RE: APPROVAL OF RECORDED EXEMPTION NO. 728 - EDWIN AND CAROL
OHMAN
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners, pursuant to its
authority under Section 30-28-101 (10) (d) , CRS , as amended, did
determine at a public meeting held in the Chambers of the Board,
that a certain parcel of land, to be divided into two parcels , as
shown on the plat known as Recorded Exemption No. 728 , does not
come within the purview of the definition of the terms ,
"subdivision" and "subdivided land" , and
WHEREAS , the request for Recorded Exemption No. 728 was
submitted by Edwin and Carol Ohman for property which is located
in Part of the SE4 NEa, Section 5 , Township 6 North, Range 65 West
of the 6th P.M. , Weld County, Colorado, being more particularly
described in the plat which shall be provided by the applicant and
known as Exhibit "A" , said plat to be recorded, and
WHEREAS , this request is to divide the property into parcels
estimated to be approximately 5 acres and 5 acres.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the hereinabove
described parcel of land be , and hereby is , exempt from the
definition of the terms , "subdivision" and "subdivided land" .
BE IT FURTHER RESOLVED by the Board that this approval is
conditional upon the applicant submitting a mylar plat to the
Department of Planning Services to be recorded in the office of
the Weld County Clerk and Recorder. The plat shall be drawn in
accordance with the requirements of Section 9-2C. (4) of the Weld
County Subdivision Regulations. The plat shall be submitted
within ninety days from the date of approval by the Board of
County Commissioners.

Re: Recorded Exemption #728
Dear Commissioners:
The attached application, plat and related items are in reference to a
request from Edwin and Carol Ohman for a recorded exemption. The
parcel of land on which this request is being made is described as part
of the SE= NE1, Section 5, T6N, R65W of the 6th P.M. , Weld County,
Colorado.
The property is located one (1) mile east of Eaton on Weld County Road
41. The property contains approximately 10.223 acres of Class IVs
irrigated and IVe, VIw nonirrigated soils. The parcel of land under
consideration is the total contiguous land holdings of the applicant.
The request is to divide the property into parcels of 5.47 acres and
4.75 acres, more or less. Mr. and Mrs. Ohman propose to further divide
a parcel of land that was created by the Minor Subdivision process in
1972. A second division was requested by the Ohman's in 1979 (RE-400)
and it was denied by the Board of County Commissioners on a 2-2 vote.
RE-728 is a duplication of the 1979 proposal.
Based upon the submitted information and policies of the County, the
Department of Planning Services staff recommends the request be denied
for the following reasons:

- The request does not comply with Section 9-2 E; the
Standards and Conditions for approval of a recorded
exemption. It is the responsibility of the
applicant to demonstrate that the proposal is
consistent with the intent of the district in which
the use is located.
- The subject site is located in an Agricultural Zone
District outside of a projected town growth area.
The minimum lot size in the Agricultural Zone
District is eighty (80) acres for irrigated land
and one hundred sixty (160) acres for dryland.
The further subdivision of a ten (10) acre parcel
into two (2) lots is inconsistent with efficient
and orderly development in the agricultural zone
district outside of a projected town growth area.
- It is the responsibility of the applicant to
demonstrate that the proposed use will be
compatible with the future development of the
surrounding area as permitted by the existing
zoning and with future development as projected by
the Comprehensive Plan of the County.
- The Weld County Future Land-Use Map indicated the
type of development at the subject location is
intended to remain agricultural and the zone
district is intended to remain agricultural.
As explained on pages forty-two (42) and forty-three (43) of the Weld
County Comprehensive Plan, problems occur when agricultural uses and
residential uses are mixed together. As explained in the Comprehensive
Plan on page forty-four (44) , "scattered development in rural areas has
other implications. Residential development in rural areas
necessitates an increase of public service to that area". More people
in the area places additional strain on expenditures for road
maintenance, police protection, fire protection, and education
services. It has not been demonstrated that the increased revenues
generated by development will pay for the required new facilities and
services.

The creation of an additional building site through the recorded
exemption process will have little impact on the need for services;
however, if the recorded exemption becomes the norm and numerous
similar proposals are granted, the above impacts can be expected to
develop.
In this regard, the cost of County services can be reduced if
development is encouraged around existing population centers and future
town growth areas. Development in town growth areas reduces the
conflict that arises between rural and urban land-uses.

Dear Mr. and Mrs. Ohman:
In regard to our telephone conservation on December 4, 1984, concerning the
issue of substantial change, I have been advised by the County Attorney's
Office to inform you of the following public hearing considerations for
Recorded Exemption #728. The Board of County Commissioners will need
evidence on December 19, 1984, that substantial changes have taken place
since their decision on Recorded Exemption #400 to warrant reconsideration
of the issue to divide your property. You will have to demonstrate one of
the following: 1) substantial changes have taken place in the area since
the 1979 Board decision, 2) your application and request for Recorded
Exemption #728 is substantially different from the request submitted for
Recorded Exemption #400, or 3) substantial changes have occurred in the
Subdivision Regulations since your prior application which set forth the
criteria for approval of a Recorded Exemption. The Board of County
Commissioners cannot make a decision on the same item again unless
substantial changes have taken place since their last review.
This office is ready to be of any further assistance in clarifying or
answering questions concerning this matter.

We are requesting this recorded exemption for the following reasons:
1 . Upon purchasing the land in May of 1972, we have tried numerous
times to reseed the pasture land and each time has proved unsuccessful
due to the poor grade of ground and since we have no water shares it
has become too expensive to buy water needed for successful planting
of crops. It is not considered prime farmland but neither is it in
a flood plain or geologic hazard.
2. We feel it would be put to better use as a home site and have
found several parties interested in buying it as such. This would not

affect the area of development as there are already parcels of land
in the amounts of 2 - acres, 5, 10, and 20 acres in this square mile
of Roads 39-41 and 72-74.
