RESOLUTION
RE: APPROVAL OF USE BY SPECIAL REVIEW FOR A LIVESTOCK CONFINEMENT
OPERATION FOR 400 HEAD OF CATTLE - GEORGE AND ORVILLE GOODELL
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld _County Home
Rule Charter , is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners held a public
hearing on the 10th day of September, 1986 , at the hour of 2 : 00
p.m. in the Chambers of the Board for the purpose of hearing the
application of _George and Orville Goodell, 15 Oak Street, Eaton ,
Colorado 80615 , for a Use by Special Review for a livestock
confinement operation for 400 head of cattle an the -following
described zeal estate , to-wit:
Part of the SE4, Section 21 , Township 7 North,
Range 66 West of the 6th P.M. , Weld County,
Colorado
WHEREAS, Section 24 . 4. 2 of the Weld County Zoning Ordinance
provides standards for review of said Use by Special Review, and
WHEREAS, the Board of County Commissioners heard all of the
testimony and statements of those present, has studied the request
of the applicant and the recommendations of the Weld County
Planning Commission and all of the exhibits and evidence presented
in this matter and, having been fully informed, finds that this
request shall be approved for the following reasons:
1 . The submitted materials are in compliance with the
application requirements of Section 24 .7 of the Weld
County Zoning Ordinance.
2. It is the opinion of the Board of County Commissioners
that the applicant has shown compliance with Section
24 . 4 . 2 of the Weld County Zoning Ordinance as follows:
a. The proposal is consistent with the intent of the
Weld County Comprehensive Plan . The Comprehensive
Plan encourages the development of agribusiness and
agriculturally oriented industry provided these
enterprises do not adversely affect the local
economy or environment.
b. The proposed use is an agricultural activity and
is, therefore, consistent with the intent of the
Agricultural Zone District.

c. The uses permitted will be compatible with the
existing surrounding land uses and with future
development of the surrounding areas as permitted
by the Agricultural Zone District.
d. Ault and Eaton' s Planning Commissions have reviewed
this request and have no objections.
e. No overlay districts affect the site.
f. Use by Special Review Development Standards will
provide adequate protection of the health , safety
and welfare of the neighborhood and County.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the application for a
Use by Special Review for a livestock confinement operation for
400 head of cattle on the hereinabove described parcel of land be,
and hereby is, granted subject to the following conditions:
1 . The attached Development Standards for the Use by
Special Review permit be adopted and placed on the Use
by Special Review plat prior to recording the plat.
2. The Use by Special Review activity shall not occur nor
shall any additional building or electrical permits be
issued on the property until the Use by Special Review
plat has been delivered to the Department of Planning
Services Office and the plat is ready to be recorded in
the office of the Weld County Clerk and Recorder.
3 . Within thirty days of final approval by the Board of
County Commissioners , the applicant/operator shall
submit to the Colorado Department of Health, Water
Quality Control Division , an engineering report
demonstrating compliance with its Guidelines for Design
of Feedlot Runoff Containment Facilities. The report
shall conform to the requirements of Section 8 . 3 . 4 of
the Colorado Department of Health , Water Quality Control
Commission' s Guidelines for Designs of Feedlot Runoff
Containment Facilities . -The applicant/operator shall
submit evidence of approval by the Colorado Department
of Health , Water Quality Control Division , to the
Department of Planning Services within 120 days of final
-approval by the Board of County Commissioners.

DEVELOPMENT STANDARDS
George and Orville Goodell

1 . The Use by Special Review permit is for a livestock
confinement operation for cattle as submitted in the
application materials on file in the Department of Planning
Services Office and subject to the Development Standards
stated herein . The -maximum number of cattle permitted shall
be 400 head of cattle.
2. The applicant shall be responsible for implementing and
maintaining the feedlot runoff containment system in
accordance with the engineered report, as approved by the
Colorado Department of Health, Water Quality Control
Division . All waste retention facilities shall meet and be
maintained in accordance with the State Health Department' s
Guidelines for Design of Feedlot Runoff Containment
Facilities. The applicant shall be responsible for any
additional requirements issued by the Colorado Department of
Health, Water Quality Control Division. The feedlot runoff
containment facility shall be in operation within six months
from the date of approval by the Board of County
Commissioners.
3 . All construction done on the -property shall be in accordance
with the requirements of the Weld County Building Code
Ordinance.
4 . The property owner or operator shall be responsible for
complying with the Design Standards of Section 2-4. 5 of the
Weld County Zoning Ordinance.
5 . The property owner or operator shall be responsible for
complying with the Operation Standards of Section 24 . 6 of the
Weld County Zoning Ordinance.
6 . Personnel from the Weld County Health Department and Weld
County Department of Planning Services shall be granted
access onto the property at any reasonable time in order to
insure the activites carried out on the property comply with
the Development Standards stated herein and all applicable
Weld County Regulations.

