoons are approximately 64x76 feet, and 75x81 feet. Mr. Arens also has a hay storage area for storage of hay during the winter for feed, and the balance of the property is in pasture ground. Mr. Arens and his family have derived their living from this dairy operation, and the dairy operation is his sole means of support. The surrounding property around the Arens property is agricultural ground. The surrounding properties are either in irrigated crops, pasture ground, or dry land farming. Mr. Arens is a participant in the Western Dairyman's Cooperative, previously known as Mountain Empire Dairyman's Association (MEDA) , and delivers all milk he produces at the farm to Western Dairyman's Cooperative. The distance of the proposed use of Mr. Arens dairy operation to residential structures in each direction is approximately one-fourth (}) mile to the east and one-fourth ( ) mile to the west. Mr. Arens' son, Grant Arens, owns the residence to the south and the east, which residence to the east is approximately one-fourth (}) mile. The closest residence to the north is approximately one full mile. The maximum number of users, patrons, members, and buyers is the applicant himself, and as previously indicated, the applicant sells his 890077 production to Western Dairyman's Cooperative. There are no other users, patrons, members, or buyers. Mr. Arens anticipates the employment will range from five (5) to eight (8) employees because of the need of the operation for three 8-hour shifts. Operating the dairy is a 24-hour a day, 365 days per year operation to properly care for the cattle. The water source for the dairy operation is Central Weld Water, and Central Weld Water has indicated there is adequate water for the operation. Further, the dairy operation has been in existance for in excess of fifteen (15) years, and will be a continuation of the prior operation. The access route to be utilized for the dairy operation is off of Weld County Road 44 by existing accesses. There wll be no additional accesses required for the operation. The vehicular traffic at the operation typically consists of only a two-ton truck approximately two times per week delivering feed, a semi-tractor trailer unit once a year to deliver straw approximately October of each year, the milk pick-up tanker truck, which comes every other day, and approximately two cars a day for the employees. The sewage system for the dairy operation consists of a two-lagoon system, as previously described. There is a six-inch tile from the barn to the lagoons, with the first lagoon retaining the solid waste. Mr. Arens cleans these lagoons approximately once a year, and the solids are removed and taken off of the property and used in the agricultural production processes on his son's farm in Section 23. The various pens the cattle are kept in are scrapped down three times a week, and the solids are removed with a dump truck to a stock pile of manure off the site, at Mr. Arens' son's farm. There are separate septic systems for the barn, one for the house, and mne for the mobile homes. The proposed use is in the LaSalle Fire District, and adequate service can be provided by the Fire District. Fire extinguishers are kept in all vehicles and in the barn. In addition, the barn is constructed of cinder block to add to the fire safety. The types and maximum number o₹ animals will consist of 400 dairy cattle, and 200 replacement and dry cattle part of the time. The replacement and dry cattle will be on the property approximately seven and one-half (7}) months out of the year. During the other time, the cattle are pastured on other property. There will be no on-site stock pile or storage areas of any waste associated with this proposed use. All wastes are removed from the site. 890.377 2 She applicant does not anticipate that any additional storm-water retention facilities will be required, other than the existing lagoons and the ditches existing on the property. The time schedule, removal and disbursal of debris and waste associated with the proposed use is every other day, which is performed by tractors and related equipment owned by the applicant for the removal of manure and waste. All the waste is removed from the site. The applicant does not anticipate that any additional landscaping is necessary on the farm, other than what presently exists. Further, the applicant does not believe any reclamation process is necessary for this farming activity. There is no construction process to be conducted by the applicant, as all improvements are in existance, and have been used by the applicant for approximately fifteen (15) years. The applicant's proposal is consistent with the comprehensive plan of Weld County, and with the intent of the agricultural district. The applicant's location is on property zoned agricultural, and has been used in agricultural activities for numerous years in the past, and has been operated as a dairy for numerous years in the past. This particular site has been a dairy since the late 1960's, early 1970's. Miller Teed Lot is located approximately one and one-half (1§) miles east, and the property is surrounded by agricultural property, and the agricultural use by the applicant is consistent with all the other land uses. _The applicant believes there is adequate provision for the protection of the health, safety, and welfare of the inhabitants in the neighborhood, and the applicant takes extra precautions for the control of odor and insects. The applicant adds an additive to his feed called "Call Back," which is extremely effective in reducing any odor in the manure. The applicant also adds a feed additive called "Fly Block," which kills the _fly larvae in the manure. These two feed additives, the applicant has found, have been very effective in control of odor and flies at the dairy operation. The applicant's use of the property is compatible with the existing surrounding uses as discussed above, as the applicant is continuing a dairy operation on property that has been used as a dairy since approximately 1970, and all surrounding property is in agricultural use. The applicant believes that the proposed use is consistent and compatible with the future development of the surrounding areas as the area is not in any future development plans of any towns, or master plans of any municipalities, nor in any expansion areas or designated areas of the county other than agricultural uses. The proposed use and the property location is not located in any flood plain or geological hazard, nor will it interfere with the Weld County Airport overlay district, and the use by special review complies with all regulations in the Weld County Zoning Ordinance. 890377 3 The applicant is very sure that adequate water is available to the use by special review site, as the applicant has previously operated the dairy, and attached hereto is a letter from the Central Weld County Water District indicating that water is available to the applicant.
