RESOLUTION RE: APPROVE SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW PERMIT FOR GREYHOUND DOG KENNEL (150 DOGS MAXIMUM) - KENT POLLARD WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 27th day of September, 1989, at the hour of 10: 00 a.m. , in the Chambers of the Board for the purpose of hearing the application of Kent Pollard, 4350 Harback Mile Road, Bennett, Colorado 80102, for a Site Specific Development Plan and Special Review Permit for a greyhound dog kennel (150 dogs maximum) on the following described real estate, to-wit: SW$ , Section 18, Township 3 North, Range 64 West of the 6th P.M. , Weld County, Colorado WHEREAS, said applicant was present, and WHEREAS, Section 24 . 4.2 of the Weld County Zoning Ordinance provides standards for review of said Special Review Permit, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1 . The submitted materials are in compliance with the application requirements of Section 24 . 7 of the Weld County Zoning Ordinance. 2. It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24 . 4 . 2 of the Weld County Zoning Ordinance as follows: a. The proposal is consistent with the Weld County Comprehensive Plan' s Agricultural Goals and Policies. The Special Review Permit site is nonproductive farmground. b. The proposal is consistent with the intent of the Agricultural Zone District and is provided for as a / //�� Use by Special Review. 7,to 987 - : 891037 Page 2 RE: USR - POLLARD c. The uses which would be permitted on the property will be compatible with the existing surrounding land uses which include nonproductive farmground, rural residences, oil and gas production, a turkey farm, and a large cattle livestock confinement operation which is located in part of the northeast quarter of this section. The use of the property is compatible with the future development of the surrounding area as permitted by the Agricultural Zone District. d. No overlay districts affect the site. e. Special Review Development Standards will provide adequate protection of the health, safety and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application for a Site Specific Development Plan and Special Review Permit for a greyhound dog kennel (150 dogs maximum) on the hereinabove described parcel of land be, and hereby is, granted subject to the following conditions: 1 . The attached Development Standards for the Special Review Permit shall be adopted and placed on the Special Review plat prior to recording the plat. The plat shall be delivered to the Department of Planning Services and be ready for recording in the office of the Weld County Clerk and Recorder within 15 days of approval by the Board of County Commissioners. 2. The Special Review activity shall not occur nor shall any building or electrical permits be issued on the property until the Special Review plat is ready to be recorded in the office of the Weld County Clerk and Recorder. 3 . Prior to the issuance of building permits, a Soil Erosion Control Plan approved by the West Greeley Soil Conservation District shall be submitted to the Department of Planning Services. 4 . The Site Specific Development Plan and Special Review Permit is for a greyhound kennel in the A (Agricultural) Zone District as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated herein. The maximum number of dogs shall not exceed 150. 2 . Approval of this plan may create a vested property right pursuant to Article 68 of Title 24 , C.R.S. , as amended. 3 . The applicant shall remove, handle, and stockpile manure from the kennel area in a manner that will prevent nuisance conditions. The manure piles shall not be allowed to exist or deteriorate to a condition that facilitates excessive odors, flies, insect pests, or pollutant runoff. The manure storage site shall have a water-tight surface which does not permit seepage or percolation of manure pollutants into the ground. 4 . Liquid and solid wastes shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. _5 . No permanent disposal of wastes other than dog manure shall be permitted at this site. -6 . Wood shavings, sawdust, and waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. 7. Fugitive dust must be confined on this site. 8. The well water provided to the animals shall be potable. 9. The maximum permissible noise level shall not exceed 55 dB (A) from 8 : 00 p.m. until 6 :00 a.m. and from 6 : 00 a.m. until 8: 00 p.m. shall not exceed 80dB (A) as measured by 25-12-102, C.R.S. 891037 Page 2 DEVELOPMENT STANDARDS - POLLARD 10. An individual sewage disposal system or vault is required for -the dog kitchen and employee restroom facilities. The system shall be designed by a registered professional engineer and installed according to Weld County Individual Sewage Disposal System regulations. Any floor drains or liquid waste streams shall be disposed by an authorized Individual Sewage Disposal System according to Weld County regulations. 11 . The Soil Erosion Control Plan approved by the West Greeley Soil Conservation District shall be maintained on the property. 12. The greyhound kennel facility shall comply with the Colorado Racing Commission's Rules and Regulations pertaining to greyhound kennels. 13. No structure shall be constructed within Panhandle Eastern -Pipe Line Company' s 65-foot right-of-way easement. 14 . Written approval shall be obtained from Panhandle Eastern Pipe Line Company for the construction of utility lines, streets, sidewalks, and driveways within Panhandle Eastern Pipe Line Company's 65-foot right-of-way easement. Two working days prior to the start of construction, the Utility Notification Center of Colorado shall be notified so that all utilities can be located and identified. 15 . All construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 16 . The property owner or operator shall he responsible for complying with the Design Standards of Section 24 .5 of the Weld County Zoning Ordinance. 17. The property owner or operator shall be responsible for complying with the Operation Standards of Section 24 . 6 of the Weld County Zoning Ordinance. 18. Personnel from the Weld County Health Department, West Greeley Soil Conservation District, and Weld County l2epartment of Planning Services shall be granted access onto -the property at any reasonable time in order to -ensure the activities carried out on the property comply with the Development Standards stated herein and all applicable Weld County Regulations. 891037 Page 3 DEVELOPMENT STANDARDS - POLLARD 19. Wood shavings, saw dust, and waste materials shall be handled, stored, and disposed in a manner that Controls fugitive dust, blowing debris, and other potential nuisance conditions. 5. Fugitive dust must be confined on this site. 6. It should be determined that the well water to be -provided for the animals is potable. 7. The maximum permissible noise level shall not exceed 55dB(A) from 8:00 p.m. until 6:00 a.m. and from 6:00 a.m. until 8:00 a.m. shall not exceed 80dB(A) as measured by 25-12-102 CRS. 8. An individual sewage disposal system or vault is required for the dog kitchen and employee restroom facilities. Due to this fact , wind erosion is the prime erosion factor as both these soils are very susceptible to wind erosion when there is a loss of surface protection such as loss of vegetation or the soil surface is left bare . I would suggest Mr. Pollard keep surface vegetative disturbances to a minimum and only grade those areas essential for building construction , and k-eep that to as small as possible . Roadways should be covered with good quality roadbase material to prevent blowout conditions from occuring . Kennel runways and interior fenced should be left in native vegetation as much as practical to prevent or lessen wind erosion . Revegetation should be considered as soon as possible after construction to suited grass species to decrease wind erosion potential . Special care will be needed to select adapted tree species for wind breaks and tree plantings due to low water holding capacity of the site soils .