7. The Use by Special Review area shall be limited to the plans
shown herein and governed by the foregoing Standards and all
applicable Weld County Regulations. Any material deviations
from the plans or Standards as shown or stated shall require
the approval of an amendment of the Permit by the Weld County
Planning Commission and the Board of County Commissioners
before such changes from the plans or Standards are
permitted. Any other changes shall be filed in the office of
the Department of Planning Services.
8. The property owner or operator shall be responsible for
complying with all of the foregoing Standards. Noncompliance
with any of the foregoing Standards may be reason for
revocation of the permit by the Board of County
Commissioners.

I hereby certify that pursuant to a notice dated August 20, 1986, and
duly published August 28, 1986, in the Johnstown Breeze, a public
hearing was conducted to consider the application of George and Orville
Goodell for a Use by Special Review for -a livestock confinement
operation for 400 head of cattle. Lee D. Morrison, Assistant County
Attorney, made this matter of record. Debbie de Besche, Planning
Department representative, read the favorable recommendation of the
Planning Commission into the record. She said three Conditions and
eight Development Standards are associated with this request. George
Goodell, one of the applicants, came forward to answer questions of the
Board. He said he has no objections to the proposed Development
Standards. No public comment was received concerning this request.
Commissioner Lacy moved to approve the request for -a Use by Special
Review, subject to the Conditions and Development Standards as
recommended by the Planning Commission. Commissioner Yamaguchi
seconded the motion which carried unanimously.
This Certification was approved on the 15th day of September, 1986.

APPEARANCE:
Orville Goodell, property owner and applicant, stated this property has been
a feedlot for forty years with the same amount of cattle they are now asking
for, but they have now sold their land to the town of Thornton and are just
retaining the nine acres. The feedlot will cover about three acres of the
nine acre parcel they are keeping.
The Chairman asked Mr. Goodell if he had reviewed the recommendations,
conditions, and development standards as outlined by the Department of
Planning Services -staff. He stated they have and have no objections to
them.
The Chairman called for discussion -from the members of the audience. There
was none.
The Planning Commission discussed drainage lans and the lagoon requirements
with Mr. Goodell.
AMENDMENT:
Ann Garrison moved Development Standard #2 be amended to contain a time for
the applicant to comply with the State Health Department's recommendation to
read as follows:
The applicant shall be responsible for implementing and
maintaining the feedlot runoff containment system in accordance
with the engineered report, as approved by the Colorado Department
of Health, Water Quality Control Division. All waste retention
facilities shall meet and be maintained in accordance -with the
State Health Department's Guidelines for Feedlot Runoff Contain-
ment Facilities. The applicant shall be responsible for
any additional requirements issued by the Colorado Department of
Health, Water Quality Control Division. The feedlot runoff
containment facility shall be -in operation within six (6) months
from the date of approval by the Board of County Commissioners.

LOCATION: Approximately 5.5 miles west of Platteville; north of Colorado
State Highway 66 and east of Weld County Road 13
APPEARANCE:
Robert Abrams, Agricultural Manager, Western Sugar Company, represented the
applicants. He reported the Sugar Company has looked a long time for such a
site. It will take care of approximately 45 growers in the area. He also
explained their intended layout of the equipment and beet piles on the land.
NOTICE: Louis Rademacher asked to be excused from participating in this
request because of a conflict of interest.

2. It is the opinion of the Weld County Planning Commission that the
applicant has shown compliance with Section 24.3 of the Weld
County Zoning Ordinance as follows:
- The proposal is consistent with the intent of the Weld
County Comprehensive Plan. The Comprehensive Plan
encourages the development of agribusiness and
agriculturally oriented industry provided these
enterprises do not adversely affect the local economy or
environment;
- The proposed use is an agricultural activity and is
therefore, consistent with the intent of the
agricultural zone district;
- The uses permitted will be compatible with the existing
surrounding land uses and with future development of the
surrounding areas as permitted by the agricultural zone
district;
- Ault and Eaton's Planning Commissions have reviewed this
request, and have no objections;
- No overlay districts affect the site; and

Use by Special Review Development Standards will provide
adequate protection of the health, safety and welfare of
the neighborhood and County.
This recommendation is based, in part, upon a review of the application
submitted by the applicant, other relevant information regarding the request
and the responses of the referral entities which have reviewed this request.
The Planning Commission's recommendation for approval is conditional upon
the following:
1. The attached Development Standards for the Use by Special Review
permit be adopted and placed on the Use by Special Review plat
prior to recording the plat.
2. The Use by Special _Review activity shall not occur nor shall any
additional building or electrical permits be issued on the
property until the Use by Special Review plat has been delivered
to the Department of Planning Services' office and the plat is
ready to be recorded in the office of the Weld County Clerk and
Recorder.
3. Within 3_0 days of final approval by the Board of County
Commissioners, the applicant/operator shall submit -to the Colorado
Department of Health, Water Quality Control Division, an
engineering report demonstrating compliance with its
Guidelines for Design of Feedlot Runoff Containment Facilities.
The report shall conform to the requirements of Section 8.3.4 of
the Colorado Department of Health, Water Quality Control
Commission's Guidelines for Designs of Feedlot Runoff Containment
Facilities. The applicant/operator shall submit evidence of
approval by the Colorado Department of Health, Water Quality
Control Division, to the Department of Planning Services within
one hundred twenty (120) days of final approval by the Board of
County Commissioners.

