RE: APPROVAL OF INTERGOVERNMENTAL AGREEMENT BETWEEN WELD COUNTY
AND CITY OF EVANS AND AUTHORIZATION FOR CHAIRMAN TO SIGN
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS , the Board has been presented with an
Intergovernmental Agreement between Weld County and the City of
Evans for the application for funds for the Rental Rehabilitation
Program, and
WHEREAS, the terms and conditions are as stated in said
Intergovernmental Agreement, a copy of which is attached hereto
and incorporated herein by reference, and
WHEREAS, after review, the Board deems it advisable to
approve said Intergovernmental Agreement.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the Intergovernmental
Agreement between Weld County and the City of Evans be, and hereby
is, approved.
BE IT FURTHER RESOLVED by the Board that the Chairman be, and
hereby is , authorized to sign said Intergovernmental Agreement.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 3rd day of
April, A.D. , 1985 .

INTERGOVERNMENTAL AGREEMENT
THIS AGREEMENT, entered into this 3rd day of April , 1985, by and
between the BOARD OF COMMISSIONERS OF WELD COUNTY, COLORADO, a body politic
of the State of Colorado, hereinafter called "the County" and the Town of
Evans , a body politic hereinafter called "the City".
WITNESSETH:
WHEREAS, pursuant to the Housing and Urban-Rural Recovery Act of 1983
hereinafter called "the Act", the United States, acting by and through the
Secretary of the Department of Housing and Urban Development, hereinafter
called "HUD" has made available to the State of Colorado certain funds
available from the Rental Rehabilitation Program of the ACT; and
WHEREAS, the State of Colorado, through the Department of Local
Affairs has the legal authority to provide funds to counties for
rental rehabilitation activities; and
WHEREAS , the City has expressed interest in allowing the program to
operate within its jurisdiction; and
WHEREAS, the County has indicated a willingness to submit a program
proposal to the State to carry out the HUD Rental Rehabilitation; and
WHEREAS, the parties hereto desire to provide assurances and delineate
the areas of cooperation between the County and the City with respect to
Rental Rehabilitation activities;
NOW, THEREFORE, in furtherance of said Resolution, and in consider-
ation of the mutual conditions, covenants and agreements herein contained,
it is acreed by and between the parties as follows:
1. Planning the Rental Rehabilitation Program. The parties, through
their executives and staff, shall cooperate with each other in developing
tii rental rehabilitation proposal, with all parties riving due consider-
ation to the needs of its citizens and goals, objectives, rules and regu-
lations of the Act.
2. Term of Agreement. This agreement shall remain in full force and
effect until the program proposal is approved by the State and a contract
executed by all parties.
3. Authorization to submit a proposal. The County is authorized to
submit a proposal to the State ou behalf of the City to apply for funds
under the HUD Rental Rehabilitation Program and to act on behalf of the
City with regard to any subsequent negotiations, presentations or informa-
tion in conjunction with the grant application.

4. The City shall have no obligations or responsibilities, financial or
otherwise, concerning the administration of the Rental Rehabilitation Program
and the County agrees to indemnify the City from any and all liability, loss or
damage the City may suffer in connection with the administration of the project
upon approval of the proposal.