1. The Use by Special Review permit is -for a livestock confinement
operation for cattle as submitted in the application materials on file
in the Department of Planning Services and subject to the Development
Standards stated hereon. The maximum number of cattle permitted shall
be four hundred (400) head of cattle.
2. The applicant shall be responsible for implementing and maintaining the
feedlot runoff containment system in accordance with the engineered
report, as approved by the Colorado Department ofHealth, Water Quality
Control Division. All waste retention facilities shall meet and be
maintained in accordance with the State Health Department's Guidelines
for of Feedlot Runoff Containment Facilities. The applicant shall be
responsible for any additional requirements issued by the Colorado
Department of Health, Water Quality Control Division. The feedlot
runoff containment facility shall be in operation within six (6) months
from the date of approval by the Board of County Commissioners.
3. All Construction done on the property shall be in accordance -with the
requirements of the Weld County Building Code Ordinance.
4. The property owner or operator shall be responsible for complying with
the Design Standards of Section 24.5 of the Weld County Zoning
Ordinance.
5. The property owner or operator shall be responsible for complying with
the Operation Standards of Section 24.6 of the Weld County Zoning
Ordinance.
6. Personnel from the Weld County Health Department and Weld County
Department of Planning Services shall be granted access onto the
property at any reasonable time in -order to insure the activities
carried out on the property comply with the Development Standards
stated hereon and all applicable Weld County Regulations.
7. The Use by Special Review area shall be limited to the plans -shown
hereon and governed by the foregoing Standards and all applicable Weld
County Regulations. Any material deviations from the plans or
Standards as shown or stated shall require the approval of an amendment
of the Permit by the Weld County Planning Commission and the Board of
County Commissioners before such changes from the plans or Standards
are permitted. Any other -changes shall be filed in the office of the
Department of Planning Services.
8. The property owner or operator shall be responsible for complying with
all of the foregoing Standards. Noncompliance with any of the
foregoing Standards may be reason for revocation of the Permit by the
Board of County Commissioners.

POSSIBLE ISSUES SUMMARIZED FROM APPLICATION MATERIALS:
The criteria for review of this -proposal is listed in Section 24.3 of the
Weld County Zoning Ordinance.
The applicant made application for a recorded exemption to split their
property into a 310 acre parcel and a 9 acre parcel, more or less, in May
1986. Recorded Exemption #886 was approved on June 9, 1986, with a
condition of the owner/applicant submitting a complete Use by Special Review
application.
The applicant is requested to obtain approval of a Use by Special Review
permit to continue the feedlot operation on nine acres of land. Nine acres
allows for 9 animal units or 36 head of cattle. The applicant is requesting
400 head of cattle.
The Department of Planning Services staff has received specific
recommendations from:
The Weld County Health Department; and
The West Greeley Soil Conservation District.

I have reviewed the Weld County referral from George and Orville Goodell
for a Use by Special Review permit for a livestock confinement operation
for cattle in part SE 114 of Section 21 , T7N , R66W. This location is
approximately 2 3/4 mires southwest of Ault , north of Weld County Rd . 78
and west of Weld County Rd . 31 .
The request mentions a total area of 9 . 17 ac . but the actual feedlot area
is + 1 . 8 acres . The facility seems adequate except there is presently no

DESCRIPTION OF Tllzi PROPOSED OPERATION
The proposed use is for a feedlot operation which is now in existence
and in operation. The existing uses on surrouding properties are
agricultural, feedlot operation -and residential. Residential structures
'ire Located to the south one quarter mile, the west one quarter mile and
the north one quarter mile.
One family will five on the premises and will manage the feedlot . No
other employees will he hired. Water source is from the North Weld
Water District and is purchased for the feedlot and residence. Access
routes are th existing county roads, primarily Weld County Rd. 11 tw Rd. ;R .
One feed truck will he used for the feedlot operation. The approximate
weight is 14, 50011. A septic tank is used fur the house on the property.
The property is in the Ault fire district. A maximum of four hundred head
of cattle will be fed. We have weekly trash removal from the residence.
Feedlot waste will be loaded and hauled off in trucks in the spring and
fall .
This proposal is agri-business and therefore consistent with the
Weld County Comprehensive Plan. The feedlot operation will be
consistent with the intent of the district which is agriculture and
business relating to agriculture. In the past years the feedlot
operation has not posed a hazard to the health, safety and welfareof the inhabitants of the area and the county; and we will continue
to protect all concerned parties. This proposal will be compatible
with the existing surrounding land uses which are agri-business. The
special review area is in an agricultural zone and we expect this area
and the surrounding areas to remain agricultural for many more years.
This area is -located far enough away from Eaton and Ault so it should
not affect these municipalities. We do not expect such rapid growth
of Eaton and Ault that might cause any problems with our proposed plan.
